County Commission
James Lewis, bridge supervisor, updated the commission on ongoing work. His crew has been working on cleaning around the outside of the shop last week. They have also been working on culverts in Jamesport and Washington Townships. Upcoming bridge work was discussed. The commission advised James there was free chain saw safety training available for his crew. James will let the commission know if they are going to attend.
Ray Dockery and Gary Eads, Home Exchange Bank, met with the commission to discuss a lease purchase agreement for sheriff department vehicles. They will return next week to finalize the first lease. The issue was continued until next week.
David Cox made a motion to approve the lease terms as discussed with Home Exchange Bank. Wayne Uthe seconded; motion passed.
Randy Eads, Washington Township, met with the commission to discuss road issues on 232nd Street. The commission will consult counsel. The issue was continued until next week.
Frank Blakemore, Garver Engineering, met with the commission to discuss engineering services for the county, and what bridge projects might be coming up.
Ryan Clark, Legendary Lawn, met with the commission to discuss a proposal to do landscaping around the courthouse. The commissioners will discuss all proposals. The issue was continued until next week.
Representatives from Missouri Opioid Crisis Alliance, Cathy Nugent, Kevin Royer, John Edgar, and Jeffrey Reeves, met with the commission regarding Missouri opioid lawsuits. Jeffrey Reeves explained the difference in filing lawsuits in Federal Court vs State Court (local judge, local jury). The Missouri Opioid Crisis Alliance is advocating for state court. Daviess County would be the plaintiff (not class action). The lawsuit would be against manufacturers and distributors. Discussion was held regarding how the opioid epidemic affects the community and has harmed the county. The alliance stated no county funds are involved in the lawsuit.
Jan Duly, Jameson Community Betterment, met with the commission to inform them of an upcoming fish fry and fire truck auction on June 1 at Jameson Park.
Steve Bohannon, Grand River Township, met with the commission regarding the process to add CART rock mileage, and discussed brush issues.
David Cox made a motion to approve the four commissioners (Bill Walker, Nodaway; Lee Sawyer, Buchanan; Ed Douglas, Livingston; Phil Ray, Grundy) to the CLEO Coordinating Committee representing the 18-county region. Wayne Uthe seconded; motion passed. Workforce development issues were also discussed.
The commission approved their inventory for 2019.
Discussion was held regarding brush issues and notices for 2019. It was decided to put an ad in the paper to start the process before brush letters would be mailed. The issue was continued until next week.
Jerry Eads, Marion Township resident, left word for someone from the commission to call him. Jim Ruse will make the call.
Discussion was held regarding ongoing clock tower and outside lighting repair.

The following case were heard during Law Day proceedings heard by Judge Ryan Horsman on May 15:
Charges against Genaro Alberto Nunez-Ugarte, St. Paul, MN, were bound over from the Associate Division. Nunez-Ugarte pled guilty to possession of controlled substance, D felony, and was sentenced to two years in the Department of Corrections. For misdemeanors of possession of marijuana and paraphernalia, he was sentenced to time served. He was fined $300 for misdemeanor no valid license, and one charge was dismissed.
Brenda King pled guilty to possession of controlled substance D felony, and was sentenced to four years in the Department of Corrections. She was sentenced to time served for misdemeanors of DWI and drug paraphernalia, sentences concurrent. She was fined $300 for misdemeanor no valid license.
Jeffery Pal Poage had previously pled guilty in March. He was sentenced to five years in the Department of Corrections for possession of controlled substance, D felony, execution of sentence suspended. He was placed on five years probation. He was fined $80.50 for speeding.
Paul A. Jones pled guilty to DWI physical injury, E felony, and misdemeanors of failure to yield to emergency vehicle and careless and imprudent driving involving an accident. He was sentenced to three years in the Department of Corrections on the felony and to 90 days on each of the misdemeanors, sentences to run concurrently.
A jury trial for Norman Michael Rice was set for Nov. 26, 2019. He is charged with felony assault second degree, misdemeanors of harassment second degree, careless and imprudent driving involving an accident, following too closely, and infractions of speeding and failure to have two lighted headlamps.
Javier Valenzuela was taken into custody for a probation violation and bond was set at $20,000 cash only. He is charged with unlawful possession of a firearm and unlawful possession of illegal weapon. He posted bond on May 20 and is scheduled for a probation violation hearing on June 12.
Wesley Alexander Kemp pled guilty to no valid license, E felony, and misdemeanor speeding. Sentencing was continued to July.
Donald Allen Holland pled guilty to driving while revoked, amended from an E felony to an A misdemeanor, and was sentenced to 60 days in jail.
Hannah Elizabeth Mehrhoff pled guilty to possession of controlled substance, D felony. She received a suspended imposition of sentence and five years probation.
Brent Neilsen Adams pled guilty to DWI persistent, E felony, and misdemeanors of no valid license and careless and imprudent driving involving an accident. A sentence assessment report was ordered.
Edgar D. Jaime pled guilty to DWI physical injury and leaving the scene of an accident, E felonies, and misdemeanors of careless and imprudent driving, littering and no valid license. A sentence assessment report was ordered.
A dissolution of marriage was granted to Tina Hendricks from Ricky Hendricks, with her former name of Tina Marie Beck restored.
Midwestern Health Management vs. Jeffrey M. Noah et al was dismissed.
A default judgment was entered for Midwestern Health Management and against Leo G. Hogan et al.
A bench trial was set for July 22, 2019, in Osby Corporation d/b/a Daviess County Nursing & Rehab vs. Glenda Patton and Steven Patton, in a breach of contract case.
Judge Brent Elliott set a bench trial for Aug. 16, 2019, for PST Enterprises vs. Randall Turner, et al, in a change of venue from Clinton County.
