County Commission
Ronetta Burton, county clerk, updated the commission on the phone project. Windstream is now done with their part of the project, and work is moving quickly. Expectations are that the courthouse will be able to make the switch next week. A new phone number will soon be available to the public.
James Lewis, bridge supervisor, stated his crew will continue work to repair bridges and bridge decks in Jefferson Township. They will also be doing preparation work at the shop for winter.
Bills were approved. Minutes from the last meeting were approved.
Recorder Jane McKinsey met with the commission to report that her county reimbursement check has arrived.
Kyle Cornett, deputy sheriff, met with the commission regarding hours and compensation.
Andy Macias, Snyder & Associates, met with the commission to update permits and paperwork for BRO 031(34).
Presiding Commissioner Ruse will pursue a Soft Match/BRO Fund trade with Buchanan County for part of the funding.
Discussion was held regarding a change in state policy for the booking room on the first floor that affects the assessor’s storage room that is attached. The issue was tabled until next week.
Todd Miller, maintenance, met with the commission to schedule the removal of the window air conditioner units.
David Roll, EMA Director, met with the commission to discuss 2019 budget details. He also presented a draft of the new Daviess County Emergency Operations Plan.
Discussion was held regarding Washington Township and Daviess County Special Road District missing financial statements for fiscal year 2017. The county clerk will make contact with them this week.
In the afternoon the commissioners took the commission vehicle to Cameron to have repairs made.

The above information is taken from the minutes of the Nov. 7, 2018, meeting of the Daviess County Commission. Jim Ruse, presiding commissioner, called the meeting to order. Wayne Uthe, second district commissioner, was present. David Cox, first district commissioner, was absent.
Circuit Court
Kenneth W. Waln, Winston, appeared for arraignment on Nov. 8 before Judge Teresa Christian-Bingham. Waln entered a plea of not guilty. His bond, which had been set at $250,000, was reset to $15,000 cash with 10% deposit allowed; he was ordered to have no contact with the victim or victim’s family. Charges were filed Oct. 26 against Waln for burglary first degree, B felony, and assault 2nd degree, D felony. The charges stem from an incident that occurred in November 2017. Waln is accused of going to a Winston home where he seriously injured a resident. Waln posted bond, and the case was continued to Dec. 10.
Salvador Hernandez, 36, appeared in custody before Judge Jason Kanoy on Nov. 8. Hernandez, 36, owner of Mi Mexico restaurant in Gallatin, is charged with sodomy or attempted sodomy first degree, unclassified felony; kidnapping second degree, D felony; and assault third degree, E felony. The charges were filed on Oct. 10, and bond was denied. The court took up the defendant’s motion to reduce bond, which the State opposed due to lack of notice. The hearing on the motion to reduce bond was set for Nov. 16.

Associate Division
Johnny Rainey was charged Nov. 7 with trafficking in stolen identities, B felony, in addition to other charges which were filed after the execution of a search warrant at his residence. He and his wife Amanda were arrested Oct. 7, and both were charged with stealing, possession of controlled substance, identity theft, possession of marijuana and drug paraphernalia. Amanda Rainey was charged with an additional B felony of trafficking in stolen identities on Nov. 5.
According to the probable cause statement, a large amount of mail and personal documents from numerous persons in Daviess County were found during the search. Mrs. Rainey stated that Mr. Rainey walked with her while she stole unknown people’s mail to “keep her safe.” She said they would walk around the neighborhood near their residence to steal the mail. During a Mirandized interview, Johnny Rainey admitted to walking with Mrs. Rainey but stated he didn’t know what she was doing.
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:
Deonta D. Kinney, Independence, no valid license, $300; speeding, two days jail.
Donald T. Fore, McFall, driving while intoxicated amended to careless and imprudent driving, $500; speeding amended to defective equipment, $300;
Robert S. Fredricks, Pattonsburg, possession of drug paraphernalia, five days jail, board bill paid by defendant.
Matthew D. Waln, Winston, endangering welfare of a child, suspended imposition of sentence, two years probation, supervision; possession of drug paraphernalia, $150.
Beau T. Wells, Chillicothe, driving while intoxicated, suspended imposition of sentence, two years probation, 30 hours of community service; speeding, suspended imposition of sentence, two years probation, eight hours of community service.
Taryn D. Nunn, Trenton, no valid license, $150.
Lucas E. Montagne, Holiday Island, AR, no valid license, $300; speeding $30.50.
Diane K. Crawford, Gallatin, leaving scene of accident, suspended imposition of sentence, two years probation; property damage, 20 days jail; possession of marijuana, 14 days jail; possession of drug paraphernalia, $300. The charges stem from an incident which occurred Aug. 14, 2018, on State Route J near Kidder in which Crawford was striking and destroying mailboxes with her vehicle.
Htoo Htoo, Omaha, NE, speeding, $30.50; failed to drive right half of roadway, $30.50; no insurance, $103.50; no valid license, $300.
Civil Court
Breach of contract: A consent judgment was entered for Discover Bank and against Lous H. Boxx, Cameron, in a change of venue from DeKalb County.
Suits on account: LVNV Funding LLC vs. Calvin Jones and GFG Agriproducts LLC vs. Terrie L. Hogan were both dismissed by the parties.
