In a jury trial held Sept. 7, on a change of venue from Clinton County, Anthony C. Brown of Plattsburg was found guilty of two counts of possession of controlled substance with intent to distribute, one count of armed criminal action, one count of receiving stolen property, and one count of possession of a defaced firearm. The trial was heard by Judge Daren Adkins in Daviess County Circuit Court.

The defendant’s request to discharge his attorney and represent himself was granted. The State was represented by Joseph Gagnon and Brandi Kellam.

The jury went to deliberation at 2:30 p.m. and returned guilty verdicts on the five counts at 3:52 p.m. Sentencing was scheduled for Oct. 17.

The charges stemmed from an incident in Plattsburg on Aug. 21, 2016, in which Brown threatened his ex-girlfriend and her brother with a handgun. While executing a search warrant, officers later found several weapons, as well as drugs and paraphernalia in Brown’s apartment. Brown already had several misdemeanor and felony convictions at the time, and was disqualified from possessing firearms. One of the handguns found was confirmed to be a stolen firearm out of Kansas City.

Circuit Court

The following cases were heard by Judge Thomas Chapman on Sept. 6:

Dissolutions of marriage was granted to Brandon M. Hoover from Jennifer L. Hoover; and to Deena S. Eads from John M. Eads.

Cases bound over from the Associate Division: State vs. Christopher S. Jackson, Grandview, non-support, class D felony; State vs. William F. Veal, Ames, Iowa, two counts of assault third degree, special victim, class D felonies; State vs. James E. Firebaugh, Excelsior Springs, possession of controlled substance, class C felony, stealing – controlled substance/meth manufacturing material, class D felony.

Civil cases filed: Rolla S. Sweiger vs. State of Missouri, motion to vacate, set aside or correct judgment. The court ruled that the motion was not timely filed, and prohibited filing of any successive motions.

Associate Division

William Donoven Reynolds was charged Sept. 7 with no valid license third and subsequent offense, E felony, failure to register vehicle, B misdemeanor, and failure to maintain financial responsibility, D misdemeanor.

Civil Court

Suits on account: Citibank NA vs. Mattie M. Radabaugh was dismissed by the court without prejudice. A change of venue was granted in Midland Funding LLC vs. Wilmer Gingerich.

Refuse Breathalyzer: Mark Negrete vs. Missouri Department of Revenue was tried by the court. The court ordered the DOR to restore Negrete’s license and privilege to drive in the State of Missouri and to remove all indicia of the sanction from his driving history.

County Commission

Jim Holcomb, Salem Township, met with the commissioners regarding CART roads in Salem Township.

Joe Brinser, Grundy County Commission, spoke by phone with the commissioners regarding the opioid tracking system planned for Grundy and Livingston counties.

MoDOT has approved funding for BRO-B31(36) and BRO-B31(37) bridges. The county is now authorized to advertise for bids on these projects.

Lindsey Chaffin, Great River Engineering, met with the commission regarding their engineering services.

Aaron McVicker met with the commission regarding a BEAP study on Bridge 466001.3 on 235th Street.

Jon Dwiggins, Howe & Company, met with the commission regarding final approval for the Quick Avenue repaving project.

Oden Enterprises met with the commissioners regarding bridge steel needs.
