Timothy John Baudour pled guilty to escape from custody, based on a plea agreement, on Dec. 7 before Judge Daniel Chadwick. He was one of three inmates who escaped from the Daviess-DeKalb Regional Jail on Oct. 24. The sentence assessment report was waived, and his penalty was assessed at confinement in the Department of Corrections for four years. They were each sentenced to four years on each count, sentences to run concurrently. These charges stem from an escape attempt at the regional jail on June 30.
McCleary was also one of the inmates who escaped from the regional jail on Oct. 24, triggering an intense manhunt. The fugitives were captured on Oct. 26 a few miles northwest of Pattonsburg. Travis Evans was also involved in the Oct. 24 escape, and is charged with three counts of aiding escape of prisoner confined for felony.

Circuit Court
Before Judge Daniel Chadwick on Dec. 7, the following cases were heard:
Joseph R. Vassallo pled guilty to failure to register as sex offender and tampering with electronic monitoring equipment, based on a plea agreement, in one case. In another case, he pled guilty to two counts of failure to register as a sex offender, based on a plea agreement. Vassallo waived the sentence assessment reports. He received a four-year sentence for each charge, sentences to run concurrently.
Probation was extended one year in a probation violation hearing for Shanda L. Anderson, on charges of endangering the welfare of a child, possession of marijuana, and possession of paraphernalia.
Probation was continued for Brian Keith Coombs Jr., on charges of trespassing and theft, with the additional condition of completing an in-patient treatment program.
Colynn Lent plead guilty on a plea agreement to endangering the welfare of a child and resisting arrest, both misdemeanors. The imposition of sentence was suspended on the first count, and he was placed on two years probation. On the second count, he received 48 hours shock incarceration with credit for time served.
David J. Rader pled guilty on a plea agreement to assault on law enforcement officer first degree, resisting a felony arrest, and possession of controlled substance. The sentence assessment report was waived. For resisting arrest, he was sentenced to two years in the Department of Corrections. On the assault charge, he was sentenced to 30 days in the regional jail, consecutive to the two-year sentence. For the possession charge, he received 10 days in the regional jail, consecutive to both other sentences.
Before Judge Chadwick on Dec. 9, in a breach of contract bench trial, the court ruled for Carolyn McInteer and against Shirley Fry on Count 1, in the amount of $23,981.86 plus court costs. On Count 2, the court found for the defendant.
Before Judge James Valbracht on Dec. 10, Shaun David Yoder was sentenced to seven years for deviate sexual assault, and the sentence was ordered executed. On a second count, sexual assault, Yoder received a suspended imposition of sentence and five years probation, sentences to run consecutively, with the court retaining jurisdiction.
Before Judge Jason Kanoy on Dec. 13, Dawn Rochelle Davis received a suspended imposition of sentence and five years probation for conspiracy to commit burglary.
A dissolution of marriage was granted to Julie A. Burnett from Michael J. Burnett, with her maiden name Youngs restored.
On Dec. 13, a warrant was issued for the arrest of Michael S. Billingsley, who failed to appear on a probation violation hearing for non-support. Judge Daren Adkins set bond at $12,000.
Civil cases filed: Jeremy K. Sutton vs. Catherine E. Sutton, dissolution of marriage. Certificates of lien, DOR, taxes, were filed Dec. 13 by the State of Missouri ex rel against Barney R. Esbeck and Grand River Hardwoods LLC.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Sheriff’s Office
Brandy Hart, 30, Hamilton, was arrested Dec. 11 on two DeKalb County warrants for misdemeanor passing bad checks. She posted $368 bond.
John Lamont, 62, Kansas City, was arrested Dec. 9 for failure to appear on a misdemeanor charge of no valid license. He is being held on $1,500 bond.
Carl Holcomb Jr., 30, Gallatin, was arrested Dec. 8 for misdemeanor passing bad checks. He posted $200 bond.
Jonathan Costa of Liberty reported that a sway hitch bar had been stolen from inside an RV parked at a Jameson residence on Ivory Avenue. A door on a shed had also been damaged. The value of the bar was approximately $500.
County Commission
The courthouse will be closed all day on Friday, Dec. 24.
James Lewis, Road & Bridge Supervisor, reported that they have completed the work in Jefferson Township.
Bills were audited and paid.
David McWilliams, coroner, met with the commission regarding budget matters and his budget for 2011.
