Officer David Francken, 41, was suspended Nov. 17 from his duties on the Gallatin Police Department after a summons was issued by Daviess County Circuit Court resulting from a complaint against Officer Francken of sexual misconduct.

According to Gallatin Police Chief Mark Richards, in May of 2011 Officer Francken was removed from active duty after a complaint was made accusing him of sexual misconduct. After several weeks, Francken was placed back on active duty.

However, upon completion of a probable cause statement by the Daviess County Sheriff’s Office, the Daviess County prosecutor requested a special prosecutor be appointed to review the case. Special Prosecutor Jonathan Myer was appointed by the Circuit Court of Daviess County, and Meyers requested that Sergeant Roger Phillips of the Missouri State Highway Patrol conduct an additional investigation.

Sergeant Phillips forwarded his finding on the issue to Meyer. On Nov. 17, Meyer sent information to the Circuit Court of Daviess County outlining the allegations and a summons was issued by the court to have Officer Francken to appear on Dec. 19 for an arraignment.

Officer Francken is a part time officer with the City of Gallatin. He has been with the department about five years. He has been taken off of active duty until this matter is resolved.

"The Gallatin Police Department takes these types of allegations very seriously and will cooperate fully with Sergeant Phillips and Mr. Meyer in this matter," said Chief Richards.

The sheriff’s office states that no other agencies were involved in the investigation.
