Sheriff’s Office
Bill Williams of Lock Springs reported property damage and thefts from his residence on March 6-7. A bus and trailer home in the yard had both been broken into, with the doors showing significant damage. The estimated loss is around $2,500. Items taken include a generator and miscellaneous tools.
Judy Hiley reported a burglary at the Civil Bend Community Room near State Highway DD and I-35, on March 19. The outside air conditioning unit, valued at $2,000, was taken. Inside, the stove had been moved, but nothing appeared to be missing. No one had been at the building since last October or November.
Larry Fenton of Pattonsburg reported March 13 that someone had broken into an old semi-trailer which he was using as a storage shed on Highway VV. The three padlocks on the trailer had been cut, but nothing was found to be missing.
Melissa Bye, 30, Trenton, was arrested March 19 on three felony counts of forgery. She is being held on $15,000 bond.
Mark Bottcher, 31, Cainsville, was arrested March 17 for misdemeanor DWI. He was held 12 hours for detoxification and a summons was issued.
Michael Ward, 19, Gallatin, was arrested March 17 for misdemeanor DWI, held for 12 hours and a summons was issued.
Dennis Swearingin, 31, Coffey, was arrested March 14 for probation violations on an original charge of no valid license. He is being held on $5,000 bond.
John Wheeler, 67, Riverside, Calif., was arrested March 19 for felony stealing. Bond was denied.
County Commission
James Lewis, bridge supervisor, reported that they have completed a bridge on Forest Avenue, east of State Hwy. K. It is now opened to 3-ton traffic.
Notice was received from the State of the approval to proceed with the BRO 32 project. Snyder and Associates have advertised for contractors and the bid date has been set for April 9.
The commission discussed the bids for lawn mowing. David Cox moved to accept the bid from Mike Walker. Carl Carder seconded. Cox – yes; Carder – yes; Sims – yes.
Ben Becerra, sheriff, met with the commission regarding the first floor room renovations and the vehicle grants.
Landowners from Colfax Township met with the commission concerning brush on Titan Avenue. The commission will inspect.
Bills were audited and paid.
Fourteen certified brush letters were sent to landowners in Jefferson Township.
Dave Allen, bridge department, met with the commission to determine his next assignment. He has completed Salem and Washington Townships and will move to Marion and Benton Townships.
Notification was received from Dale Schmutzler, SEMA, that a survey team will be on the Grand River next month determining needs for flood control.
At 11 a.m., the commission met with the LEPC board.
In the afternoon, the commission inspected roads, bridges and brush in Colfax, Sheridan, Harrison and Jackson Townships.

Circuit Court
Before Judge Thomas Chapman on March 14, the following cases were heard:
Dennis A. Swearingin was taken into custody for a probation violation on a charge of no valid license. Bond was set at $5,000 cash only.
The suspended imposition of sentence for Brian Habelitz was revoked, and he was sentenced to four years in the Department of Corrections, execution of sentence suspended, for felony charges of burglary and resisting arrest and misdemeanor charges of property damage and theft. He was placed on probation through August 2014 and ordered to serve 30 days shock time in the regional jail.
Scotty G. Malott was sentenced to four years in the Department of Corrections for two felony counts of passing bad checks, execution of sentence suspended. He received five years probation. On two misdemeanor counts of passing bad checks, he received a suspended imposition of sentence and five years probation. Four misdemeanor counts of passing bad checks were dismissed.
Mary J. Hampton had previously plead guilty to four felony counts of passing bad checks. She was sentenced to five years in the Department of Corrections on each count, sentences to run concurrently.
A jury trial for Wayne D. Poage was set for July 31 for felony non-support.
Wanda Petrie plead guilty to two counts passing bad checks and was sentenced to five years on in the Department of Corrections on each count concurrent, execution of sentence suspended. She received five years probation. One charge was dismissed.
Probation was revoked for Darrell J. Palmer, and a sentence of three years in the Department of Corrections was imposed for the class D felony of attempt to steal motor vehicle.
Jean A. Rogers plead guilty to the class C felony of forgery and was sentenced to five years in the Department of Corrections, execution of sentence suspended, five years probation.
The jury trial for David Duane Karstens set for March 26 was vacated, and the case was continued for a plea hearing.
Probation was revoked for James E. Robertson for driving while revoked, class D felony, and his three-year sentence was executed. On a second count of driving while revoked, he was sentenced to two years, sentences to run consecutively. On each of two counts of endangering welfare of a child, he was sentenced to two days in the regional jail.
A jury trial was set for Joseph L. Loucks on July 31 for failure to register as sex offender, class D felony.
State vs. Tyler Franklin Pickren was continued on a charge of possession of controlled substance, with bond reset to $30,000 cash, 10% deposit.
Jennifer R. Goston plead guilty to forgery, class C felony, and identity theft, class B misdemeanor. A sentence assessment report was ordered.
A change of venue to Livingston County was granted to Lonnie L. Breer on two felony charges, involuntary manslaughter and DWI. It is set for April 10 in Livingston County for plea or trial setting.
A warrant was issued for Bryan C. Thomas for failure to appear on a probation violation for no valid license. Bond was denied.
Ernest Rash was found guilty in a January jury trial of DWI and failure to drive on right half of roadway. He was sentenced to seven years in the Department of Corrections on the first count. The court retains jurisdiction under the 120-day callback provision. Appeal bond was set at $35,000. On the second count, he was fined $100.
Zachariah E. Oneal plead guilty to two amended felony charges of possession of controlled substance. He was sentenced to seven years in the Department of Corrections on each count, sentences to run concurrently. However, these two sentences are to run consecutively to any other sentences being served. On a misdemeanor charge of drug paraphernalia, he was sentenced to 48 hours jail with credit for time served.
Before Judge Jason Kanoy on March 13, probation was revoked for Rudy Gingerich for non-support. He was sentenced to four years in the Department of Corrections, execution of sentence suspended, and placed on a new 5-year term of probation. He was also ordered to serve 14 days shock time in the regional jail.
Before Judge Thomas Chapman on March 7, the following cases were dismissed: Debra K. Loxterman vs. Steven K. Collins; Larry D. Daniel vs. Director of Revenue; Ernest W. Rash vs. Missouri Director of Revenue; and Hanes et al vs. Premium Standard Farms.
In James B. Jordan vs. Director of Revenue, a trial was set for May 24, 2012.
In Bobby Gene Ball vs. Terry Ball etal, an interlocutory order of default was entered against Allen Ball, Vicki Granito, William Ball, Connie Flaherty, and Lisa Griffith. Three defendants remain in the case.
