Two Winston men were arrested April 2 when grass fires which they were setting in their fields spread to property on 120th Street belonging to D.J. Bonderer.

The fire burned 22 round bales of hay, then spread west to 110th Street where it burned 225 bales of hay. The hay is valued at $25 per bale, bringing the total loss to $6,175, according to the probable cause statement.

David M. Ayers, 55, continued to start fires on his farm ground even as the KAW Fire District was attempting to control the fire. Both David and his brother Daniel Ayers, 51, became belligerent with law enforcement and demanded they get off of the property. David threatened the deputy with a hose and nozzle which was believed to contain gasoline.

During the confrontation, Deputy Todd Watson deployed his taser on both brothers. When he tasered Daniel Ayres, Daniel ran to a Bobcat Skid Steer and started driving it towards the deputy and KAW Fire Chief Chris Brownlee. Deputy Watson drew his duty weapon and ordered Daniel Ayres to stop several times. When 5-10 feet from the men, Daniel turned the Bobcat towards the patrol car and stopped inches short of the car. With reinforcement from the Highway Patrol, Daniel Ayres was cuffed after a short struggle.

When Deputy Watson tasered Daniel Ayres, David Ayres activated the nozzle, spraying the deputy in the face with a liquid, believed to be water. The deputy tasered David Ayres and secured him in handcuffs.

Both Daniel Ayres and David Ayres have been charged with felony assault on law enforcement officer, felony resisting arrest, and misdemeanor negligent burning. They have each posted $35,000 bond.
