James Lewis, bridge supervisor, met with the commission to update them on ongoing work. James advised that his crew will be working on repairing and replacing tubes in Colfax Township again this week. They will also be cutting brush in Washington Township and repairing bridge boards across the county. Wayne Uthe advised James that a bridge on 190th Street in Sheridan Township needed a few boards replaced.
Discussion was held regarding the progress on the townships spreading their CART rock for this year. The issue was continued.
Cheryl Alexander, Daviess County Health Director, spoke to the commission by phone to update them on the current COVID-19 cases. As of Oct. 14, Daviess County had 209 positive cases and 128 active cases, with three deaths and 10 persons hospitalized.
Ronetta Burton, county clerk, presented the commission her training certificate for 2020.
The commission discussed new and ongoing applications for CARES Act funding. The issue was continued until next week.
Jim Ruse will be working on the specs for a bid notice regarding sealing and tuckpointing the outside of the courthouse for next week.

Circuit Court
The following cases were heard by Judge Ryan Horsman on Law Day, Oct. 14, 2020:
James Cranmer was sentenced to four years in the Missouri Department of Corrections (DOC) for domestic assault third degree, E felony. The court ordered placement in the 120-day program under Section 559.115 RSMo general population. On a misdemeanor charge of domestic assault fourth degree, Cranmer was sentenced to one year jail, execution of sentence suspended, and he was placed on two years probation supervised by the court. The sentence will run consecutively to any other sentences being served.
David Deming pled guilty to possession of controlled substance, D felony, misdemeanors of drug paraphernalia, possession of marijuana, no insurance, and infractions of displayed plate of another and no seat belt. A sentence assessment report was ordered.
Joshua Wyatt pled guilty to domestic assault and kidnapping, D felonies, and was sentenced to five years in the DOC on each count, to be served concurrently. On a charge of misdemeanor operating vehicle without valid driver’s license, he was sentenced to 90 days jail with credit for time served.
In State vs. Mathew Rouner, a change of venue to Livingston County was granted. He is charged with stealing motor vehicle, burglary second degree, three counts of stealing firearm, and one misdemeanor of stealing.
Probation was continued and extended one year for April D. Brown with the special condition of Court Order Detention Sanction in DOC for 120 days, on a charge of possession of controlled substance.
Eric Tate was appointed as special prosecutor in two cases, State vs. Amber Gann and State vs. Toni Yarbrough. They are each charged with domestic assault first degree, B felony.
Probation was revoked for Tara Hendrix on a charge of no valid license and the previously imposed four-year sentence in the DOC was imposed.
A jury trial for Dustin Florez was set for April 20-21, 2021 on charges of domestic assault first degree, A felony, kidnapping, B felony, and armed criminal action unclassified felony.
A jury trial for Michael Clyde-David Moses was continued to Dec. 3-4. He is charged with assault first degree, A felony, armed criminal action, unclassified felony, resisting arrest, two counts leaving scene of accident, and attempted stealing.
State vs. Bryan Norton was assigned to Judge Brent Elliott. Norton is charged with trafficking drugs, possession of controlled substance, no valid license, drug paraphernalia, and a plate infraction. On Oct. 16 Judge Elliott set a jury trial for Jan. 11, 2021.
All inmates who are in the DDCRJ appear in court hearing via Zoom. Prisoners who are in the Department of Corrections appear via video. Most other defendants appear in person in the court.
In 2021, Judge Ryan Horsman, Division 1, will be handling circuit criminal cases in Daviess County; Judge R. Brent Elliott, Division 2, will be handling civil and juvenile cases in Daviess County.
Cases bound over from the Associate Division: State vs. Katrina Michele England of Maysville, change of venue from DeKalb County. England is charged with three counts of abuse or neglect of child, no sexual contact, and two counts of endangering welfare of a child, no sexual conduct.
Civil case filed: Joshua D. Jarvis vs. Department of Health and Senior Service Bureau of Vital Records, petition to establish record of birth; Viking Valley Association vs. Susan Sill of St. Joseph and William Logston of Altamont, petition for ejectment and quiet title; Jesse L. Gray vs. Missouri State Highway Patrol et al, petition for expungement.

Assessor’s Office
A representative from the State Tax Commission (STC) worked in the field with staff members of the assessor’s office on Oct. 19 in Washington and Lincoln Townships. STC representatives will be in Daviess County one day a week for the next month.
The assessor and staff continue to review and pick up new construction in Liberty Township, and will progress to Jamesport and Union Townships.
