County Commission
James Lewis, bridge supervisor, updated the commission on ongoing work. The road crew will be working in Washington Township this week. The commission discussed a Howe & Co. proposal with James regarding the repair of the bridge on Jump Road.
Discussion was held regarding brush mowing issues for the county. The commission will discuss options with mower operator Bill Haggard. The issue was continued until next week.
Unfortunately there was no interest by most of the county officials in having a county float in the Chautauqua parade, so the request has been dismissed.
Three Daviess County residents were granted 30-day extensions for brush cutting: Keith Harpster of Colfax Township for property owned by Kenneth and Nancy Sandy; Johnathan McGinness of Jefferson Township; and Helen Webber of Sheridan Township. Each was granted a 30-day extension, as well as a final 30-day extension. Final extension deadlines are as follows: Harpster, Nov. 13; McGinness, Nov. 3; and Webber, Oct. 29.
The commission discussed brush letters and the progress that has been made. More brush letters and second notices will be sent out. The commission will make an effort to complete more of the county brush removal around culverts and bridges as soon as possible. They will also be working on checking the brush that has been cut and approve as many as possible.
Janie McKinsey, Master Gardeners Club, met with the commission to discuss improvements to the flower beds around the courthouse. The commission will furnish cedar mulch and river rock to complete some of the projects.
No new information was received on the Caldwell County mitigation project. Joe Reed left word for the commission that he has concerns regarding one of the project locations. The issue was continued until next week.
Due to a change in RSMo 190.460 effective Aug. 28, 2019, the county has an opportunity to opt-in to an agreement with DOR to collect part of a 3% surcharge on prepaid phones and prepaid phone cards sold in Daviess County. Discussion with Daviess County Central Dispatch will be held. The issue was continued until Sept. 25.
The Northwest Commission meeting scheduled for Sept. 19 in Mercer County has been cancelled with no re-schedule planned. The next meeting will be in Nodaway County on Dec. 19.
The commission received an invitation to attend a Rural Community Development workshop in Maryville, coming up in February 2020. The commission plans to attend. The issue was continued until January 2020.
Ronetta Burton, county clerk, advised the commission second notices for some cyber security training will be sent to county employees that did not complete the course.
Discussion was held regarding the lease for Daviess County Nursing & Rehab. No decisions were made. The issue was continued until Sept. 25.
The commission received information from the U.S. Corps of Engineers regarding possible repair solutions for the Magill Bridge. The commission will send a formal letter of request to start the process.
John Dwiggins, Howe & Co., met with the commission to discuss an agreement on engineering fees and bid formulation for the repair of the bridge on Jump Road. A lengthy discussion of possible solutions was held. Wayne Uthe made a motion to approve the Howe & Co. proposal to move forward on the repair of the Jump Road bridge; David Cox seconded, and the motion passed. David Cox made a motion to terminate the existing Work Order #1 on this bridge; Wayne Uthe seconded, and the motion passed.
The commission received a “Thank You for the Whole Community” from Blackie Wortman for the community’s support of the Kickin’ Cancer With Kindness program that distributes gas cards for persons traveling back and forth for cancer treatments.
In the afternoon the commission checked roads, culverts, bridges, brush and noxious weeds in Jefferson, Colfax, Grand River, Jamesport, and Union Townships.

Circuit Court
The following cases were heard by Judge Ryan Horsman on Sept. 11:
Scotty Eugene Kennedy had previously pled guilty in June to possession of controlled substance, D felony. He was sentenced to five years in the Department of Corrections, execution of sentence suspended. He was ordered to serve five years probation. One misdemeanor count of drug paraphernalia was dismissed.
Reuben E. Gingerich had previously pled guilty in July to possession of controlled substance, D felony. He received a suspended imposition of sentence and five years probation. He was fined $150 for misdemeanor drug paraphernalia.
Two misdemeanor charges against Salvador Hernandez of Gallatin were dismissed. The dismissed charges were patronizing prostitution and assault fourth degree. Hernandez was acquitted of four felonies in a jury trial which concluded Aug. 2 in Daviess County.
A jury trial was set for March 19, 2020, for Kenneth Lee Utley on two felony counts of domestic assault.
Jay Alan Parker pled guilty to the D felonies of possession of controlled substance and endangering welfare of a child and was sentenced to four years in the Department of Corrections on each count. He was sentenced to 100 days jail for misdemeanors of drug paraphernalia, attempted tampering with evidence, and no valid license. All sentences will run concurrently. Five charges were dismissed.
Carol Iacono pled guilty to possession of controlled substance, C felony, and possession of marijuana, A misdemeanor. A sentence assessment report was ordered.
Benjamin S. Devine pled guilty in July to possession of controlled substance, D felony. He received a suspended imposition of sentence and five years probation. He was fined $150 for misdemeanor possession of drug paraphernalia.
Caleb J. Kettner pled guilty to assault first degree, D felony, amended from a B felony; and to kidnapping, A misdemeanor, amended from a D felony. A sentence assessment report was ordered.
In Gary D. Buck et al vs. James W. Wright II et al, a quiet title was granted to Buck.
A jury trial for Dennis L. McBroom was reset to Feb. 27, 2020. He is charged with DWI chronic, C felony, and three traffic misdemeanors.
A jury trial for Elmer Martin Sorrell was reset to April 22-24, 2020. He is charged with felonies of assault first degree, armed criminal action, unlawful possession of firearm, stealing firearm, stealing, and resisting arrest.
In Kristin Allen vs. Brandon Miller et al, a partition was entered for the plaintiff Kristin Allen.
The following name changes were granted: Carter S. Boyd to Carter S. Talbert; Joanne Kay Goetz to Jo Mason Goetz.

Small Claims over $100: Daniel A. August vs. Grand River Tire and Automotive was tried by the court. The court found in favor of the plaintiff Daniel August and against the defendant for $165 plus costs.
Assessor’s Office
Representatives from the assessor’s office are currently in the field doing review and picking up new construction for 2020. They will be in the Lake Viking area and throughout the county. While in the field, it is sometimes necessary to update pictures of the property and check on measurements. In order to be fair to all, all structures must be included on the tax roll. If a structure is new or has not previously been reported to the assessor, it must be added to the tax roll. This includes buildings on skids if they are 100 square feet or more.
