These cases was heard by Judge James Valbracht on Sept. 23:

A change of venue to Livingston County was granted to Shane Ott, Cameron, on three counts of armed criminal action, assault first degree, and discharging firearm from a vehicle, in connection with a shooting incident July 4 at Lake Viking. The next court date is set for Nov. 10.

Jeffrey Joe Crosthwait plead guilty to DWI, chronic offender, driving while suspended, possession of marijuana while operating motor vehicle, and possession of drug paraphernalia. A sentence assessment report was ordered.

These cases were heard by Judge Daniel Chadwick on Sept. 22:

Jason E. Ellis admitted probation violations on a charge of possession of controlled substance. Probation was revoked, and the previously imposed sentenced of seven years in the Department of Corrections was executed.

Probation was revoked for Jermane L. Kearney on a charge of possession of controlled substance. The court retains jurisdiction under Section 559.115 RSMo and recommends institutional treatment. The previously imposed sentence of five years incarceration in the Department of Corrections was executed.

Brian H. Steele plead guilty to driving while intoxicated and no valid license. A sentence assessment report was ordered.

A bench trial was set for Nov. 30 for Shanan I. Francios, who is charged with stealing.

A jury trial was set for Dec. 1-2 for Joseph R. Vassalo, who is charged with three counts of failure to register as sex offender.

A bench trial was set for Nov. 30 for David J. Girsch, who is charged with no valid license.

Patrick W. Cope received five years probation for possession of controlled substance and drug paraphernalia. The court ordered Phase II inpatient treatment under Section 217.785 RSMo.

Kevin D. Berry plead guilty on a plea agreement to misdemeanor passing bad checks, amended from a felony. One count was dismissed. He was fined $25 plus costs.

Eric Eiken received a suspended imposition of sentence and was placed on five years probation for tampering with motor vehicle first degree.

Travis W. Evans plead guilty to attempted escape from confinement and damage to jail property, based on a plea agreement. A sentence assessment report was ordered.

Nicholas Dale McCleary plead guilty to attempted escape from confinement and damage to jail property. A sentence assessment report was ordered.

Manuel Joseph Canchola plead guilty to DWI, aggravated offender, no valid license, failure to drive on right half, and failure to wear seat belt, based on a plea agreement. A sentence assessment report was ordered.

Phillip R. Wood plead guilty to driving while revoked, speeding, and failure to wear seat belt, based on a plea agreement. A sentence assessment report was ordered.

A dissolution of marriage was granted to Cassandra A. Leatherman from Bradley J. Leatherman. Her former name Parton was restored.

A dissolution of marriage was granted to Earl Y. McAfee from Samantha N. McAfee. Her maiden name Lutz was restored.

In Saint Luke’s Hospital of Kansas vs. Lonnie M. Norris, a judgment was entered for the plaintiff.

In MoDOT vs. Warren R. Hemry, et al, suit for eminent domain and condemnation, a trial was set for March 3-4, 2011.

On Sept. 21, Lillian Bauer vs. William Brent Foster was dismissed by the court with prejudice, at the plaintiff’s expense.

Civil cases filed: Scot A. Wilkerson vs. Karla M. Wilkerson, dissolution of marriage; Deleta J. Eaton-LeBeau vs. Richard M. Lebeau, dissolution of marriage; Karla M. Wilkerson vs. Scot A. Wilkerson, dissolution of marriage; Bank of America NA vs. Kenneth Burns, et al, quiet title.

Certificate of lien, DOR, taxes, have been filed by the State ex rel against each of the following: The WJF Trust, The JHB Trust, George R. Walker, The WJB Trust; Paul Kenneth Stanhope, and Arthur and Patricia L. Krour.

Traffic Fines

Fines paid by Missouri residents totaled $137 for four cases. Fines for defendants who reside outside the state of Missouri totaled $261.50 for six cases.

Speeding: Nathan D. Bull, Springfield, $88.50.

No seat belt: Steven L. Meek, Brimson, $10; Jeffery A. Collins, Cameron, $10.

Failed to stop at posted stop sign: Benjamin D. Lane, Gallatin, $28.50.

Civil Court

Breach of contract: Citibank vs. Vernon C. Parman was dismissed by the parties.

Suits on account: Default judgements were entered for Midwestern Health and against Matt and Dana Cameron, and for Midwestern Health and against Alva and Rita Cogdill.

County Commission

James Lewis, road and bridge supervisor, reported that they are finishing up work on a bridge in Harrison Township, checking on a bridge in Lincoln Township and on a tube in Salem Township.

Trudi Burton and Belinda McLey met with the commission requesting use of the property at 611 West Johnson for the Fine Arts Council.

Jerald Uthe met with the commission concerning taxes he had paid on two vehicles that he had purchased in July and October 2009 but didn’t own January 1, 2009. He is requesting a refund of these taxes. The commission agreed to reimburse the taxes paid on these two vehicles back to Mr. Uthe.

Lloyd Riley met with the commission requesting information for FEMA for Monroe Township.

Jim Holcomb met with the commission regarding flood damage to a county tube in Salem Township.

Zac Johnson met with the commission regarding repairs needed on West Grand at the west end of town, Old Highway 6. The commission will inspect the road.

The commission inspected culvert problems in Grand River and Jackson Townships in the afternoon.

Sheriff’s office

David Stark of the Daviess County Historical Society reported damage to the historic squirrel cage jail on Sept. 20. Six windows were cracked. It is unknown when the damage occurred.

Richard Furman, 29, Oklahoma City, Okla., was arrested Sept. 27 for misdemeanor possession of marijuana. He posted $500 bond.
