In-person court appearances begin; several receive DOC sentences

County Commission
James Lewis, bridge supervisor, updated the commission by phone on ongoing work. James advised that they are working in Jackson Township this week pouring concrete for a bridge repair. The brush mower is back to work mowing in Lincoln Township.
Jim Ruse called Christa Sullenger with the title office to check on the land transfer for Saber Road project. The county should have title documents by next week.
Jane McKinsey, recorder, met with the commission to advise them her training conference this year will be transitioned to a virtual event.
Mitchell Ott, Double Ott Lawn Care, met with the commission to discuss details of finishing the landscaping around the courthouse. They also discussed spraying the white clover in the lawn. The road and bridge crew will get the rock and help with the placement.
Cheryl Alexander, Daviess County Health Director, spoke to the commission by phone to update them on COVID-19. She advised there are two more cases in the county as of last Wednesday afternoon. Cheryl called back to say there is one more new case, which makes a total of seven, with four active. Rural auctions are continuing to be problematic with people standing too close to each other; auctioneers have been advised. Cheryl is also working with the nursing home to update procedures.
Discussion was held regarding the CARES Act Funds. Wayne Uthe made a motion to proceed with Phase I of the disbursement of funds using the Uniform Plan document, the Poli-Sub Grant document, and the Intergovernmental Agreement document; David Cox seconded, and the motion passed, 3-0. Ronetta Burton, county clerk, will send grant packets to all political subdivisions based in the county before the end of the week.
Wayne Uthe advised he had been in contact with Matt Nalle, and he would be sending a letter soon regarding work on the gravel road leading to the new CAFO hog barns.
Discussion was held regarding the care center lease. Ronetta Burton advised she was waiting on the signed copy from Ed Osby which should arrive today. The issue was continued until next week.
Ronetta Burton advised she had heard from Farmers Bank regarding an old safe deposit box in the county’s name. The bank will advise when they are ready to open the box. David Cox made a motion to remove the names of Randy Sims, Carl Carder, and Betty Harmison from the safe deposit box and add Jim Ruse, David Cox and Wayne Uthe; Wayne Uthe seconded, and the motion passed, 3-0.
Discussion was held on how long to wait before property owners would have the brush mowing costs added to their tax bills. Anyone who has received a brush letter in the past, but has not eradicated the brush, will need to get compliant soon to avoid an increase in their property tax bill for 2020.
Discussion was held regarding the water bill increase. Jim Ruse spoke by phone to Lance Rains. No refund will be made. Discussion was also held regarding a wiring issue for two of the light poles on the west side of the square. The issue was continued until next week.
Cazes Johnson, Snyder and Associates, met with the commission to finalize documents related to BRO 31 (34) bridge. The bridge is now complete and open. David Cox made a motion to accept the final closeout from Snyder and Associates on BRO31 (34) bridge; Wayne Uthe seconded, and the motion passed, 3-0. The final bill from Boone Construction was presented for payment. Final documents will be executed by MoDOT and Snyder at a later date.
The commission spoke by phone with Harold Anderson, Colfax Township landowner, regarding a culvert issue on Titan Avenue between 140th Street and 145th Street. The commission will check to see if this culvert is county owned or township owned. Road issues will be forwarded to Colfax Township.
In the afternoon, the commissioners checked roads, bridges, and culverts in Harrison, Jackson, and Colfax townships.

Circuit Court
The following defendants made personal appearances before Judge Ryan Horsman on June 10:
Connor Monteer was sentenced to seven years in the Missouri Department of Corrections (DOC) for assault second degree, D felony. The court retains jurisdiction for 120 days under Section 559.115.2, general population. Monteer was sentenced to 180 days jail with credit for time served for kidnapping third degree, A misdemeanor.
Shane O’Dell was sentenced to five years in the DOC for endangering the welfare of a child, D felony. The court retains jurisdiction for 120 days under Section 559.115.2, general population.
He was sentenced to one year jail for misdemeanor endangering welfare of a child, execution of sentence suspended, and received two years probation.
Shaun David Yoder was sentenced to four years in the DOC for failure to register as a sex offender, E felony. The execution of sentence was suspended and he was placed on five years probation.
Ronald Fanning pled guilty to assault third degree, E felony, and was sentence to four years in the DOC. Execution of the sentence was suspended, and he was placed on five years probation.
Lori Bolin pled guilty to domestic assault third degree, E felony, and a sentence assessment report was ordered.
Nacole Jones failed to appear on a probation violation. A warrant was issued with bond set at $5,000 cash only.
Charles Oakgrove pled guilty to possession of controlled substance, D felony, and unlawful possession of drug paraphernalia, D misdemeanor. A sentence assessment report was ordered.
Christian L. Hogan received a suspended imposition of sentence and placed on five years probation for domestic assault third degree, E felony, and harassment first degree, E felony. He was sentenced to 60 days jail for stalking second degree, A misdemeanor, execution of sentence suspended, and placed on probation.
Dawson Levi Davis received a suspended imposition of sentence and five years probation for unlawful possession of illegal weapon, D felony. On a misdemeanor charge of possession of liquor by a minor, he received a suspended imposition of sentence and two years probation. He was also ordered to serve 100 hours of community service.
Mark Lundy failed to appear on a probation conditions review. A warrant was issued with bond set at $1,500 cash only.
The following cases were heard via Zoom:
A jury trial for Dennis McBroom was set for Dec. 2, 2020, on charges of DWI chronic, C felony, and three misdemeanor traffic offenses.
Dennis Swearingin of Altamont pled guilty and was sentenced to five years in the DOC on each of two separate counts of burglary second degree, D felony. He was ordered to pay restitution of $625 and $500. In misdemeanor charges in the two separate cases, he was sentenced to 30 days jail on two counts of property damage and two counts of stealing, with credit for time served.
A jury trial was set for Dustin Florez of Winston on Oct. 1-2 on charges of domestic assault; kidnapping, facilitating A Felony, inflicting injury, terrorizing 1st degree; and armed criminal action.
Gordon Byrom et al vs. Public Water Supply District was dismissed by the parties.
Civil cases filed: Sandra Dustman, Jamesport, vs. Richard Dustman, Jamesport, dissolution of marriage.
Associate Division
James A. Waggoner, Pattonsburg, was charged June 9 with no valid license, E felony, and operating motor vehicle knowing owner has not maintained financial responsibility, D misdemeanor.
Civil Court
Breach of contract: A consent judgment was entered for Second Round SU B LLC and against Donna J. Thomas.
Suits on account: Default judgments were entered for Midland Funding LLC and against Mary Browning; for Midland Credit Management Inc. and against Maranda Neeley; and for Harrison County Community Hospital and against Steven B. Brown et al. Harrison County Community Hospital vs. Michael A. Youngs et al was dismissed by the parties.
