Circuit Court

The following cases were heard by Judge Thomas Chapman on Dec. 10:

Probation was revoked for Rolla Sweiger on three felony charges, burglary second degree, tampering with motor vehicle, and property damage. He was sentenced to four years in the Department of Corrections on each count, to run consecutively. In a separate case for felony forgery, probation was revoked and he was ordered to serve five years in the Department of Corrections, consecutive to all other sentences. Sweiger also plead guilty to DWI, class D felony, and was sentenced to four years in the Department of Corrections. For misdemeanor drug paraphernalia, he received 60 days jail with credit for time served. For misdemeanor driving while revoked, he received 60 days jail, credit for time served, and $150 fine. For misdemeanor attempted escape from custody, amended from a felony, he received 60 days jail with credit for time served. Two charges were dismissed. In each case, the court retains jurisdiction for 120-day callback and completion of institutional treatment program.

Probation was revoked for David Duane Karstens. His previously imposed sentence of nine years in the Department of Corrections was executed on a charge of DWI, chronic offender, class B felony. For felony no valid license, his previously imposed sentence of four years was executed, sentences to run concurrently.

A suspended imposition of sentence was revoked for Justin W. Leardi on a class C felony charge of possession of controlled substance. He was sentenced to five years in the Department of Corrections.

Freddie D. Pendergraft plead guilty to DWI, class D felony, and was sentenced to three years in the Department of Corrections. He was fined $300 for misdemeanor no valid license.

Rachael R. Dolan had previously plead guilty to possession of controlled substance, amended from possession of controlled substance at jail, and was sentenced to seven years in the Department of Corrections. For a misdemeanor amended of drug paraphernalia, she was sentenced to 170 days jail with credit for time served. The court retains jurisdiction for 120-day callback and orders institutional treatment.

Probation was extended for Kyle R. Konrardy on two class D felony counts of damage to jail property, with the special condition of completing 120-day CODS program.

Cassandra D. Ellison failed to appear for a probation revocation hearing on a class C felony charge of possession of controlled substance. A warrant was issued with bond set at $10,000 cash.

A jury trial was set for Scot Wilkerson on Feb. 23-24, 2015, on charges of domestic assault and armed criminal action.

At a sentencing hearing for Bryan McArthur on three felony counts of forgery, a motion was made for a new trial. The sentencing hearing was continued to Jan. 14.

Daniel H. Diaz had previously plead guilty to possession of controlled substance. He received a suspended imposition of sentence and five years probation. For misdemeanor drug paraphernalia, he received 40 days jail with credit for time served.

Austin Frion plead guilty to DWI, class D felony, and a sentence assessment report was ordered.

Mark E. Lundy Jr. failed to appear for a probation violation hearing on four felony counts of passing bad checks. A warrant was issued for his arrest, with no bond.
