County Commission

The road and bridge crew will be placing corrugated metal pipe in several areas in the county.

The Federal Emergency Management Agency sent release HQ-15-057 which states the President has declared a disaster for Missouri which includes Daviess County.

Frank Blakemore, Garver Engineering, discussed engineering for bridges and other types of projects that the company does.

Judy Elbert discussed Christmas on the Square with commissioners, regarding Santa pictures in the courthouse on Saturday Nov. 21. Request granted. Commissioners will confer and decide later about use of the second floor for overflow if weather is cold.

Bills were reviewed and approved.

Jim Baker discussed brush removal in Sheridan Township.

Commissioners viewed a webinar presented by Maria Garcia, ReGroup, on geomapping for emergency services in the county.

Carl Carder moved to appoint Mary Jarboe as Trustee on the Daviess County Library Board; seconded by David Cox. Motion passed. Roger Eichler’s term ended on July 1, 2015.

There was discussion on village and city dis-incorporations within the county and procedures for the process.

Commissioners attended a presentation with Daughters of the American Revolution and the Postmaster of Gallatin for commemoration of the 50th anniversary of the start of the Vietnam War.

Carl Carder left the meeting at 10:21 a.m.

Commissioners viewed a webinar with FacilityDude for work orders, tracking of brush and details of bridges.

Tina Brown, Executive 1 SEMA, discussed via telephone a LEPC grant in the amount of $8,302.23 and said that she needed confirmation from the county to receive the monies. Commissioners will send an email to her.

Reta Rains, treasurer/collector, and Betty Harmison, assessor, discussed the decision of the State Tax Commission regarding the dismissal of appeals for 2014 for Summit Natural Gas. The assessor is still waiting on values for 2015 amounts and the decision on 2011, 2012 and 2013.

Commissioners attended the LEPC meeting at Subway, then saw Sam Graves at A.V. Spillman Center in Jamesport, and Jennifer Osby at the Daviess County Care Center to discuss roof issues.

Commissioners visited Sheridan Township to inspect CMP on Unity Avenue.

Circuit Court

An August 18 jury trial which had been scheduled for Andrew Kory of Belgrade, Mt., was canceled. The original single charge of rape first degree was dismissed. That charge was refiled on Aug. 11 with additional charges of statutory rape first degree and endangering welfare of a child. The charges stem from an incident in Jamesport which occurred in October 2013 with a juvenile. Judge Daren Adkins has recused himself from the case, which has been assigned to Judge Jason Kanoy. The setting of the preliminary hearing will be on Aug. 25.

The following cases were heard by Judge Thomas Chapman on Aug. 12:

Probation was revoked for Michael Faught on an original charge of no valid license, class D felony, and his 4-year sentence in the Department of Corrections was ordered executed.

Probation was revoked for Jeramy Sanders on a misdemeanor charge of resisting arrest. His one-year jail sentence was ordered executed.

William Johnson had plead guilty July 22 to three charges. For possession of controlled substance, class C felony, he was sentenced to 3 years in the Department of Corrections. On each of two misdemeanor charges of drug paraphernalia and no valid license, he was sentenced to 60 days jail with credit for time served.

Devin First plead guilty to two charges of tampering with a witness, one felony and one misdemeanor. He was sentenced to two years in the Department of Corrections on the felony charge and six months jail on the misdemeanor, sentences to run concurrently. In a separate case, First plead guilty to misdemeanors of property damage and tampering with a witness and was sentenced to 60 days jail on the first charge and 6 months jail on the second charge. These sentences run concurrently to each other and concurrent to the other sentences.

Tina Powell had plead guilty April 15 to possession of controlled substance, class C felony, and received a sentenced of five years in the Department of Corrections, execution of sentence suspended, and five years probation. On a misdemeanor charge of DWI, drug intoxication, she was sentenced to 90 days jail with credit for time served.

Joshua S. Stewart had plead guilty May 20 to possession with intent to distribute, class B felony. He was sentenced to 7 years in the Department of Corrections. The court ordered institutional treatment and retains jurisdiction for 120-day callback.

Anthony Duran plead guilty May 13 to two felony counts of possession of controlled substance and misdemeanor charges of possession of marijuana and paraphernalia. On the felonies, he received a suspended imposition of sentence and five years probation. On each of the misdemeanors, he was sentenced to 60 days jail with credit for time served.

Michael D. Henry plead guilty to two counts of possession of controlled substance, class C felony and one misdemeanor charge of no valid license. A sentence assessment report was ordered.

Before Judge Chapman on Aug. 11 in Livingston County, a jury trial was set for Ashley M. Huff on charges of domestic assault third degree, assault law enforcement, felony property damage first degree, and resisting arrest. The jury trial was set for Sept. 24, 2015, in Livingston County. The case is a change of venue from Daviess County.

Civil cases filed: Certificate of lien, DOR, taxes, were filed by the Department of Revenue-Collection Enforcement against Williamson Dickie Manufacturing Company of Fort Worth, Texas, Jeremiah C. Johnson of Gallatin, and David Winfree and Ephrem Esquivel of Gallatin.

Civil Court

Breach of contract: A consent judgment was entered for CACH, LLC and against Marilyn S. Demke. American Express Bank FSB vs. Vera S. Dowell-Nelson was dismissed by the court without prejudice.

Suits on account: Default judgments were entered for Midland Funding LLC and against Michelle Smith; for Midwestern Health Management and against Steven B. Brown et al, and for Midwestern Health management Inc. and against Jacob N. Cook. Midwestern Health Management vs. Dennis P. Schlaiss et al was dismissed by the parties.
