Your Right to Know: The following is information released from the Daviess County Courthouse on Tuesday, July 7, 2015.
County Commission
James Lewis, road and bridge supervisor, discussed storm damage from the SEMA/FEMA meeting held with the townships boards on June 30. Crews will be replacing at least 22 corrugated metal pipes around the county from storm damages. Discussion on priorities for the county road and bridge repairs was held as the county is 45 days behind on maintenance issues due to all the storm damage around the county.
Due to Statute 28.110 not being completed, the reading of the petitions for the vacation of roads in Sheridan (Ridge) and Liberty (210th, Slade, 208th and Sunset) will be on July 29, 2015, with a second reading of these petitions. The county clerk’s office gave three copies of the two Petition of Vacation of a Public Road to the sheriff’s office on July 1, for posting in three public places within Sheridan and Liberty Township by July 8.
Mary Hacking requested posting a vinyl 3×8 sign for soccer registration on the courthouse square lawn. She also made a request for a zip line for a “dummy” person coming off of the courthouse building for 2015 Chautauqua festival.
Dave Allen has completed the mowing and brush cutting on Beacon and 200th Street in Salem Township. He is now scheduled to be in Sheridan.
Commissioners authorized the 2016-DSSSF-027 for Sheriff’s Department for $16,789.47 for the period of 7/1/15 to 6/30/16.
Denise Caven, LEPC, discussed grant applications from 2013, 2014 and 2015 with commissioners.
Bills were reviewed and approved.
Commissioners reviewed brush, storm damage and log roads in Benton Township. They reviewed storm damage and brush in Union, Marion and Liberty Townships.
Carl Carder moved to deposit $150,364.68 from the final distribution of the Young Trust Estate into the care center fund. David Cox seconded. Motion carried.
These are the unapproved minutes of July 1, 2015. David Cox, First District Commissioner called the meeting to order. Carl Carder, Second District Commissioner, was present. Randy Sims, Presiding Commissioner, was absent.
Several expired notary public commissions were shredded, following record retention guidelines.
Circuit Court
The following cases were heard by Judge Thomas Chapman on July 1:
The suspended execution of sentence for Kelly J. Beeler was revoked, and the previously imposed sentences of seven years on two felony charges were ordered executed, sentences to run concurrently, and consecutively to any other sentences being served. The charges are endangering welfare of child first degree, class C felony, and possession of controlled substance, class C felony.
A jury trial was set for Aug. 31, 2015, for Christopher L. Huffman on a felony charge of abuse or neglect of a child.
A dissolution of marriage was granted to Alex D. Shelton from Paula D. Shelton.
A dissolution of marriage was granted to Lindsay Allen from Cody Allen.
State vs. Jonas Schrock was transferred to Livingston County on a change of venue on June 30. Schrock is charged with possession of liquor by a minor, first offense, unclassified misdemeanor. This case was heard by Judge Jason Kanoy.
Civil cases filed: Calvin L. Jones and Eddie M. Long, both of Winston, vs. Doug Youtsey and Lisa Ford, both of Weatherby, petition for conversion of personal property.
Associate Circuit
Dylan Neudorff was charged June 26 with theft, class C felony. According to the probable cause report, Neudorff took an ATV belonging to Marjorie Kramer, Jamesport, in April and traded it for a pickup truck. Neudorff had convinced Kramer that he would repay her for the ATV, but as of June 25, had failed to repay her.
Kiersten Mendiola, Kansas City, was charged June 30 with damage to jail property and peace disturbance, both misdemeanors.
Civil Court
Suits on account: Default judgments were entered for LVNV Funding LLC and against Cheri L. Rice, for Midwestern Health Management and against Arlington E. Davis et al, for Midland Funding LLC and against April Wollam. The following cases were dismissed by the court without prejudice: Midwestern Health Management vs. Douglas R. Fletchall, Midwestern Health Management vs. Lincoln T. Cornett, Midwestern Health vs. Jeremy Holcomb.
