The following cases were heard by Judge Thomas Chapman on April 12:

A jury trial was set for Aaron Robert Balliett on Sept. 20-21, 2017, on charges of involuntary manslaughter, vehicular, intoxicated; DWI, B misdemeanor; careless and imprudent driving, A misdemeanor; and failure to stop for stop sign, C misdemeanor. Balliett was the driver in a one-vehicle accident which occurred May 29, 2016, which resulted in the death of McKenzie Rae Patti, in Daviess County.

A jury trial was set for Carlos Rocha on June 9, 2017, on charges of driving while intoxicated, E felony, and a plate violation.

A jury trial was set for Fabian W. Lincoln on May 30, 2017, on felony charges of driving while intoxicated – habitual and no valid license, and five other misdemeanor charges.

Probation was revoked for Jennifer A. Bears on a C felony charge of possession of controlled substance. Her previously imposed sentence of seven years in the Department of Corrections (DOC) was ordered executed.

Probation was revoked for Kyleigh Rothman on a C felony charge of burglary, and the previously imposed sentence of five years in the DOC was ordered executed. She had previously plead guilty to three felony charges of stealing, which were set aside, and the charges were amended to misdemeanors. She was sentenced to six months jail with credit for time served on each of the three misdemeanors. She was sentenced to 10 days jail on a B misdemeanor of property damage with credit for time served. All sentences run concurrently, and consecutively to any other sentences being served.

Probation was revoked for Andrew Johnson on two counts of unlawful use of a weapon, D felony. The previously imposed sentence of four years in the DOC on each count was ordered executed, sentences to run consecutively. On a misdemeanor charge of domestic assault, he was sentenced to 120 days in the regional jail.

Aaron Martin plead guilty in November to attempted possession of controlled substance, D felony. He received a suspended imposition of sentence and two years probation. He was fined $80 for speeding.

Blake J. Goddard plead guilty, by video conference, to attempted damage to jail property, amended from felony to misdemeanor, and was sentenced to 30 days in the regional jail with credit for time served.

Probation was reinstated for Jean A. Rogers on a C felony charge of forgery, originally filed in 2011. She was placed on a new 5-year term of probation.

Civil cases filed: Certificates of lien, DOR, taxes, have been filed against Daniel Goll, Winston; Brenda K. Goll, Winston; and Red Bird Diner, Winston.

Associate Division

Civil Court

Wayne Willits vs. Director of Revenue was tried by the court. Willits’ petition for limited driving privilege was denied.

Replevin: Harley-Davidson Credit Corp. vs. Manuel J. Quintana was dismissed by the parties.

Municipal Court

Defendants found guilty in the municipal court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the City of Gallatin are $32.50. Judge Daren Adkins presided over the following cases on April 10:

Kyanna M. Merritt was fined $100 for driving while license was suspended.

Kelsey Dawn Bird was fined $42.50 for improper backing.

Norma R. Griffin was fined $117.50 for an equipment violation.

Steven Heath Prindle was fined $200 for peace disturbance.

Meleana P. Still was fined $100 for assault.

County Commission

James Lewis, road and bridge supervisor, discussed issues around the county regarding water drainage issues and bridges.

Joe Michael discussed a bridge on 117th Street in Jefferson Township on which the approach has been washed out. The road and bridge crew will be replacing it with a corrugated metal pipe.

John Quinn discussed a collapsed plastic pipe and drainage issues in Grand River Township.

David Roll, Emergency Management Director, discussed issues with commissioners.

Wayne Uthe left the meeting at 10:35 a.m.

Eric Corwin, clock keeper, discussed colored lights for the courthouse in reference to Autistic Awareness Month.

Commissioners attended the Local Emergency Planning Committee meeting at noon.

Wayne Uthe returned to meeting at 1:15 p.m.

Commissioners inspected corrugated metal pipes, bridges, roads and culverts in Jefferson and Colfax Townships.

The meeting adjourned at 3:37 p.m.
