Circuit Court
Due to the appointment of Thomas N. Chapman to the Missouri Court of Appeals, Western District, on Aug. 29, Brent Elliott has been appointed as the presiding judge of the 43rd Circuit. Judge Elliott will be responsible for the reassignment of Judge Chapman’s cases.
Jeramy Sanders of Pattonsburg pled guilty to domestic assault second degree, D felony, and tampering with motor vehicle, A misdemeanor on Sept. 6. Sanders made the plea just prior to a jury trial which had been scheduled for him that day. A sentence assessment report was ordered, and the jury, which had come for the trial, was dismissed. The case was heard by Judge Bartley Spear.
The following cases were heard by Judge Daren Adkins on Sept. 5:
In Jamie Trimble vs. Director of Revenue, the petition for reinstatement of license was granted.
Dissolutions of marriage were granted to Charles Lollar from Chelsea Lollar; and to Amanda R. Baker from Douglas D. Baker, with her maiden name Williams restored.
Civil cases filed: Department of Revenue Collections Enforcement vs. Jeremy Clay, Platte City, certificate of lien, DOR, taxes; Kristi Chapman, Shawnee, KS, vs. Ronald Fredrick, Gallatin, dissolution of marriage.
Associate Division
Carmelo Hernandez of Nashville, TN, and currently residing in Gallatin, was charged Sept. 5 with unlawful use of weapon, E felony, in a road rage incident on I-35 that occurred on July 21. Trooper J. Lynch conducted a traffic stop on a Tahoe driven by Hernandez. Hernandez brandished a firearm in a threatening manner to subjects in another vehicle. Trooper Lynch recovered a .45 caliber pistol from the vehicle and arrested Hernandez without incident. Adam Warren of Livingston County has been named as special prosecutor in the case.
Michael A. Nattier, Patoka, IL, was charged Sept. 6 with two felony counts of passing bad checks.
Sarah Elaine Dowell, Milan, was charged Sept. 6 with felony possession of controlled substance at private jail and misdemeanor possession of item at jail which prisoner is prohibited from receiving. As an inmate at Daviess DeKalb County Regional Jail (DDCRJ), she is accused of smuggling paraphernalia and testing positive for methamphetamine and THC during a voluntary urine analysis.
Allie Genai Rainey of Liberty was charged Sept. 6 with four misdemeanors, speeding, possession of marijuana, drug paraphernalia, and no valid license. She was arrested by the Highway Patrol during a traffic stop on I-35 on Aug. 27 after a radar check revealed she was traveling in excess of 110 miles per hour. When she yielded to the patrol north of Route E on U.S. 69, marijuana and paraphernalia were found in her car, and she had no valid license. She was transported to DDCRJ.
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:
Aaron J. Degeare, Kansas City, driving while revoked, $500; no insurance, $103.50; no valid license, $150.
Robert D. Temple, Tulsa, OK, careless and imprudent driving involving accident, $80.50.
Civil Court
Breach of contract: Portfolio Recovery Associates LLC vs. Destiny Moore was dismissed by the parties.
Suits on account: Midwestern Health Management vs. Barney Esbeck et al was dismissed by the parties. Midwestern Health Management et al vs. Kevin D. Cecil was dismissed by the parties. Harrison County Community Hospital vs. Kathryn R. Petty et al was dismissed by the parties. A default judgment was entered for Capital One Bank and against Grace E. Sharp.
Contract-Account: A default judgment was entered for Capital One Bank and against Dana L. Maxwell.
County Commission
Assessor Sally Black discussed exempted property that needs to have a form filled out by the property owner for reassessment year 2019. She also described a problem with an incorrect deed on a property needing a correction deed. Sally also discussed commercial, personal, residential and agriculture values.
James Lewis, bridge supervisor, stated his crew will be working on culverts and tubes on 250th Street. The commission tabled discussion on equipment rates for soft match projects until next week.
Bills were approved. Minutes from the last meeting were approved.
Due to the absence of Ronetta Burton, county clerk, the commission tabled discussion on progress with the new phones and IT security issues until next week. UPS for the card reader was also tabled until further information is acquired. The commission also will work on updating the county personnel manual and the 2018 budget next week.
Sheriff Ben Becerra presented the commission his annual certificate of training from the Missouri Sheriffs Association.
Judge Daren Adkins answered questions from the commissioners about Daviess County having a full-time prosecutor.
Deputy Larry Adams will be picking up new door keys for the courthouse at Trenton.
Commissioners approved Progress Invoice 17 for Howe & Co., BRO 031(36) for $6,493.95.
Dick Carpenter, Harrison Township, spoke to the commission by phone regarding a notice to proceed for CART rock.
The commissioners inspected roads in Harrison Township in the afternoon. They also looked at two bridges in Union Township.
