Circuit Court

The following cases were heard by Judge Thomas Chapman on Feb. 15:

A jury trial was set for June 29-30, 2017, for Teddy Holcomb on a charge of statutory rape.

A jury trial for Brian James Deweese was postponed to April 20, 2017, on two counts of possession of controlled substance, one of DWI, drug intoxication persistent offender, and drug paraphernalia.

Bridgette L. Callaway plead guilty on Dec. 14 to tampering with motor vehicle, C felony. She was sentenced to six years in the Department of Corrections, execution of sentence suspended. She was placed on five years probation, and ordered to serve 60 days shock jail time with credit for time served, and to pay restitution of $2,910.46.

Dustin R. Teel plead guilty to misdemeanor assault, amended from a felony, and was sentenced to 120 days in the regional jail, execution of sentence suspended. He was placed on two years probation and ordered to serve 30 days shock jail time. On a misdemeanor count of property damage, he received a suspended imposition of sentence and two years probation. He also plead guilty to driving while revoked, unclassified misdemeanor, and was fined $300.

Dustin Ray Carpenter plead guilty to misdemeanor assault on law enforcement, amended from a felony. He was sentenced to six months jail, execution of sentence suspended, placed on two years probation and fined $100. On a misdemeanor count of domestic assault, he was sentenced to 12 months jail, execution of sentence suspended, and placed on two years probation. He will serve 30 days shock jail time with credit for time served.

Dennis Alan Swearingin had previously plead guilty in November to felony possession of controlled substance. He was sentenced to five years in the Department of Corrections, execution of sentence suspended, placed on five years probation, and ordered to serve 50 days shock jail time with credit for time served. On a misdemeanor count of drug paraphernalia, he received a suspended imposition of sentence and two years probation.

Voris Markell Ross plead guilty to possession of controlled substance at jail facility and was sentenced to two years in the Department of Corrections. For misdemeanor no valid license, he was fined $300.

Probation was extended one year for Jennifer N. Smith, and she was ordered to serve 15 days shock jail time, due to probation violations on two forgery cases.

Abheshek Kothary plead guilty to misdemeanor possession of controlled substance, amended from a felony. He was sentenced to five days in the regional jail and fined $300. He was fined $300 for misdemeanor possession of marijuana, and $30.50 for speeding.

Christopher W. Allen plead guilty Nov. 16, 2016, to driving while revoked, D felony. He was sentenced to three years in the Department of Corrections, execution of sentence suspended, placed on five years probation, and ordered to serve 48 hours shock jail time. He was fined $50 for failure to drive on right half of roadway.

Timothy Johnson plead guilty on Dec. 14, 2016, to assault, C felony. He was sentenced to seven years in the Department of Corrections, execution of sentence suspended, placed on five years probation, and ordered to serve 120 days shock jail time with credit for time served. He was also ordered to pay restitution of $5,439.99.

Civil cases filed: Michael Cottrell, Gilman City, vs. Gene Prindle, Lois Prindle, and Prindle Farms, Jameson, suit on account; Farm Credit Services of America vs. David V. Searcy, Pattonsburg, registration of foreign judgment; Department of Revenue Collection Enforcement vs. Roseland Landscape and Design, Altamont, certificate of lien, DOR, taxes.

Associate Circuit Court

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:

Terry Stewart, Sugar Creek, driving while intoxicated, $350.

Javier Mondragon-Albarran, Independence, operated vehicle without a valid license, $150.

Tyler J. Hackman, Lawson, minor in possession of liquor, $25, 30 hours community service.

Janee R. Fi1beck, Gallatin, minor visibly intoxicated, $25, 30 hours community service.

Sameckia T. Oakley, Des Moines, IA, operated vehicle without a valid license, $300.

Richard E. Mendenhall Jr., Unionville, possession of marijuana, $300; possession of drug paraphernalia, $150; no seat belt, $10.

Brian L. Lovell, St. Joseph, operated vehicle without a valid license, $150; failed to register vehicle, $30.50.

Andy S. Bo1ay, Aldooda, IA, driving while intoxicated, $350; speeding, 5 days jail, board bill paid by defendant; operated vehicle without a valid license, $300.

Brenden Casky, Jamesport, possession of marijuana, 30 days jail, $25, suspended execution of sentence, two years probation.

Jay A. Hatfield, Jamesport, domestic assault, 30 days jail, $25, suspended execution of sentence, two years probation; operated vehicle without a valid license, $300.

Stephen C. Deming, Ridgeway, driving while revoked – prior offender, 20 days jail; speeding, two days jail; possession of marijuana, $300; failed to display plates, $30.50.

Civil Court

Suit on account: A consent judgment was entered for Midwestern Health Management and against Edward E. French et al.

Municipal Court

Defendants found guilty in the municipal court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the City of Gallatin amount to $32.50 for moving traffic violations and $29.50 for non-moving violations. Judge Daren Adkins presided over the following cases on Feb. 14:

Joseph W. Davis was fined $52.50 for speeding.

Crystal R. Orr was fined $50 for peace disturbance.

Mary Leonnie Ellington was fined $10.50 for animal license.

Kaitlin Ann Trimble and Ayrica Jade Stufflebean each received a suspended imposition of sentence and one year probation for property damage.

Marriage

Dale Ray Myers, 30, and Codi Jean Brannen, 34, both of Gallatin, were married Feb. 14 by Judge Daren Adkins.

County Commission

All commissioners submitted certificates of training from the County Commissioners Association of Missouri for 20 hours of annual training.

Steve Holcomb and Jane McKinsey, recorder, discussed flooring for the Recorder’s Office.

Road and bridge crews are working on placing a four-foot corrugated metal pipe on 177th Street in Sheridan Township.

Richard Stuck, senior auditor from State of Missouri, discussed an upcoming audit for Daviess County.

Randy Sims moved to appoint Cheryl Alexander as Daviess County Health Officer. David Cox seconded. Motion carried.

Chad Higdon, CEO of Second Harvest Food Bank, discussed services that the food bank provides for the county.

Justin Johnson, representative from Mike Keith Insurance, completed blood draws for county employees.

Jeff Hower, Daviess County Special Road District #1, discussed the 165th Street project in the district with commissioners.

Wayne Uthe moved to accept the Holcomb Flooring bid for replacement of the flooring for the Recorder’s Office. David Cox seconded. Motion carried.

Commissioners viewed a bridge on 330th Street.

The meeting adjourned at 4:14 p.m.
