The following cases were heard by Judge Ryan Horsman on Nov. 13:

Jamey A. Griffin withdrew his petition for a change of judge and received a change of venue to Livingston County. Griffin was being transported through Daviess County on June 14, 2019, by a Trenton police officer when he gained control of her firearm and shot her in the abdomen. The incident occurred near the Winston Pit Stop. The officer was seriously injured. He is charged with assault first degree – serious physical injury or special victim, A felony; unlawful use of weapon – shoot at person – death or injury, A felony; and armed criminal action, unclassified felony.

Vincent Sturgeon, Gallatin, was convicted in a jury trial held Sept. 4 of endangering welfare of a child, D felony, and domestic assault, a misdemeanor. On the felony charge he was sentenced to seven years in the Department of Corrections. He was sentenced to one year in jail on the misdemeanor, sentences to run consecutively.

Caleb J. Kettner was sentenced to five years in the Department of Corrections for assault second degree, D felony. The court retains jurisdiction for 120 days of shock incarceration. He was also sentenced to 90 days in jail with credit for time served for kidnapping, A misdemeanor.

Probation was revoked for Michael Edward Harrison on a C felony count of possession of controlled substance. His previously imposed 7-year sentence was ordered executed.

Michael T. Koch pled guilty to assault third degree, E felony, and was sentenced to two years in the Department of Corrections.

A jury trial for Jay Curtis Guhlke was set for June 24-26, 2020, on three child pornography charges.

A jury trial for James Leland Benson was sent for Feb. 7, 2020, for domestic assault third degree.

A jury trial was set for Amy Lynn James on April 2, 2020, on charges of burglary and stealing.

A jury trial for Dustin Andrew Mullen Florez was set for April 9-10, 2020, on charges of domestic assault, kidnapping and armed criminal action.

The jury trial for Christopher G. Houston was postponed to Jan. 10, 2020. He is charged with domestic assault, kidnapping and tampering with witness in felony prosecution.

Jerry Dean Reeder pled guilty to an amended charge of failure to register as sex offender, E felony. A sentence assessment report was ordered.

Dustin Kimberling was sentenced to 90 days jail on each of two drug paraphernalia charges, sentences to run concurrently. One charge was dismissed. Kimberling received credit for time served.

Melanie Lynn Myers failed to appear and a warrant was issued for her arrest, with bond set at $50,000 cash only. She is charged with possession of controlled substance and drug paraphernalia.

Carol A. Iacono received a suspended imposition of sentence and five years probation for possession of controlled substance, C felony. For possession of marijuana, A misdemeanor, she was sentenced to 60 days jail with credit for time served. One charge for bad checks was dismissed.

William J. Walker failed to appear and a warrant was issued for his arrest, with bond set at $50,000 cash only. He is charged with endangering jail employee by exposure to bodily fluids, E felony.

On Nov. 15, Judge Brent Elliott granted Reid Otto Scott a change of venue to Clinton County. He is charged with burglary second degree and stealing firearms.

Judge Elliott also issued a civil judgment for Midwestern Health Management and against Katherine C. Parker.

Civil cases filed: Kelley Trotter, Santa Ana, CA, vs. State of Missouri, et al, petition for expungement; Division of Employment Security vs. John McKinney, Coffey, certificate of assessment of overpaid benefits; Division of Employment Security vs. Matthew A. Associate Division

Kolbey Sandgren, Maysville, was charged Nov. 18 with damage to jail property, E felony.

Civil Court

Breach of contract: Cavalry vs. Sylvia Swearingin was dismissed by the court without prejudice.

Suit on account: A consent judgment was entered for Midwestern Health Management and against Randy L. Hisel, et al.

Rent and possession: Green Hills Community Action Agency vs. Linda Berten was tried by the court. The court entered judgment against Berten for past due rent, with defendant to surrender possession of the apartment by Dec. 1, 2019.

Small claims: Larry Shipers vs. Vera S. Dowell-Nelson was tried by the court, with judgment for the plaintiff.

County Commission

James Lewis, bridge supervisor, met with the commission to update them on ongoing work.  The road crew will be working in Lincoln and Jackson Townships this week. They are also mowing brush in Grand River and Jamesport townships.

David Roll, EMA Director, met with the commission and James Lewis to discuss final paperwork for damages from the spring disaster declaration. David asked the commission to think about some possible upgrades in the commission room to accommodate a work space for him. Funds would come from his EMPG grant for next year.  The commission will consider the request.

David also advised the commission he had been notified by the state DNR that two drums of potash was dumped in the southern part of Harrison Township.  David will follow up.

Ronetta Burton, County Clerk, discussed reimbursement issues with David Roll.

Commissioner Wayne Uthe reported that he had met with Steve McBee and Union Township to discuss a possible solution to the erosion on the Grand River near the Magill Bridge, and the damage to Saber Road.  The commission will follow up.

Rod Cotton, Farmers’ Electric Cooperative, met with the commission to update them on things going on with FEC. They have a scholarship opportunity for residents, an electric vehicle they use as an educational tool, a small solar farm in Chillicothe that residents can visit, and capital credit payments. They also have a new program “Farmers You” that tries to educate the public on jobs and programs available from FEC.

Dan Hegeman, Missouri Senator, met with the commission to update them on current legislative issues.

David Michael, Grand River Township resident, left word for the commission to thank them for clearing the brush from around the bridge at 280th Street and Lilac Avenue.

David Gwinn, Salem Township landowner, left word for the commission to ask for a 30-day extension to complete brush cutting.  Permission was granted.

Sheriff Ben Becerra met with the commission to discuss courthouse security issues.

Assessor Sally Black met with the commission.

The commission conducted a closed session from 11:40 a.m. to 12:05 p.m. No decisions were made.

The commission spoke by phone with Ivan Schraeder, county attorney.

The commission conducted another closed session from 12:15 to 12:40 p.m. No decisions were made.

The commission and the county clerk reviewed revenue and expenses for January through October 2019 in anticipation of working on the 2020 county budget.

Brian Teel, Marion Township, met with the commission to advise them the township roads are ready to be inspected. The commission will issue the Notice to Proceed for the spreading of CART rock as soon as the inspections are complete.

The commission and the county clerk continued working on updating the Daviess County Personnel Manual.
