A Gallatin man plead guilty Friday to assault first degree, amended from statutory rape, and one count of incest in a 2013 case involving his then 4-month-old child. Sentencing is set for Feb. 11 before Judge Thomas Chapman.

Bryan Scott Carter was arrested March 30, 2013, due to an investigation conducted by the Daviess County Sheriff’s Office for various charges including rape and incest of a four-month-old child, which occurred on or about March 30 in Gallatin.

Carter admitted Friday, Jan. 9, to causing serious physical injury to the child. Carter is the baby’s father and was the primary caretaker at the time. The infant sustained serious physical injury as a result of the penetration, which resulted in emergency surgery at Children’s Mercy Hospital.

Carter has been in custody at the Daviess-DeKalb County Regional Jail since his arrest, with bond set at $500,000. He was originally charged with statutory rape first degree, statutory sodomy first degree, two class C felony counts of endangering the welfare of a child, and two class D felony counts of incest. One count of sodomy, one count of incest, and two counts of child endangerment have been dismissed.

A jury trial before Judge Thomas Chapman had been scheduled for Carter in Daviess County Circuit Court later this month.

In the April 10, 2013, issue of the Gallatin North Missourian, it was reported that the 4-month-old victim was under ongoing medical treatment and doing well, according to the baby’s family.
