County Commission
Jon Dwiggins, Howe and Company, met with the commission to discuss the bids received last week for the Jump Avenue bridge project. He stated that all the documents and calculations on each of the bids were correct, and Howe’s recommendation is that Daviess County accept the low bid from Decker Construction of Lathrop. Discussion was held on the merits of each bid. David Cox made a motion to accept the bid from Decker Construction for $409,319.50 for the Jump Avenue bridge; Wayne Uthe seconded. In discussion, Wayne Uthe asked if this bid included removal of the old bridge. Mr. Dwiggins stated yes it did. The motion passed, 3-0.
James Lewis, bridge supervisor, updated the commission on ongoing work. James hopes to complete the bridge inspections this week with MoDOT. The road crew continues to repair signs and railings on bridges, and cutting brush around the bridge approaches. James and the crew will continue to work in the shop on equipment at the barn, including doing annual inspections.
Jordan Habers, consultant for Union Pacific, spoke to the commission to ask permission to close 290th Street in Harrison Township, just north of the Caldwell County line at the railroad crossing in order to replace the railroad bridge. The commission denied their request to permanently close this portion of 290th Street; however, they gave their permission to temporarily close the road for approximately three days and then allow the road to be reduced to one lane for an additional period of time while the bridge is being replaced. Union Pacific will provide the road signs and traffic flaggers for the project.
Jane McKinsey, Master Gardeners, met with the commission to discuss landscaping plans around the courthouse.
Confirmations for hotel reservations for the CCAM training have finally been received. The commission will be attending Feb 12 -14. The commission met Feb. 11.
Beth Plotner, Daviess County Library, met with the commission to discuss the upcoming 2020 census process. She stated the library will be the information center for all census questions in Daviess County, as well as being a computer access point for people to fill out the census questionnaire online.
David Roll, Emergency Management Director, met with the commission to update them on current and future grant funding. Greg Lewis, FEMA, spoke to the commission by phone to answer some questions from the commissioners.
Don Tolen, Jackson Township, met with the commission to advise them MoDOT has discovered some damage to bridge 110002.8 on Real Avenue. The bridge has been temporarily closed at this time.
David Cox made a motion to approve the 2020 Emergency Management Director agreement; Wayne Uthe seconded, and the motion passed, 3-0.
Discussion was held regarding the annual safety visit from Midwest Public Risk. Ronetta Burton, County Clerk, will try to set up the visit for March 18. The commission plans to have a safety meeting for all elected officials at the same time.
Discussion was held regarding a bid received from RenoDry to install equipment that would dry out the courthouse from rising moisture. The commission will check references. The issue was continued.

Circuit Court
The following cases were heard by Judge Ryan Horsman on Feb. 5:
Ginny Marie Klitzing was sentenced to four years in the Department of Corrections for DWI persistent and seven years on each of two counts of endangering welfare of a child and one count of possession of controlled substance. On a charge of drug paraphernalia, she was sentenced to 60 days jail with credit for time served. All sentences will run concurrently.
Shane O’Dell pled guilty to two amended charges, two counts of endangering welfare of child, one D felony and one A misdemeanor. A sentence assessment report was ordered. Brandy A. Rhoades pled guilty to an amended charge of endangering welfare of a child, A misdemeanor. She received a suspended imposition of sentence and two years probation supervised by the state board of probation and parole. O’Dell and Rhoades were charged in May 2019 in a case where a 6-year-old juvenile had been locked in a basement. They had each originally been charged with child abuse, no sexual contact, B felonies.
Amy Lynn James pled guilty to trespassing first degree, B misdemeanor, amended from burglary second degree, D felony, and was sentenced to 60 days jail with credit for time served. She was sentenced to 15 days jail for littering, C misdemeanor, amended from stealing firearm, D felony. She received credit for time served.
Dawson Levi Davis pled guilty to possession of explosive or incendiary device, D felony, and minor in possession second offense, A misdemeanor. A sentence assessment report was ordered.
Chad Prentice pled guilty to unlawful possession of illegal weapon, D felony, and a sentence assessment report was ordered.
In a change of venue from DeKalb County, a jury trial was set for Oct. 21-22, 2020, for Michael Clyde-David Moses on charges of assault, armed criminal action, resisting arrest, two counts of leaving the scene of accident, and attempted stealing.
Justin J. Rainey pled guilty to possession of controlled substance, D felony, and was sentenced to five years in the Department of Corrections. On misdemeanor charges of careless and imprudent driving, leaving the scene of accident, and DWI, he was sentenced to 30 days jail with credit for time served. All sentences will run concurrently and consecutively to any other sentences.
Shelby Marie McAfee was sentenced to five years in the Department of Corrections, execution of sentence suspended, for possession of controlled substance and endangering welfare of a child. She was placed on five years’ probation. She was sentenced to 60 days jail with credit for time served on counts of drug paraphernalia and possession of marijuana, sentences to run consecutively. Two counts were dismissed.
April D. Brown was sentenced to five years in the Department of Corrections, execution of sentence suspended, for possession of controlled substance. She was placed on five years’ probation. She was fined $150 for drug paraphernalia and $10 on a seat belt infraction. One count was dismissed.
Elijah J. Carlson received suspended imposition of sentence for tampering with a motor vehicle, D felony, and ordered to serve five years probation. He was ordered to pay restitution of $1,550.50.
Melanie Lynn Myers received a suspended imposition of sentence and five years probation for possession of controlled substance, D felony. She was sentenced to seven days jail with credit for time served for misdemeanor drug paraphernalia.
Christian Lee Hogan pled guilty to domestic assault third degree, harassment, and stalking, and a sentence assessment report was ordered.
Kolbey Sandgren pled guilty to damaging jail property, E felony, and was sentenced to four years in the Department of Corrections. The court retains jurisdiction for 120 days and ordered completion of an institutional treatment program.
Jacob W. Palmer pled guilty to tampering with motor vehicle, resisting arrest, possession of controlled substance, speeding, possession of marijuana, and driving while revoked. A sentence assessment report was ordered.
Jordan Riggins was sentenced to two years in the Department of Corrections for resisting arrest and 30 days jail with credit for time served on an amended charge of property damage.
A jury trial for Norman Michael Rice was vacated and the case continued to March. He is charged with assault, harassment and four traffic offenses.
A jury trial for Kenneth Lee Utley was vacated and the case continued to March. He is charged with two counts of domestic assault.
A warrant was issued for Trevor Seibert for failure to appear. He is on probation for possession of controlled substance at correctional facility.
Bond was revoked and a warrant was issued for Dennis McBroom on a probation violation for DWI chronic and three traffic offenses.
Before Judge Horsman on Feb. 7, Devin L.A. Hall pled guilty to DWI persistent, E felony, and was sentenced to three years in the Department of Corrections. He was sentenced to 25 days jail with credit for time served for failure to comply with ignition interlock and failure to drive in single lane. He was fined $50 for no valid license.
In Aaron and Stephanie Mason vs. Logan Groomer, judgment was amended on a quiet title.
A dissolution of marriage was granted to Jessica Gates from Norman Gates, with her former name Jessica Vanderslice restored.
Cases bound over from the Associate Division: State vs. Apollo Leon Brown, Cameron, no valid license, third and subsequent offense, E felony; State vs. Alfred Brian Sprouse, Gallatin, four counts of child molestation fourth degree, one count sexual contact with student, and one count assault third degree, all E felonies; State vs. Gunnar D. Goll, Bethany, two counts tampering with motor vehicle first degree, D felony, stealing motor vehicle, D felony, property damage first degree, D felony, and trespassing second degree, infraction; State vs. Nicholas Dale McCleary, Rayville, endanger correctional employee by causing contact with bodily fluids, E felony.
Civil cases filed: Kerry McBroom, Gallatin, vs. Director of Revenue, petition for reinstatement of driving privilege.
