County Commission

Donnie Heldenbrand, Colfax Township landowner, met with the commission regarding a bridge on Zane Avenue, #2200012. According to Daviess County records it is a Caldwell County bridge. The commission will contact the Caldwell County Commission.

Shad Mort, Lake Viking Association, met with the commission regarding the emergency plan for the lake. His plan is to have it completed by the end of the year.

Dave Allen, road department, met with the commission regarding his progress in removal of brush at culverts and bridges. He is currently working in Jamesport Township. He has finished cutting for an individual on Grate Avenue and that individual has made payment to the county.

Following further discussion of the Jefferson Township bridge, Randy Sims moved to accept the proposal from Decker Construction Services, the only contractor in the area, as recommended by Snyder and Associates. No publication was made as it is imperative to get the bridge built as soon as possible while weather permits, and there are no local contractors capable of driving piling over 30 feet. David Cox seconded. Cox – yes; Carder – yes; Sims – yes.

Carl Carder reported having inspected the reconstruction and removal of brush on 232nd Street in Harrison Township. The progress is good and it should be completed Sept. 2-3, weather permitting.

Mitch Riley and Eric Critten met with the commission regarding sewer problems outside the public restrooms on the east side of the courthouse. Also, they inspected the request for a hot water heater on the third floor and will submit an estimate.

The commission discussed CART road 504 in Liberty Township. The road will be brought up to CART road standards, brush removed and base rock applied. Central Dispatch will be notified for a street name and sign.

Ben Becerra, sheriff, filed his certificate of training for 2011.

James Lewis, bridge supervisor, met with the commission discussing equipment and ongoing projects. They have removed the brush at the intersection of Vista and 235th Street reported last week. They discussed the bridge on 105th Street in Jefferson Township.

Bills were audited and paid.

In the afternoon the commission inspected roads, brush and bridges in Liberty and Colfax Townships.

Sheriff’s Office

Mathew Lee, 30, St. Joseph, was arrested Sept. 4 for possession of marijuana and paraphernalia. He posted $750 bond.

Guri Singh, 31, Bangalore, India, was arrested Sept. 2 for misdemeanor speeding. He posted $120 bond.

John Flickinger, 45, Miami, Okla., was arrested Sept. 5 for misdemeanor possession of marijuana and paraphernalia. He posted $750 bond.

Michael Fordyce, 50, Miami, Okla.,was arrested Sept. 5 for misdemeanor no valid license. He posted $500 bond.

Harvey Duke, 34, Kansas City, was arrested Sept. 6 for failure to appear on an original charge of taking wildlife illegally. Bond was set at $250.

Bryan E. Stark, 29, Maysville, was charged Sept. 3 with misdemeanor DWI. After 12-hour detoxification, he was released with a summons.

Circuit Court

Civil cases filed: Division of Employment Security vs. Laverne W. Hostetler.

Associate Division

Brent M. Harris, Kansas City, was charged Aug. 31 with one count of felony non-support.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases. Judge Daren Adkins presided over the following cases.

Phillip J. Williams, Lee’s Summit, assault on corrections officer, 10 days jail, $25.

Benjamin S. Lebert, Avondale, two counts of non-support, suspended imposition of sentence and two years probation on each count.

Richard H. Kerns, Stewartsville, assault, 10 days jail, $25.

Richard L. Asher, Winston, driving while intoxicated, $350.

The following are traffic cases which were heard in the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri were $2942.50 for 44 cases. Total fines assessed for defendants who reside in Missouri were $1,993.50 for 33 cases.
