The four-day Habeas Corpus hearing for Ricky L. Kidd, which was heard in Daviess County Circuit Court last week, has been continued. Kidd is presently serving life without the possibility of parole, and has been trying to prove his innocence for 19 years. He was convicted in 1997 of two counts of first degree murder in a Kansas City double homicide. The record, at the request of the petitioner and without objection, was left open for 30 days to present any additional evidence. The case was heard by Judge Daren Adkins.
A jury trial which had been scheduled for Kenneth W. Waln of Winston on April 30 was canceled when Waln pled guilty to amended charges late in the day on April 29. Waln pled guilty to trespassing, B misdemeanor, amended from burglary first degree, B felony, and to assault third degree, E felony, amended from assault second degree, D felony. A sentence assessment report was ordered, and sentencing was set for July 17. The case was heard by Judge Ryan Horsman.
The following cases were heard by Judge Horsman on April 29:
In Fabian W. Lincoln vs. State of Missouri, Lincoln’s motion to vacate, set aside or correct sentence was granted. Lincoln was serving a seven-year sentence for the B felony of DWI, habitual offender. That charge was set aside and amended to the C felony of DWI, chronic offender. He pled guilty to the amended charge and was sentenced to seven years with credit for time served.
Sarah Elaine Dowell, 29, Milan, pled guilty to an E felony charge of attempted possession of controlled substance at jail and two counts of delivery of prohibited article to jail, both A misdemeanors. She was sentenced to two years in the Department of Corrections on the felony, and to one year in the regional jail on each of the misdemeanors, sentences to run concurrently. Her scheduled jury trial was vacated.
Civil cases filed: Raylan Adkison by next friend Courtney Adkison vs. Andrew Adkison, personal injury, vehicular.
Associate Division
Ephraim J. Gibson, Kansas City, KS, was charged April 24 with non-support, E felony.
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:
Dashiell M. Saenz, Des Moines, IA, no valid license, not reinstated, $300.
Andrea L. Miller, Bethany, following too closely, $30.50; no insurance, $103.50.
Kevin Britton Jr., Belton, driving while intoxicated, suspended imposition of sentence, two years probation, 30 hours community service; speeding amended to defective equipment, $200.
Donald R. Hartman, Kansas City, assault, 15 days jail.
Cathy Hartman, Pattonsburg, driving while intoxicated, 10 days jail; resisting arrest, 10 days jail; failure to use turn signal, $20.50; no insurance, $103.50.
Marco A. Gomez De Leon, Independence, no valid license, reinstated, $150.
Michael A. Nattier, Patoka, IL, two counts of passing bad checks, $25 on each count.
Jason Crawford, Fond Du Lac, WI, no valid license, not reinstated, $300.
Civil Court
Other contract: A change of venue to Grundy County was granted in Barclays Bank Delaware vs. Wilmer Gingerich.
Marriage
Chris M. Dannar, 46, and Shelli Dawn Christopher, 45, both of Gallatin, were married April 26 by Judge Daren Adkins.
County Commision
The commission received a copy of the BEAP study for BR 466001.3 in Union Township.
The commission spoke with Ivan Schraeder, county attorney, on the phone regarding road issues.
The commission discussed possible appointments for Marion Township. The second notice was in the paper on April 23. David Cox will continue to work on possible candidates. The issue was continued until next week. Trent Dowell, J.D. Dowell, and Mary Lee Froman-Ellis, Sheridan Township landowners, met with the commission to discuss 215th Street in Sheridan Township (County Road 194). The commission will make some additional inquiries. The issue was continued until next week.
Ray Wadley, SEMA, left word for the commission that he will be back next Thursday to do the final inspection on records for the 2015 FEMA/SEMA awards.
The commission will meet May 8 with Jennifer Ellis at the nursing home to renew their lease, and to make an inspection.
The Extension office has a bad A/C unit this season. Wayne Uthe will check to see if a replacement is available from a local business. The issue was continued until next week.
Wayne Uthe also advised that the new water fountain for the third floor has been installed.
Ronetta Burton, county clerk, advised the commission that the courthouse elevator has had some minor repair and has passed the annual inspection.
Eric Corwin, clock maintenance, left word for the commission that he has determined the issue with the clock tower lights. He will need a new light fixture and sensor to get it working. He also advised that these fixtures are discontinued, and he would like to order the only other one available for a spare. Permission was granted.
Discussion was held regarding the custodian’s daily work sheets. It was determined to continue with them at this time. Improvements have been seen.
The commissioners looked at roads, bridges and culverts in Union, Sheridan, and Benton Townships in the afternoon.
