Benton Duane Simpson, 29, of St. Joseph, was arrested Aug. 28 during a traffic stop for speeding, made by Cpl. J. Cross, at the 81-mile marker on I-35 in Daviess County.

During the stop, Simpson refused to comply with the officer’s commands. When he refused to turn around to be placed in handcuffs, the officer attempted to use Oleoresin Capsicum spray on Simpson, but Simpson turned his head and the spray was deflected back into the officer’s right eye. Simpson then ran back towards his car. After Cpl. Cross held him at gunpoint for approximately 30 seconds, Simpson began to get onto the ground. Simpson told the trooper he would rather be shot than go to jail. Trooper Sullivan arrived shortly thereafter, and Simpson was secured in handcuffs. A chemical test of Simpson’s breath indicated blood alcohol content of .161%. A computer check revealed two prior convictions for driving while intoxicated.

He has been charged with felony DWI, persistent offender, speeding 92 mph in a 70 mph zone, and 2 other traffic citations. Bond is set at $50,000 cash.
