Circuit Court
A change of venue to Caldwell County has been granted in State vs. Dana Maxwell. Judge Thomas R. Alley has been assigned to the case. Maxwell is accused of stealing over $150,000 from the Tri-County R-7 School while she was a secretary at the school from 2012-2015. She is charged with 16 felonies: eight charges of receiving stolen property, seven charges of forgery, and one charge of fraudulent use of a credit device.
The following cases were heard by Judge Thomas Chapman on Oct. 11:
Javier Valenzuela was sentenced to seven years in the Department of Corrections on each of two felony charges, unlawful possession of firearm and unlawful possession of illegal weapon, sentences to run consecutively. The court ordered a 120-day institutional treatment program. Valenzuela was fined $5,000 on the first firearm charge. He was also fined $300 for driving while revoked, misdemeanor, and received a suspended imposition of sentence and two years probation for drug paraphernalia.
Probation was revoked for Daryl DeWayne Travis on a D felony charge of resisting arrest. His four-year sentence was ordered executed. On two misdemeanors, failure to yield and failure to register vehicle, his suspended imposition of sentence was revoked and he was sentenced to 10 days jail on each count, concurrent.
Jeffrey Matthews failed to appear for a probation review on a bad checks felony charge. A warrant was issued with bond set at $1,000.
The suspended imposition of sentence for Donna J. Sweat was revoked on a misdemeanor charge of child endangerment. She was sentenced to one year in jail, execution of sentence suspended, and two years probation.
A jury trial was set for Feb. 21, 2018, for John J. Moreno for failure to register as sex offender.
A jury trial was set for Feb. 1, 2018, for Rain K. Cizek, for receiving stolen property, C felony, and misdemeanors of possession of drug paraphernalia and marijuana.
In State vs. Keith Albert Shafer, Judge Brent Elliott was assigned to the case. Shafer is charged with felony burglary and stealing.
Jordin D. Nealon plead guilty to possession of controlled substance, D felony, and drug paraphernalia, D misdemeanor. A sentence assessment report was ordered.
Johnny L. Blevins plead guilty to assault, A misdemeanor, amended from E felony, and was sentenced to 30 days jail.
Autumn C. Thein plead guilty to possession of controlled substance, D felony, and drug paraphernalia, D misdemeanor. A sentence assessment report was ordered.
The following cases were heard by Judge Chapman on Oct. 4:
Quiet title was granted to William L. Bear, Karen Bear, and Barbara Ahrendt from Martin L. Landes.
Dissolutions of marriage were granted to Kayla Berry from Phillip Berry; to Michael J. Comstock from Geraldine B. Comstock; and to Steven Kyle Sgambato from Megan Elizabeth Sgambato with her maiden name of Megan Elizabeth Shaul restored.
Valerie Ann Potter was granted a change of name, from Potter to Werner.
Civil cases filed: Linda Ann Jameson, Pattonsburg, vs. Jason David Jameson, Kingston, dissolution of marriage; Fabian W. Lincoln vs. State of Missouri, post conviction relief.
Associate Division
John J. Moreno, Weatherby, was charged Oct. 13 with harassment second degree and assault fourth degree, both misdemeanors, due to an incident at the Daviess-DeKalb Regional Jail.
Civil Court
Breach of contract: Shane L. Harkins vs. Jason Daley et al was dismissed by the court without prejudice. Discover Bank vs. James R. Fuller was tried by the court, with judgment granted to the plaintiff, Discover Bank.
Municipal Court
Defendants found guilty in the municipal court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the City of Gallatin are $32.50. Judge Daren Adkins presided over the following cases:
Failure to register vehicle: Dillon Lynn Curtis, $54.50; Lisa Marie Maenhoudt, $54.50.
Speeding: Evelyn Estrada, $117.50.
Improper backing: Dariyn R. Pettit, one year, suspended imposition of sentence; Michelle L. Ramos, $42.50; Corey L. Meier, $42.50.

Driving in careless and reckless manner: Morgan I. Miller, one year, suspended imposition of sentence.

Marriage
Justin Tyler Moody, 29, and Michelle Lee Jago, 29, both of Gower, were married Oct. 12 by Judge Daren Adkins.
County Commission
James Lewis, road and bridge supervisor, reported that crews are completing corrugated pipe placement in Lincoln Township.
Assessor Sally Black submitted her annual 2017 training certificates.
Jeannie Cunningham and Brett Delaney, Mike Keith insurance agents, discussed renewal rates for health insurance for Dec. 1, 2017. Renewal rates were at a 0% increase with the Lifestyle Health Plans. The vision plan went down 1.78%.
Judy Elbert asked the commissioners for use of the courthouse first floor and lawn for “Christmas on the Square” on Nov. 18.
David Cox entered the meeting at 10:30 a.m.
A public meeting was held at 11 a.m. for bid openings for Bridge 43100222 BRO-B031(36) and Bridge 431002081 BRO-B031(37). In attendance were Jon Dwiggins, Howe Company LLC; Gene Haile, Gene Haile Excavating, Inc.; Marli Hayes, Capital Paving & Construction; Michael Sattman, MS Contracting LLC; Terry Littrell, Boone Construction; and Chris Childress, C&C Bridge & Concrete Inc. Bids were opened. Commissioners will review later and award bridges at that time.
Commissioners discussed having health insurance for employees with three options of a deductible of $3,500; $2,500 with an employee “buy-up;” and a Health Savings Account.
Sally Black, assessor, and Vicki Corwin, county clerk, held discussion with the commissioners regarding keys to offices and cleaning issues.
