David Michael, spoke to the commission by phone to discuss a brush issue at the intersection of Lilac Ave and 280th Street. David Cox will check on this.
Roger Lindahl, Sheridan Township resident, met with the commission to ask for a 30-day extension to get his brush eradicated. Wayne Uthe made a motion to grant the 30-day extension; David Cox seconded, and the motion passed.
Royce Brock, Washington Township resident, spoke to the commission by phone about his brush letter. He will be cutting soon.
A petition to close a portion of 232nd Street in Washington Township, Section 20, was read for the first time. It will need to be read in the October and January sessions before a decision can be made.
A petition to close a lane at approximately 236th Street in Washington Township, Section 8, was dismissed because the road was never officially open.
James Lewis, bridge supervisor, updated the commission on ongoing work. His crew will continue to work on repairing damage from the recent rains in various townships, including Union, as well as documenting damage in other areas. They will be working in Harrison Township this week, weather permitting.
The commission discussed a request from the assessor for a subpoena for records from AT&T that had been discussed at the Board of Equalization. The request was denied – BOE has already adjourned.
Discussion was held regarding an easement in Union Township to repair a portion of Sabre Avenue. Wayne Uthe will check with the landowners. The issue was continued until next week.
Pam McNeel, collector/treasurer, met with the commission to discuss cash flow needs for the upcoming months and to ask what suggestions the Commissioners have for bidding interest on a CD that is maturing. They advised her to go ahead and ask for bids from Daviess County banks.
Craig Wooldridge, Sheridan Township landowner, met with the commission to discuss his options to appeal their decision to not close a part of 175th Street in Sheridan Township. Mr. Wooldridge presented a narrative of his position and received copies of statutes that applied to the appeal process.
An Empower Retirement representative met with Daviess County employees to discuss their retirement contributions and any changes they needed for this year.
David Roll, EMA director, met with the commission to discuss ongoing disaster declarations and grant proposals.
Ronetta Burton, county clerk, presented the commission with profit and loss vs. budget numbers for January through June 2019. Actual revenues and expenses are in line with budget projections so far this year.
Jon Dwiggins, Howe & Company, met with the commission to discuss upcoming BRO bridge replacement projects for the next three years.
At noon the commission attended the Local Emergency Planning Commission (LEPC) meeting at Subway.
The commission is receiving requests to present healthcare options to county employees. Discussion was held with a decision to start accepting proposals on Sept. 18.
In the afternoon the commissioners inspected roads, bridges, culverts, brush and noxious weeds in Jefferson, Sheridan, and Union townships.
The meeting adjourned at 4:30 pm.

Circuit Court
The following cases were heard by Judge Ryan Horsman on July 17:
Probation was revoked for Javier Valenzuela on two felony charges, unlawful possession of firearm and unlawful possession of illegal weapon. His suspended execution of sentence was revoked, and he was ordered to serve seven years on each count, consecutively. He was arrested by the Missouri State Highway Patrol on Dec. 20, 2016.
Probation was revoked for Donald G. Shields on a charge of failure to register as sex offender. The court revoked his suspended execution of sentence, and his four-year sentence in the Department of Correction was ordered executed.
A jury trial for Elmer Martin Sorrell was vacated and the case was continued to Sept. 11 for a bond hearing and trial setting. Sorrell exchanged gunfire with a state trooper after a car chase in Daviess County in March 2018. He is charged with assault first degree, armed criminal action, unlawful possession of a firearm, stealing firearm, stealing, and resisting arrest.
Steven R. Periman pled guilty to attempted forgery and no valid license third and subsequent offense. He was sentenced to two years in the Department of Corrections on each count, sentences to be served concurrently, and consecutively to any other sentences being served. He was fined $100 for failure to maintain financial responsibility. Three charges were dismissed in exchange for his guilty pleas to the above charges.
Probation was revoked for Donna J. Sweat on an A misdemeanor charge of endangering welfare of a child, and her one-year sentence was ordered executed.
Probation was revoked for DaWayne Billups on two misdemeanors, possession of defaced firearm and possession of marijuana. His suspended imposition of sentence was revoked, and he was sentenced to 30 days on each count, to be served consecutively.
A jury trial was set for March 23-25, 2020, for Mary Lou Browning on two felony charges of stealing and two of forgery.
Reuben E. Gingerich plead guilty to possession of controlled substance, D felony, and drug paraphernalia, D misdemeanor. A sentence assessment report was ordered.
Angela M. Labee appeared for trial setting on two felony counts of stealing, forgery and attempted stealing. A warrant was issued for bond violation, with bond set at $50,000 cash only.
Michael E. Trickler Jr. failed to appear for a trial setting on felony charges of burglary and possession of burglary tools. A warrant was issued with bond set at $50,000 cash only.
A jury trial was set for March 23, 2020, for Christopher G. Houston for felony domestic assault, felony tampering with a victim in felony prosecution, and two misdemeanor counts of kidnapping third degree.
Kevin Eugene Harvey pled guilty to felony domestic assault and was sentenced to three years in the Department of Corrections. For misdemeanor domestic assault, he was sentenced to time served.
State vs. Adam Tyler Justus was transferred to Caldwell County on a change of venue. He is charged with escape or attempted escape from confinement and resisting arrest for a felony, both felonies.
Brent Neilsen Adams had previously pled guilty to DWI, E felony. He was sentenced to four years in the Department of Corrections, execution of sentence suspended, and placed on five years probation. He was also ordered to serve 30 days shock jail time with credit for time served. He was fined also $300 for no valid license and sentenced to two days jail with credit for time served for careless and imprudent driving.
A jury trial was set for Sept. 4, 2019, for Kenneth Lee Utley on two felony charges, domestic assault second degree and domestic assault third degree.
Benjamin S. Devine pled guilty to possession of controlled substance, D felony, and drug paraphernalia, D misdemeanor. A sentence assessment report was ordered.
A jury trial was set for Sept. 23, 2019 for Vincent Sturgeon on three counts of kidnapping, one count of domestic assault second degree, and one count of endangering the welfare of a child.
William J. Walker pled guilty to felony endangering a jail officer and was sentenced to three years in the Department of Corrections, execution of sentence suspended. He was placed on 5 years probation.

A court trial scheduled before Judge Ryan Horsman on July 22 was vacated when the parties reached a settlement. The case, Osby Corporation d/b/a Daviess County Nursing & Rehab vs. Glenda Patton and Steven Patton was a petition for breach of contract.

Associate Division
Cody L. Bannan, Mooresville, was charged July 19 with non-support, E felony.
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $70.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren L. Allyson M. Routh, Gallatin, driving while revoked, $300; failed to register vehicle, 14 days jail; driving while revoked, $300; no seat belt, $10.
Selvin B. Paxtor Hernandez, Clarion, IA, speeding (106 mph in 70), two days jail, $250; driving while intoxicated, $350; no valid license, $300.
Dylan W. Ballard, St. Joseph, assault – probation violation, probation revoked, 60 days jail.
Tylor S. Periman, Altamont, possession of drug paraphernalia, $300; possession of marijuana, two days jail.

Sandy Blu Spruell, 59, and Gina Bagano Geston, 52, both of Grandview, were married by Judge Daren Adkins on July 16.
Assessor’s Office
Representatives from the assessor’s office will soon be in the field reviewing new construction for 2020. The review will begin Aug. 5 in the Lake Viking area and will continue throughout the county through December. New construction includes any building projects which started after Jan. 1, 2019.
