The 1995 Ford and a Canadian Pacific Locomotive collided at about 6:30 p.m. on May 24 at Livingston County Road 228, two miles northeast of Chillicothe.

According to a report by the Missouri State Highway Patrol, the Ford passenger car, driven by Haley Graves, 10, of Chula, was westbound on the county road. The little girl stopped near the tracks, then accelerated to avoid the approaching train. The locomotive, engineered by Darrell Teel, 43, Pattonsburg, struck the vehicle on the left rear. Following impact, the car spun counter-clockwise and came to rest facing southwest in the roadway.

The Highway Patrol said Erin Graves was an adult in the vehicle at the time of the accident, but were not able to confirm how he was related to Haley. An arrest report was filed at 7:58 p.m. in Livingston County for Erin Graves, 31, Chula. He was charged with five counts of endangering the welfare of a child, Class A Misdemeanor. He was held in Livingston County LEC and placed on 24 hour hold.

The car was moderately damaged.

The accident was investigated by Trp. B.N. Raney, assisted by Sgt. D.P. Little.
