Your Right to Know. The following is a portion of the information released from the Daviess County Courthouse on Tuesday, May 24, 2016.
County Commission
James Lewis, road and bridge supervisor, and the crew continue working on the bridge on 292nd Street, weather permitting. Crews are completing discrepancies noted by the 2016 bridge inspections that were completed by MoDOT.
Resolution 2016-1 was approved by the commissioners regarding Sunshine Law (Chapter 610) Policy.
Commissioners reviewed historical information regarding the Lewis Mill in regards to the previous administrations.
Commissioners reviewed SEMA/FEMA project paperwork for various sites.
Pam Howard, circuit clerk, discussed that the State of Missouri will be putting fiber to the Circuit Court offices.
Carl Carder made a motion to accept invoice and pay amount from Kramer Contracting Company. David Cox seconded. Motion carried.
The Commissioners visited Sheridan, Colfax, Benton, Grand River, Jamesport, Jackson, and Union Townships checking brush, roads and bridges.
These are the unapproved minutes of May 18, 2016. Randy Sims, presiding commissioner, called the meeting to order. Carl Carder, second district commissioner, and David Cox, first district commissioner, were present. Minutes were approved, and bills authorized.
Circuit Court
Before Judge Thomas Chapman on May 20, Allen S. Tolen of Jamesport was sentenced to eight years in the Department of Corrections for possession of controlled substance with intent to distribute, seven years for possession of controlled substance, and four years for unlawful possession of firearm. These sentences are to run concurrently.
Tolen had sold marijuana and/or methamphetamine to an undercover officer on four separate occasions from January through March of 2014.
Five charges were dismissed. Tolen had previously plead guilty to these charges on Feb. 19.
On a separate charge of misdemeanor no valid license, Tolen was sentenced to 30 days jail and fined $100. The jail sentence runs concurrently to his other sentences.
Cases bound over from Associate Division: State vs. Roger Dale Hess, Gallatin, possession of controlled substance, class C felony, possession of synthetic cannabinoid, class A misdemeanor, and four misdemeanor counts of drug paraphernalia;
State vs. Sarena Oliver, Wichita, Kan., possession of controlled substance with intent to distribute, class B felony, and possession of controlled substance, class C felony;
State vs. Sean Osborn, Sugar Creek, elder abuse second degree, class B felony; State vs. Dustin Sisemore, Kidder, domestic assault second degree, class C felony; State vs. Adam A. Miller, Independence, burglary first degree, class B felony, possession of burglary tools, class D felony, resisting arrest, class D felony.
Civil cases filed: Jason M. Michener, Pattonsburg, vs. Jessica S. Michener, Higginsville, dissolution of marriage. The Department of Revenue filed certificates of lien, DOR, taxes, against Phil Morrell, Gallatin; Morrell Legacy Hospitality, Gallatin; and Legacy LLC Morrell, Holladay, Utah.

A change of venue case from DeKalb County was dismissed by the parties. The plaintiffs were State Ex Rel. Osborn Wind Energy, LLC and Osborn Wind Energy LLC. The defendants were Washington Township Planning and zoning Commission and Washington Township, DeKalb County, Missouri.
Suit on account: A change of venue was granted in Midwestern health Management vs. Virgil Caldwell.
Other contract: A change of venue was granted in Capitol One Bank vs. Jason C. Riddle.
