Ivan Schraeder, county attorney, represented the county during a hearing conducted in a court case filed by Craig Wooldridge against the Daviess County Commission, regarding a petition to close a portion of 175th Street in Sheridan Township that the county had denied. The hearing began at 8:45 a.m. and concluded at 8:55 a.m. Judge Ryan Horsman took the issue under advisement, and a ruling is expected in about a week.

The commission conducted a closed session with their attorney from 9-9:38 a.m., with no decisions made.

Jane McKinsey, recorder, met with the commission to advise them that the county has received her reimbursement for 2019. As expected the reimbursement is $20,000 short from what was budgeted.  There will be no reimbursement in 2020, leaving the county short $55,000 in revenue.

Discussion was held regarding the back flow test due for the boiler. Commissioner Wayne Uthe will find a number for a certified tester.

Bradley Jones, Daviess County Nursing & Rehab Maintenance, met with the commission to advise them the concrete steps have been repaired. He advised the boiler is leaking and will need to be replaced. They are also having problems with the hot water heater for the kitchen and laundry.  Repairs have been ordered. The staff has been using the van the last couple weeks, and it is working properly now. The water faucet issue in the shower room has been fixed. Also, remediation has been done for the mold issue in one room. Maintenance has just been completed on the stove hoods and fire suppression system. The center is expecting a state inspection soon. Bradley reported the care center has 46 residents at this time, which is up several from the occupancy this summer.

Eric Corwin, clock specialist, reported the lights are still not working on the outside of the courthouse clock tower. Discussion was held, and Wayne Uthe will try to get those repairs made in the next week or two.

James Lewis, bridge supervisor, updated the commission on ongoing work. The road crew will be working in Harrison Township this week. They are also mowing brush in Grand River and Jamesport townships.

Due to holiday schedules, the commission will meet on Monday, Dec. 23 the week of Christmas, and they will meet on Thursday, Jan. 2 the week of New Year’s Day. All other commission meetings will be 8 a.m. to noon on Wednesday mornings. Afternoon appointments can be made from 1 to 4 p.m. in advance; otherwise the commission will review roads, bridges, culverts, brush and noxious weeds on Wednesday afternoons.

The commissioners will attend the Northwest Commissioners Meeting in Maryville on Dec. 19.

Work sessions on the 2020 budget will be held Dec. 11 and 12 in the commission court room by appointment.

Commissioner David Cox left at noon to attend to some personal business.

Jim Ruse and Wayne Uthe, along with Ronetta Burton, worked on updating the Daviess County personnel manual in the afternoon.

Circuit Court

A jury trial which had been scheduled for James D. Whitt, Bethany, was postponed from Nov. 7 to Dec. 18. He is charged with two counts of domestic assault second degree and kidnapping third degree.

A dissolution of marriage was granted to Steven A. Riley from Monica R. Riley on Nov. 6.

Associate Division

Jack W. Parker, Winston, was charged Nov. 7 with no valid license third and subsequent offense, E felony, and failure to drive on right half of roadway, C misdemeanor.

Ashley A. Stover, Excelsior Springs, was charged Nov. 7 with possession of controlled substance, D felony, and drug paraphernalia, D misdemeanor. She was arrested June 6, 2019, in Jamesport, after a Daviess County deputy responded to a call for assistance. Stover was found to be in possession of drugs and paraphernalia.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $70.50 for moving traffic violations and $120.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:

Aundrea R. Whiteley, Gallatin, careless and imprudent driving, 2 days jail; no valid license, $150.

Robert L. McDaniels, Bakersfield, CA, failed to drive on right half of roadway resulting in an accident, 5 days jail.

Steven A. McBee, Gallatin, consumption of alcoholic beverage while driving, $150.

Jo Elda Pena, Palmview, TX, possession of marijuana, $300; speeding, $70.50; possession of marijuana – THC Oil, $300; possession of drug paraphernalia, $150.

Assessor’s Office

County residents should have received their tax statements by now. Your taxes are not determined by the assessor, but rather by the levies set by county entities. The assessor is responsible for valuation only.
