The expenses for a change of venue civil case in DeKalb County will be paid by Daviess County, where the case originated, until the final outcome of the case. As a change of venue civil case, the originating county is responsible for the court costs.
The Daviess County Commission recently received a response from Jon Beetem, the circuit judge assigned to the case, about the court costs for the case. The suit for damages was filed by Vernon Hanes against Smithfield Foods, Premium Standard Farms, Contigroup Companies, PSF Group Holdings and KC2 Real Estate LLC in April 2008. A change of venue to DeKalb County was granted on July 29, 2008.
Judge Beetem said that the loser in the case will be assessed all court costs. However, pending the final outcome of the case, Daviess County has already paid the jury expense for one trial date last fall and will be accountable for an upcoming trial, set for the entire month of June, as well. DeKalb County expects to call 300 jurors for the upcoming case.
According to DeKalb County Circuit Clerk Julie Whitsell, 100 jurors were called for the case last fall, but the trial was not completed, as 12 jurors could not be selected.
