County Commission
James Lewis, road and bridge supervisor, reported that they will be reinforcing culverts with rip rap this week if conditions are favorable.
Bills were audited and paid.
Representatives from Wieland Hauling, Inc. met with the commission regarding the replacement of the bridge in Jefferson Township, destroyed by a truck hauling gravel. They also discussed the problems in delivering rock to some areas in the county due to the inability to cross some bridges due to the low weight limits.
Annie Gibson, prosecuting attorney, met with the commission regarding the liability of Wieland Hauling, Inc. when crossing some bridges. She will draft a letter to the company relieving them of certain liabilities.
These are the unapproved minutes of Feb. 14, 2011. Presiding Commissioner Randy Sims and Second District Commissioner Danny Heldenbrand were in attendance. Minutes were approved.
Sheriff’s Office
Kimberly Schulze, 43, Jamesport, was arrested Feb. 11 for hindering prosecution of felony, class D felony. She is being held on $5,000 bond.
Randall Kelley, 50, Plattsburg, was arrested Feb. 11 on four charges from Clinton County, failure to register as sex offender, DWI, no valid license, and domestic assault third degree. Bond was denied.
Circuit Court
Law Day was conducted Feb. 8 by Judge Thomas Chapman. The following cases were heard:
Nicholas Dale McCleary plead guilty to escape from custody. The sentence assessment report was waived, and he was sentenced to three years in the Department of Corrections, consecutive to any sentences he is already serving.
Kayla L. Evans plead guilty to delivering a prohibited article to a county jail. Three charges were dismissed. The sentence assessment report was waived, and she was sentenced to five years in the Department of Corrections.
Mandi D. Michaels and Brandy R. Waterbury each plead guilty to unlawful use of weapon, misdemeanor stealing and unlawful possession of firearm. One charge was dismissed for each defendant. The sentence assessment reports were waived. They were each sentenced to two years on the first count, 30 days on the second count, and five years on the last count, all to be served concurrently.
Ruben F. Fierros admitted probation violations on a charge of possession of controlled substance. The suspended imposition of sentence was revoked, and he was sentenced to seven years in the Department of Corrections, execution of sentence suspended. He received five years probation, with conditions to include 48 hours shock incarceration. Defendant was also ordered to complete an alcohol treatment assessment.
Shad D. Campbell plead guilty to DWI, persistent offender, and misdemeanor endangering welfare of a child. One count was dismissed. Campbell was sentenced to four years on the first charge and 15 days on the second. The court retains jurisdiction for 120 days and recommends institutional treatment.
Penny Sue Whitt plead guilty to two misdemeanors, endangering welfare of child and assault on law enforcement. One charge was amended to misdemeanor. She was sentenced to 30 days in the county jail on each count, concurrent to each other, but consecutive to any other sentences being served.
Drew M. McCall plead guilty to an amended charge of misdemeanor receiving stolen property. The imposition of sentence was suspended, and he was placed on two years probation.
Kristopher Alan Powers plead guilty to tampering with motor vehicle first degree. A sentence assessment report was ordered. He was taken into custody due to a warrant for failure to appear which was issued Jan. 6.
James M. Barrett plead guilty to receiving stolen property, and a sentence assessment report was ordered.
Wanda Petrie plead guilty to felony passing bad checks, and a sentence assessment report was ordered.
Heidi L. Pettit and Mark A. Pettit each plead guilty to filing a false Missouri income tax return. Sentence assessment reports were ordered for each.
A bench trial for Margo W. Smith was set for March 18 on a charge of passing bad checks.
A jury trial for Ashley Marie Kincaid was set for March 9 on one felony charge of stealing livestock animal, three felony charges of stealing, and two misdemeanor charges of stealing.
A jury trial was set for Jonas P. Kurtz on April 28-29 for felony resisting arrest, felony no valid license third and subsequent offense, and misdemeanor speeding.
A jury trial was set for Roger Price on three counts of child molestation on June 14-16.
A warrant was issued for Sandra L. Kriegel for failure to appear on a theft charge.
Cases bound over from the Associate Division to the Circuit Court: State vs. Ronald Eugene Reeter, stealing motor vehicle, class C felony, change of venue from Livingston County; State vs. Ryan Edward Reeter, Chillicothe, stealing of any livestock animal, class C felony, change of venue from Livingston County; State vs. Sarah N. Moore, domestic assault second degree, class C felony, possession of marijuana, class A misdemeanor, unlawful use of drug paraphernalia, class A misdemeanor.
Civil cases filed: Deanna Sue Brown vs. David Harold Brown Jr., dissolution of marriage; Vaughan J. Oyler vs. Jacoy L. Oyler, dissolution of marriage.
Associate Division
Justin W. Vigar, Weatherby, was charged Feb. 10 with failure to register as sex offender.
Jeffrey W. Knorr, Independence, was charged Feb. 10 with no valid license, third and subsequent offense.
Traffic Fines
The following are traffic cases which were heard in the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri were $1,164.50 for 11 cases. Total fines assessed for defendants who reside in Missouri were $478.50 for six cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:
