These are the unapproved minutes of June 22, 2016. All commissioners were present. Minutes were approved, and bills authorized.

James Lewis, road and bridge supervisor, and the county crew are continuing to work on the bridge on 292nd Street this week.

Ron Urton, Howe & Company, updated commissioners on bridge construction of BRO-B031(36) and  BRO-B031(37) in Jamesport Township.

Dane Worrell discussed work completed with the roof and the windows for the courthouse.

Keith Sutton discussed an issue in Washington Township regarding flooding and drainage. Brush issues were discussed regarding the following areas: Forest Avenue in Washington Township, 290th Street and Forest Avenue in Lincoln Township, and 168th Street and 180th Street in Salem Township.

Pam Howard, circuit clerk, discussed the plan which Bluebird Networks has determined to connect the fiber wiring to the courthouse building for the State of Missouri’s installation for the Circuit Court offices. Commissioners agreed with Bluebird Networks to place the line next to the sidewalk on the southwest side of the courthouse instead of underneath the sidewalk on the northwest side.

Commissioners signed revised Certified Order 2016-2 Resolution regarding the Property Assessment Clean Energy Act (PACE).

Commissioners signed a letter of engagement for an audit from CliftonLarsonAllen.

Commissioners will be advertising a part-time position for brush mower operator due to the resignation of David Allen.

Commissioners signed Invoice Number 3 for BRO-B031(36) for bridge No. 43100221; and Invoice No. 3 for BRO-B031(37) for bridge No. 43100081.

The commissioners visited Marion, Jefferson, Salem, Washington and Benton Townships to view brush issues and storm damage of the roads.

Circuit Court

Forty-five potential jurors were called in for a jury trial on June 28 for Christopher Pickering of Milan, on a class B misdemeanor charge of DWI, alcohol. Jurors appeared and were dismissed before entering the courtroom. Just prior to the beginning of the trial, Pickering accepted the State’s final offer of a $350 fine and entered a guilty plea. He was also ordered to pay costs to include recoupment of $118.00. The incident occurred in November of 2013 on northbound I-35. The case was heard by Judge Jason Kanoy.

A felony DWI persistent offender charge against Toby D. Griffin was recently dismissed, when the defendant filed a motion to suppress, and the court sustained the motion. The case had previously been scheduled for a jury trial.

Cases bound over from the Associate Division: State vs. Timothy Johnson, Trenton, felony assault second degree; State vs. Andrew Johnson, Maysville, felonies of armed criminal action, unlawful use of weapon while intoxicated and unlawful use of weapon – exhibiting, and misdemeanor domestic assault third degree;

State vs. Diane M. Smith, Kansas City, Kan., felony possession of controlled substance with intent to distribute and misdemeanors of possession of marijuana, drug paraphernalia and driving while revoked.

Civil cases filed: Department of Revenue Collection Enforcement filed a certificate of lien, DOR, taxes, against Breezy Services Inc., Gallatin.

Associate Division

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations, and $116.50 in most criminal cases. Judge Daren L. Adkins presided over the following cases:

Lindsay Hunter, Gilman City, theft-stealing, 30 days jail, suspended execution of sentence, 2 years probation.

Christin Gibson, Glenpool, OK, speeding, $250, 48 hours jail, board bill paid by defendant.

Ronald F. Gibson, Ridgeway, no valid license, 2 days jail.

Jared Davis, Kansas City, no valid license, $150; possession of marijuana, suspended imposition of sentence, 2 years probation, 30 hours community service; possession of drug paraphernalia, suspended imposition of sentence, 2 years probation, 30 hours community service.

Brock Sellers, Kansas City, driving while intoxicated, suspended imposition of sentence, 2 years probation, 30 hours community service; speeding, $30.50.

Ricky Pauley, Milan, tampering with physical evidence, 35 days jail; no valid license, $300; failed to drive right half of roadway, 3 days jail consecutive to each.

Tanner G. Hudson, Trenton, possession of drug paraphernalia, $300.

Quade Peery, Jamesport, Leaving Scene of Motor Vehicle Accident – probation violation, probation revoked, 13 days jail, $25.

Kayla Berry, Savannah, littering – probation violation, probation revoked – 48 hours jail; passing bad checks, $25.

Celina Mercado, Carthage, driving while revoked, $300; vision reducing material on window, $30.50.

David Graham, Bethany, driving while intoxicated, $350 fine, $98 recoupment; operated vehicle without a valid license, $300.

Judge Jason Kanoy presided over the following case:

Jackson Anderson, Kansas City, passing bad checks amended to class A misdemeanor, $25; driving while revoked, $300.
