The following cases were heard by Judge Thomas Chapman on March 14:

Matthew E. Labee of Pattonsburg has been sentenced to serve 15 years for unlawful use of a weapon, B felony, and four years for D felony unlawful use of weapon. The sentences will run consecutively. His suspended execution of sentence and probation were revoked in the probation violation hearing, during which Labee admitted using controlled substances and committing the criminal offense of property damage.

Labee originally faced nine charges — including two counts of felonious assault, four counts of unlawful use of a weapon, and one count of armed criminal action — which stemmed from an apparent road rage incident that happened about 6 p.m. on Sept. 30, 2015, on Highway 13 in Daviess County. Labee brandished and fired a handgun during the incident, which occurred within 100 feet of the North Daviess R-3 School, just outside the limits of the Village of Jameson.

Tracy Lee Wooten failed to appear for a probation hearing on an original charge of driving while revoked, D felony. A warrant was issued with no bond.

Shawn Yuille surrendered his probation and consented to revocation of probation on two misdemeanor charges, receiving stolen property and tampering with motor vehicle. Disposition was continued to May 16. Yuille is currently incarcerated at the regional jail on a charge of second degree murder for his role as the driver in a high speed crash last year in downtown Chillicothe that resulted in the death of a Chillicothe attorney. He is also charged with endangering the welfare of a child first degree, as his 5-year-old daughter was injured in the crash. Yuille allegedly inhaled the contents of an air duster, causing him to pass out.

The suspended imposition of sentence and probation were revoked for Miranda Page on a felony charge of forgery. She was sentenced to four years in the Department of Corrections.

Probation was revoked for Giovanni D. Scott on a misdemeanor charge of domestic assault, and his one year sentence was ordered executed, with credit for time served. On another charge of domestic assault, his probation was continued and extended one year.

Donald G. Shields had plead guilty in January to the E felony of failure to register as sex offender. He was sentenced to four years in the Department of Corrections, execution of sentence suspended. He received five years probation and 120 days shock jail time with credit for time served.

Jason D. Livick plead guilty in January to misdemeanor endangering welfare of a child. He was sentenced to 90 days jail, execution of sentence suspended, two years probation, and fined $250.

David E. Deming tested positive for methamphetamine at a probation revocation hearing for felony possession of controlled substance. He was taken into custody, and a warrant was issued with no bond.

In State vs. Devona Lea Bailey, a change of judge was granted. She is charged with DWI, persistent, E felony, and misdemeanors of speeding and failure to drive on the right half of roadway. The case was transferred to Judge Brent Elliott.

A jury trial was set for Sept. 6, 2018, for Jacob A. Barnes, who is charged with tampering with motor vehicle and stealing, both D felonies.

Kelly L. Clevenger had plead guilty in January to endangering welfare of a child, D felony. He received a suspended imposition of sentence, five years probation, and 25 days shock jail time. He was fined $300 for possession of marijuana and $150 for drug paraphernalia.

A jury trial was set for Oct. 15, 2018, for Lisa F. Reynolds on a D felony charge of endangering welfare of a child.

Kurtis A. Smith plead guilty to misdemeanors of endanger welfare of a child and assault fourth degree, both amended from felony charges. He was sentenced to six months jail on each count, to run concurrently.

A bench trial for Tiffany Ann Luttrell was set for April 4, 2018, on a D felony charge of failure to register as sex offender.

A bench trial for Joseph E. Ginn was set for May 11, 2018, on four D felony counts of failure to register as sex offender.

Justin A. Lamb plead guilty by videoconference to the E felony of damage to jail property, and was sentenced to four years in the Department of Corrections. One B felony count of possession of firearm at jail was dismissed.

A bench trial was set for Sept. 24, 2018, in a breach of contract case, Robert Tull vs. NWGC NW Generational Concrete LLC.

Cases bound over from the Associate Division: State vs. Tracy J. Dunse, Gallatin, two counts of DWI-habitual, B felony, speeding, C misdemeanor, failure to maintain financial responsibility, D misdemeanor, two counts of no valid license, D misdemeanor; State vs. Nyia Shynell Robinson, Kansas City, KS, possession of controlled substance, D felony, receiving stolen property, D felony; State vs. Mack Jerry Robinson, Kansas City, KS, possession of controlled substance, D felony, receiving stolen property, D felony.

Civil cases filed: In Re, Kaydence Nichole Jordan, Coffey, change of name. The Department of Revenue Collections Enforcement has filed certificates of lien, DOR, taxes, against Angela M. Kelley, Platte City, and Melvin K. Offutt, Gallatin.

Associate Division

Kyle James Kidwell, Greenwood, was charged March 19 with tampering with motor vehicle first degree, D felony, E felonies of driving while revoked and resisting arrest, and misdemeanors of property damage second degree, speeding, careless and imprudent, and failure to drove on right half of roadway.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:

Brandon T. May, Kidder, speeding (107 mph), $250, 2 days jail, board bill paid by defendant; no insurance, $103.50; no seat belt, $10.

Haylie M. Turner, Jamesport, violated intermediate driver’s license, suspended imposition of sentence, one year probation, 30 hours community service.

Jason M. Chadwick, Jameson, failed to check deer and possessed bobcat taken during closed

Season, suspended imposition of sentence, two years probation, and 30 hours community service on each count.

Hannah D. Tucker, Gallatin, failed to drive on right half – accident, $30.50.

Ronald Osburn, Jamesport, no valid license amended to class A misdemeanor, 5 days jail, board bill paid by defendant.

James P. Walker, Coffey, driving while intoxicated, $350; failed to drive right half, $30.50.

Krystyna Johnson, St. Joseph, two counts non-support, suspended imposition of sentence and two years probation on each count.

Michael R. Wittren, Overland Park, KS, possession of marijuana, seven days jail; possession of drug paraphernalia, $150; no insurance, $103.50.

Patrick L. Best, Mound City, KS, driving while intoxicated, 10 days jail, board bill paid by defendant; careless and imprudent driving, two days jail, board bill paid by defendant; no valid license, $300.

Justin M. Ross, Kansas City, no valid license, $300.

Isaac T. Smith, Bethany, failed to stop at sign, 15 days jail; displayed plates of another, $400; no seat belt, $10.

Veronica Sanchez-Lozano, Bloomington, MN, speeding (100 mph), $250, two days jail, board bill paid by defendant.

Brinton J. Bingham, Provo, UT, possession of drug paraphernalia, $150.

Austin Burton, Pattonsburg, passing bad checks, $25.

Marriages

Judge Daren Adkins officiated the following marriages: Lucas Brody Smith, 20, and Teresa Ann Childs, 19, both of Jamesport, on March 13; William Robert Ragle Jr., 20, and Heather Lucille Curtis, 20, both of Altamont, on March 16; Nathaniel Arthur Young, 22, and Avery Nicole Moore, 19, both of Chillicothe, on March 16.

County Commission

James Lewis, road and bridge supervisor, met with commissioners regarding road issues. Crews have been continuing to clean the areas around the road and bridge building and will be installing a culvert on 190th Street in Sheridan Township this week.

Bills were approved.

Dale Willis, Viking-Cives Midwest, stopped by to talk to commissioners about updating the dump truck.

Leonard Lowry, SKW Engineering, stopped by and brought the commissioners a peach pie for “Pi Day 3.14.”

Commissioners viewed roads in Jamesport and Colfax Townships after lunch.
