Circuit Court
In a jury trial held May 5-6, Michael T. Conrick was found guilty on two felony charges, robbery first degree and armed criminal action. The case was a change of venue from Clinton County which was heard by Judge Daren Adkins. Sentencing was set for June 20.
Judge Thomas Chapman presided over Law Day on May 3. The following cases were heard:
Julie A. Vyrostek received a suspended imposition of sentence and five years probation for stealing. Vyrostek was the agent for the Daviess County License Bureau when the Department of Revenue closed the office in August 2010, for breach of contract. The case was investigated by the Department of Revenue, and she was charged with stealing in September, 2010. Restitution of $32,890 is a condition of probation in the case, which was handled by special prosecutor Doug Roberts.Probation was revoked for Jeffrey S. Shanks on a charge of no valid license, and the previously imposed sentence of four years in the Department of Corrections was ordered executed.
Ashley Marie Kincaid plead guilty to two counts of stealing and was sentenced to seven years on each count, to run concurrently. Four charges were dismissed.
Charlie H. Plunkett III plead guilty to receiving stolen property, and a sentence assessment report was ordered.
James M. Barrett plead guilty to receiving stolen property. He was sentenced to seven years in the Department of Corrections, execution of sentence suspended, and five years probation.
Courtney Anne Jones plead guilty to possession of controlled substance. A sentence assessment report was ordered.
Kimberly Claudette Schluze plead guilty Mary 8 to hindering prosecution of a felony. She was sentenced to four years in the Department of Corrections, execution of sentence suspended, and received five years probation. She will serve 15 days shock time.
Derek J. Bertoncino plead guilty to stealing and was sentenced to two years in the Department of Corrections.
Angel A. Ayala had plead guilty April 5 to no valid license. He was sentenced to two years in the Department of Corrections.
A jury trial for Eddy W. Meador was reset to Aug. 24-25 on three counts of statutory sodomy.
Criminal cases bound over from the Associate Division to the Circuit Court: State vs. Davin R. Lucassen, property damage first degree, class D felony.
Associate Division Breach of contract: Consent judgments were entered for Capital One and against Vicky L. Ray, and for Southwest National Bank and against Kurt M. Waterbury.
Suit on account: A default judgment was entered for Midwestern Health Management and against Mary M. Morrow.
Unlawful detainer: Federal National Mortgage Association vs. John A. Swoboda was dismissed by the court without prejudice.
County Commission
Brenda Rauber, Sheridan Township, met with the commission regarding a road in that township. The county will install a six-foot metal pipe on the road this summer.
Joseph Billings, Wideband, met with the commission regarding economic development.
Bob Burnett, Snyder & Associates, met with the commission with progress reports for the BRO 31 project in Grand River Township. He will submit the reports to MODOT for payment.
A request was received for permission to hold a farmers market in the street on the north side of the courthouse this summer. Permission granted.
The commission reviewed the monthly Treasurer’s report.
James Lewis, road and bridge supervisor, reported that they will be making routine repairs this week.
Bills were audited and paid.
In the afternoon, the commission inspected roads and bridges in Grand River Township. The bridge crew will make repairs this afternoon.

Sheriff’s Office
Janice Wynne, 51, Trenton, was arrested May 10 for felony possession of controlled substance at correctional facility. Bond was set at $35,000.
Richard Brown, 35, Arcola, Ill., was arrested May 8 for a probation violation on an original charge of theft, class C felony. He is being held on $2,000 bond.
Donald L. Rice, 26, Jameson, was arrested May 8 for misdemeanor no valid license, possession of marijuana and paraphernalia. He posted $1,300 bond.
Wayne Poague, 49, Albany, was arrested May 5 for felony non-support, class D felony. He is being held on $5,000 bond.
Aleisha Ward, 18, Chillicothe, was arrested May 6 on two misdemeanor counts of passing bad checks. She is being held on $550 bond.
