Troy Elbert of Gallatin appeared before Judge James B. Funk in Caldwell County for a probation violation hearing on Oct. 25, in a change of venue case from Daviess County. Elbert admitted to the violations during the hearing. The court continued Elbert on probation with an additional condition of serving 87 days shock detention, with credit for time served. Elbert was released from custody.

Elbert had been charged in Daviess County in November 2016 with possession of controlled substance with intent to distribute, C felony. The case was transferred to Caldwell County in January 2017, where he pled guilty in March 2017. He was sentenced in June 2017 to seven years in the Department of Corrections, with the court retaining jurisdiction and ordering completion of a 120-day institutional treatment program. He was released in September 2017. The probation violation against Elbert was filed in August 2018.
According to the probable cause statement, Elbert had sold methamphetamine from his home in Gallatin to a confidential informant acting on behalf of the NITRO Task Force and Daviess County Sheriff’s office.
