County Commission
Commissioner David Cox heard from Dick Carpenter, Harrison Township, regarding the purchase of a trencher for ditching and an issue with a low water crossing.
Commissioner Cox also heard from Brian Teel, Marion Township, regarding CART rock and repairs to a box culvert. He also discussed some needed repairs near 110th Street.
Larry Gordon, Jefferson Township resident, spoke to the commission by phone about a gravel road that needs some spot rock. The commission advised he speak with Jefferson Township.
Craig Lambert, Marion Township resident, met with the commission to discuss road issues.
James Lewis, bridge supervisor, updated the commission on ongoing work. They are working on replacing bridge railing in Sheridan Township, and working on bridge beams on a bridge in Marion Township.
Aaron McVicker, SKW Engineering, advised the commission that preliminary plans normally run $35,000 for engineering specs and another $15,000 for site inspections during construction.
David Roll, EMA, Cheryl Alexander, Daviess County Health, and Mike Booth, SEMA, met with the commission to discuss COVID-19. Cheryl advised that there are no reported cases of COVID-19 in Daviess County. David Roll advised the state will be doing weekly advisories on new cases. Cheryl advised that the nursing home and regional jail are using their normal flu protocols. She also recommended that for accurate information about the virus, everyone should be using the websites for the Centers for Disease Control (CDC) and the Department of Health.
Frank Blakemore, Graver Engineering, met with the commission to discuss their services if the county has any upcoming bridge projects.
Francis Engineering notified the commission that a new CAFO is proposed to be built south of Highway C and east of Interstate 35 in Salem Township.
Jennifer Pankau, Daviess County Nursing & Rehab, notified the commission that they were restricting visitors at the nursing home indefinitely due to the concerns over the flu virus and the COVID-19 virus.
Commissioner Jim Ruse advised he had spoken to someone about repainting the roof of the 2011 Tahoe. Discussion was held regarding options that are available. Wayne Uthe made a motion to use Woody’s Repair by Terry McLey to make the repairs; David Cox seconded, and the motion passed, 3-0.
Discussion was held regarding information brought to the commission by Pam McNeel, collector/treasurer, concerning additional security she has implemented for county accounts. Notification will be sent to other elected officials.
Discussion was held regarding what the use tax amount for Daviess County is – 1.5% same as sales tax.
In the afternoon the commission looked at bridges, culverts, and brush in Marion, Benton and Washington Townships.

Amended: Bid Opening March 4
The Nail Excavating bid was missed when the other bids were opened on March 4. The bid has not been let so this bid was opened on March 11 at 10 a.m. The Nail Excavating bid is $11,700.
Circuit Court
The following cases were heard by Judge Ryan Horsman on March 11.
Brian S. Alexander was sentenced to five years in the Department of Corrections (DOC) on a D felony charge of forgery. Execution of sentence was suspended, and he was placed on five years’ probation.
Jesse A. Brock pled guilty to damage to jail, E felony. He was sentenced to four years in the DOC, execution of sentence suspended, and placed on five years’ probation.
On a motion for change of judge, State vs. Charles W. Burnett was transferred to the presiding judge for assignment and on March 13, the case was assigned to Judge Brent Elliott. Burnett is charged with stealing $750 or more, D felony.
Stacy Mae Clark pled guilty to four counts of forgery, D felony, and was sentenced to four years DOC on each count, to be served concurrently. The court retains jurisdiction for 120 days under 559.115 (3) and ordered completion of an institutional treatment program.
A jury trial set for Dustin Florez on April 9-10 was vacated. He is charged with domestic assault first degree, A felony; Kidnapping – Facilitating A Felony – Inflicting Injury – Terrorizing – 1st Degree, B felony; and armed criminal action, unclassified felony.
Joscelynn Russell had previously pled guilty on Jan. 15. He received a suspended imposition of sentence on two counts of possession of controlled substance, D felony, and two counts of endangering welfare of a child, D felony, and was placed on five years’ probation. On a misdemeanor of drug paraphernalia, he was fined $50.
In State vs. Kenneth Lee Utley two counts of felony domestic assault were amended to the class A misdemeanor of domestic assault 4th degree. He pled guilty and was sentenced to 30 days on each count, to be served consecutively.
Angela Whitlock appeared on charges of no valid license, E felony, careless and imprudent driving, A misdemeanor, and DWI, B misdemeanor. She had a bond violation and a warrant was issued with bond set at $25,000 cash only. In a bond hearing March 16, an OR bond was granted with supervision by supervision services.
In a change of venue from Livingston County, State vs. Dale Marvin Barker, a jury trial was set for June 18-19. He is charged with statutory sodomy, statutory rape, and incest.
A jury trial for Mary Lou Browning was reset to July 22, 23, and 24. She is charged with two counts of D felony stealing $750 or more and two counts of D felony forgery. Browning is the former Coffey clerk who allegedly stole over $60,000 from the City of Coffey. The charges were filed after an audit by the State Auditor’s Office.
In State vs. Surezz Hunter, who is charged with illegal use of a card scanner, C felony, a jury trial was set for Aug. 6.
Norman Michael Rice pled guilty to harassment, A misdemeanor, and was sentenced to 180 days jail. Execution of sentence was suspended and he was placed on two years probation. For careless and imprudent driving, the imposition of sentence was suspended, and he was placed on two years’ probation, supervised by Supervision Services.
Shaun David Yoder pled guilty to failure to register as sex offender, E felony, and a sentence assessment report was ordered.
In State vs. Elmer Sorrell, the trial dates of April 22-24 were vacated. He is charged with assault first degree, armed criminal action, unlawful possession of firearm, two counts of stealing, and resisting arrest. Sorrell is accused of firing on a trooper after a car chase in March 2018.
On March 12, a dissolution of marriage was granted to Jared Hogan from Kassandra Hogan by Judge Daren L. Adkins.
On March 16 a personal injury vehicular case, Juan Castro-Garcia vs. Wanda B. Harris, was dismissed by the parties with prejudice.

Chad E. Budds, Cameron, was charged March 16 with assault third degree, E felony.

Breach of contract: Default judgments were entered for DNF Associates LLC and against Cassandra Parton; and for World Acceptance Corporation and against Brock E. Walsh et al. Consent judgments were entered for CACH, LLC and against Jason Tedrick; and for Cavalry SPB I, LLC, and against Terry E. Caldwell.
Suits on account: A default judgment was entered for Midwestern Health Management and against Daniel J. Dilley et al. Capital One Bank vs. Jason Long was dismissed by the court without prejudice. Two cases, LVNV Funding LLC vs. Zac Shipers and Midland Funding LLC vs. Robert Sweiger, were dismissed by the parties.
