E-filing officially begins in Circuit Court

Your Right to Know: The following is information released from the Daviess County Courthouse on Tuesday, May 19, 2015.

County Commission

Bills were reviewed and approved.

BRO-B031 (34) Bridge No. 35900061 Invoice No. 8 was approved by Commission.

J.L. McFee, Sheridan Township, inquired regarding the opening of 175th Street. Commissioners discussed the items that would be addressed before opening the road.

Robert Dyson, chairman of Lock Springs Village, discussed issues with the Village of Lock Springs and Lock Springs Special Road District regarding maintenance of roads with the commissioners.

George Wingert, Sheridan Township, discussed the placement of a corrugated metal pipe in the west end section of 185th Street and Vista Avenue. Discussion was also held on 210th Street regarding easements and recording of property.

Commissioners attended LEPC at noon at Subway in Gallatin.

In the afternoon the commission inspected roads, bridges and brush in Washington, Grand River and Lock Springs Village in Jackson Township.

Circuit Court

Circuit Clerk Pam Howard reports that e-filing officially began in her office on May 18. Training for the implementation of e-filing began well over a year ago. Ms. Howard and her staff have received extensive training for the change during the past six months. The office became paperless on Jan. 1, when they began scanning documents into the online court system. The change also involved the acquisition of the equipment needed to implement of e-filing.

E-filing requires that all documents from attorneys be filed electronically, and it also enables attorneys to view all case documents online. The court will, however, still accept paper filings from individuals who are not represented by an attorney.

Ms. Howard said that e-filing helps alleviate storage issues and cuts costs for postage and other office operating expenses.

The following cases were heard by Judge Thomas Chapman on May 13:

A jury trial for Andrew Kory was rescheduled for June 24-25, on a charge of first degree rape.

James G. Crockett appeared on a probation violation for distribution of marijuana, class C felony. A warrant was issued, and he was taken into custody, with bond set at $10,000 cash only.

A jury trial was set for Allen Tolen on Nov. 18-19, on four counts of possession of controlled substance with intent to distribute, class B felony, one class C felony count of possession, and three counts of unlawful possession of firearm, class C felony.

Juan L De La Torre plead guilty to DWI, persistent offender, class D felony, and was sentenced to two years in the Department of Corrections. On two misdemeanor counts of endangering welfare of a child, he received 120 days jail with credit for time served. All sentences will run concurrently. He was also fined $300 for misdemeanor no valid license.

James D. Whitt plead guilty to two class C felonies, burglary second degree and stealing. A sentence assessment report was ordered.

Anthony Duran plead guilty to two class C felony counts of possession of controlled substance and two misdemeanor charges, possession of marijuana and paraphernalia. A sentence assessment report was ordered.

Meagann R. Abernathy had previously plead guilty Feb. 11 to one class C felony count of possession of controlled substance. She was sentenced to 5 years in the Department of Corrections. On each of two misdemeanors, possession of marijuana and paraphernalia, she was sentenced to six months jail, all sentences to run concurrently.

Tracy Lee Wooten plead guilty to driving while revoked, class D felony and misdemeanor speeding. A sentence assessment report was ordered.

Jeffrey Matthews appeared on a probation violation on two counts of passing bad checks. His probation was continued and extended one year, and he was sent to the Department of Corrections to complete a Court Ordered Detention Sentence (CODS) program.

Associate Division

Mervin Beechy, Jamesport, and Randall W. Todd, Trenton, were each charged with felony passing bad checks on May 15.
