County Commission
Road and Bridge Supervisor Jason Lewis and crew are cutting brush around bridges in the county.
A semi-final inspection of bridge #33000091 over Sampson Creek is scheduled for Jan. 28 at 10 a.m.
Charles Winger discussed road closure at Ridge Avenue and 240th Street in Sheridan Township.
Ryan Eddis of Simple Energy Solutions met with the commission regarding an energy audit.
Becky Simpson from the Daviess County Extension Office met with the commission regarding the 2015 budget, and area extension offices.
A hearing for the 2015 budget was held at 10 a.m.
Caldwell County Commissioner Bud Motsinger discussed county issues with the commission.
These are the unapproved minutes of Jan. 21, 2015. Randy Sims, Presiding Commissioner, called the meeting to order. David Cox, First District Commissioner, and Carl Carder, Second District Commissioner, were present.
Circuit Court
After a two-day jury trial on Jan. 20-21, Christa J. Tate was found not guilty of a felony charge of endangering welfare of a child, first degree. The charge had been filed in November 2013. Judge Thomas Chapman presided over the trial in the Daviess County Circuit Courtroom.
In a class action suit that originated in Ray County, a change of venue has been received from Carroll County, with Danny and Deborah Daniel of Pattonsburg listed as the plaintiffs. The original petition filed in Ray County listed 27 plaintiffs. The defendants are Mediacom LLC and State of Missouri ex rel Missouri Highways and Transportation.
The petition for damages and declaratory relief states that Mediacom, a cable TV company, trespassed on the plaintiffs’ property without permission in order to place cable on their properties. The petition asks for ejectment of Mediacom from the plaintiffs’ properties, and claims that Mediacom is unjustly profiting from the use of the properties, without making any payment to the plaintiffs. The petition further asks for punitive damages and a declaratory judgment against Mediacom.

Criminal cases bound over from Associate Division: State vs. Steven Periman, Jamesport, possession of controlled substance with intent to distribute, class B felony; State vs. Tina Powell, Gallatin, possession of controlled substance, class C felony, DWI drug intoxication, class B misdemeanor, failure to display lighted lamps, misdemeanor; State vs. Carl A. Asher, Winston, possession of controlled substance, class C felony; State vs. Christopher E. Moss, Breckenridge, no valid license third and subsequent offense, class D felony, DWI alcohol, prior offender, class A misdemeanor.

Randall Todd, Trenton, was charged Jan. 26 with three felony counts of passing bad checks.
Civil Court
Property Damage: Pamela Bailey vs. Ashley Simpson was dismissed by the parties.
Breach of Contract: A consent judgment was entered for the New Liberty Hospital District and against Michael T. Ward. A default judgment was entered for Harrison County Community Hospital and against Terry Puls et al. A change of venue was granted in Ford Motor Credit Company vs. William R. Barnett.
Promissory Note: Ally Financial Inc. vs. Lance A. Derstler was dismissed by the parties.
Suits on account: Default judgments were entered for Midland Funding LLC and against Scot Wilkerson, and for the New Liberty Hospital District and against Teresa J. Clevenger. Midwestern Health Management vs. Charles D. Uthe was dismissed by the parties.
