County Commission

James Lewis, road and bridge supervisor, and the crew continue construction on 292nd Street. MoDOT and the road and bridge crew are working on the intersection of Major Avenue and Highway 6. Commissioners requested review of the bridge on Pepper Avenue by the City of Gallatin utility plants.

The Daviess County Soil and Water Conservation District agreement was received for the promotion of the conservation of soil and water within the county.

There was a motion to send the CART agreement for 2016 to the Daviess County Special Road District #1.

David Roll, Local Emergency Planning Committee, is applying for a Flow Study Grant from Missouri Emergency Response Commission (MERC).

Commissioners received a call from Jason Watkins, Midwest Data, from Rockport regarding telephone systems and internet services.

Commissioners reviewed the web application of Mobile311 for Daviess County.

David McWilliams submitted his 2016 hours for his annual training.

Tom Salisbury discussed mitigation and regulation issues regarding the Corps of Engineers and EPA for bridges, and maintenance on low water crossings.

Joe Reed, Harrison Township, updated commissioners on FEMA and township roads.

Doug Boe, River Bluff Engineering, met with the commissioners to discuss drawing design specs for the repairs to the nursing home roof.

Commissioners viewed Oval Ave in Union Township in the afternoon.

Advanced Drainage Systems, Inc. met with commissioners regarding piping issues in regards to roads.

The sheriff’s office discussed bids for repairs on a vehicle. Deputy Lonnie Windsor will ask Scotty’s Carriage Works in Cameron for the second bid for the requirements of the insurance.

These are the unapproved minutes of April 13, 2016. All commissioners were present. Minutes were approved, and bills authorized.

Circuit Court

The following cases were heard by Judge Thomas Chapman on April 13:

A warrant was issued for Cassandra D. Ellison on a probation violation for possession of controlled substance, class C felony. No bond.

Probation was continued for Nicholas Smith for possession of controlled substance, class C felony, and possession with intent to distribute, class B felony, with the additional condition of court-ordered detention in the Department of Corrections. He was remanded into the sheriff’s custody.

A jury trial which had been set for Terry M. Roberts was vacated and moved to Sept. 22-23, 2016. He is charged with two counts of assault first degree, burglary first degree and arson first degree, all felonies, and misdemeanors of driving while revoked and failure to register motor vehicle.

Jared T. Nachtigal plead guilty to elder abuse amended from class A felony to class B felony, and he was sentenced to eight years in the Department of Corrections.

John D. Haun plead guilty possession of controlled substance with intent to distribute, class B felony, possession of controlled substance, class C felony, and misdemeanors of unlawful use of weapon, violation of protection order, possession of marijuana and speeding. He was sentenced to 10 years in the Department of Corrections on the first count, five years on the second count, and 90 days on each of the misdemeanors, all sentences to run concurrently. Haun was ordered to complete a long-term treatment program under RSMo. 217.362.

Probation was revoked for Raymond Rounds and his previously imposed sentence of four years in the Department of Corrections was ordered executed. He was ordered to serve 120 days of shock incarceration, under RSMo. 559.115.5.3. He is charged with sex offender present within 500 feet of park/playground, class D felony.

Benjamin Danz had previously plead guilty on. Jan. 13. On a felony charge of possession of controlled substance, he received a suspended imposition of sentence, five years probation and 30 days shock incarceration. On two counts of possession of marijuana and two counts of drug paraphernalia, he received 30 days jail on each count. He was also fined $80 for speeding.

Nicolas A. Stevens had previously plead guilty and received a sentence of seven years in the Department of Corrections for felonious restraint. The execution of sentence was suspended, and he received five years probation and 30 days shock incarceration. For misdemeanor assault third degree, he received 15 days in the regional jail and a $250 fine.

A jury trial for Jeffrey Vogt was set for Aug. 15, 2016 on charges of DWI, persistent offender, class D felony.

Brian Butner plead guilty on Feb. 10 and was sentenced to seven years in the Department of Corrections for DWI, class C felony. He will complete the 120-day institutional treatment program, and the court retains jurisdiction. On a misdemeanor count of driving while revoked, he was sentenced to 10 days jail. He was also fined $100 for careless and imprudent involving an accident.

A two-day jury trial was set for Jeffrey Griffith on Sept. 26-27, 2016, for resisting arrest, possession of controlled substance, tampering with motor vehicle, and five counts of receiving stolen property.

Troy M. Violette plead guilty and was sentenced on the following charges: possession of controlled substance, five years Department of Corrections; possession of marijuana, 90 days jail; no valid license, $100 fine; drug paraphernalia, 15 days jail; speeding, 15 days jail. All sentences to be served concurrently with credit for time served.

Michael A. Wheeler plead guilty to misdemeanors of receiving stolen property, unlawful possession of weapon, possession of marijuana and paraphernalia. One felony count of possession of burglary tools was dismissed. He was sentenced to five months jail for the first three misdemeanors. On the paraphernalia charge, he received a suspended imposition of sentence and two years probation.

Civil cases filed: The Department of Revenue has filed certificates of lien, DOR taxes, against Mark A. Smith, Pattonsburg; Legacy LLC Morrell, Holladay, Utah; Phil Morrell, Gallatin; Morrell Legacy Hospitality, Gallatin; and Daniel B. Johnson and Lindy J. Stanhope-Johnson, both of Gallatin.

Associate Division

Municipal Court

Defendants found guilty in the Municipal Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the City of Gallatin amount to $32.50 for moving traffic violations and $29.50 for non-moving violations. Judge Daren Adkins presided over the following cases on April 11, 2016:

Bradley Allen Rhoades received a suspended imposition of sentence and two years probation for operating vehicle in careless and reckless manner and resisting arrest.

Operate vehicle in careless and reckless manner: Dalton Lane Swalley, suspended imposition of sentence, two years probation; Shawn Michael Yuille, $100.

Other Ordinances:

Disorderly conduct: Shawna M. Tyrrell, $150.

Domestic assault: Donald R. King, suspended imposition of sentence, two years probation.

Peace disturbance: Wayne W. Tucker, $50; Megan N. McClane, $50.

Assault: Ryan F. Parker, two days jail and board bill $75.

Roger Dale Hobson, 43, and Diane Nicole Lofgren, 31, both of Pattonsburg were married April 15 by Judge Daren L. Adkins.
