Circuit Court
Shane Ott, Cameron, appeared before Judge Daniel Chadwick on July 29. Ott is charged with three counts of armed criminal action, assault first degree, and discharging firearm from a vehicle, in a shooting incident July 4 at Lake Viking. The case was transferred to Presiding Judge Brent Elliott for reassignment. On July 30, Ott posted $100,000 bond, 10% cash surety, after the court ruled that he would be allowed to be released upon posting of bond and with special conditions applied. No court date has been set.
The following cases were heard by Judge James Valbracht on July 30:
A furlough was granted Jeffrey J. Crosthwait, due to the death of his son. Crosthwait was to appear for DWI, no valid license, possession of marijuana and paraphernalia; however, his son was recently murdered in a drive-by shooting in Kansas City.
Bobby R. Wheelbarger was found guilty of DWI, class D felony, and no valid license, class A misdemeanor. A bench trial was conducted on June 25, and the ruling was made on July 30 by Judge Valbracht. A sentence assessment report was ordered.
The following cases were heard by Judge Jason Kanoy on July 30:
Rudy A. Gingerich was continued on probation with an added special condition of 40 hours community service. Gingerich is charged with non-support.
A warrant was issued for the arrest of Jeffrey Merrill Wilcox, who failed to appear on a charge of non-support.
A jury trial was set for Nov. 19 for Ronald Wayne Miller, charged with child molestation second degree, class A misdemeanor.
Richie A. King received a suspended imposition of sentence and five years probation for felony tampering with a judicial proceeding. He is to serve 64 days shock incarceration with credit for time served, and perform 40 hours of community service.
In a change of venue from Livingston County, a jury trial was set for Nov. 5 for Michael Jerome Baker, who is charged with forcible rape. The motion for bond reduction was denied.
Cases bound over from the Associate Division to the Circuit Court: State vs. David J. Girsch, New Hampton, no valid license third and subsequent offense; State vs. Brian Keith Coombs Jr., felony burglary second degree and misdemeanor stealing.
State vs. Robert A. Iser, Kansas City, three counts of possession of controlled substance with intent to distribute; misdemeanor possession of marijuana; and two counts of misdemeanor unlawful use of drug paraphernalia.
Civil cases filed: Delmond A. Lowe vs. Bonnye L. Lowe, dissolution. State ex rel has filed certificates of lien, DOR, taxes, against Melissa D. Gough, Corey Teel, Mark A. Smith, James R. Bray, Richard E. McFadin PC, Tim Caldwell, and William J. Sites.
On July 29, Joseph Lagodny vs. Doris Ellen Smith was dismissed by the court with prejudice.

Traffic Fines
The following are traffic cases which were heard in the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,471.00 for 22 cases. Total fines assessed for defendants who reside in Missouri was $844.00 for 16 cases. Breach of contract: Ozark Financial vs. Elizabeth Meador was dismissed by the court without prejudice.
Suits on account: A consent judgement was entered for Midwestern Health and against Stephanie A. Lewis. Midwestern Health Management vs. Linda L. Turpin and Midland Funding LLC vs. Stephanie Duncan were dismissed by the parties.
Other contract: Action Management and Consulting vs. Jenny L. Stanhope was dismissed by the parties.
Refuse breathalyzer: Russell J. Landes vs. Director of Revenue was dismissed by the court without prejudice.
Unlawful detainer: Fannie Mae vs. Alexander Sperry and John Doe was dismissed by the parties.
Municipal Division

Aaron S. Mort, Gallatin, failed to obey police officer in funeral procession, bench trial with Judge Valbracht. Court finds defendant guilty beyond reasonable doubt. Defendant fined $60.
Larry W. Smith, Cameron, possession of controlled substance, 3 days jail.
Sheriff’s Office
In a traffic stop on I-35, Yvette Frederick, 40, Glenwood, was arrested Aug. 1 on two counts of felony possession of controlled substance, misdemeanor possession of marijuana and paraphernalia. Her passenger, Danny Garrett, 45, Memphis, Mo., was charged with possession of controlled substance with intent to distribute and drug paraphernalia. Each is being held on $35,000 bond.
Matthew H. Brown, Cameron, was arrested Aug. 3 on three felony counts of failure to register as sex offender. He is being held on $35,000 bond.
Dustin Loucks, 23, Breckenridge, was charged July 31 with a conservation warrant. He posted $100 bond.
James Jordan, 53, Cameron, was arrested Aug. 1 for misdemeanor DWI. He was processed and released after 12-hours detoxification. A summons was issued.
Efrain Guttierrez, 25, Shawnee Mission, Kan., was arrested July 27 for misdemeanor no valid license. He posted $600 bond.
Angela Ruch, 32, Jamesport, was arrested July 29 on a probation violation for endangering welfare of a child and possession of marijuana and paraphernalia. Bond was denied.
County Commission
James Lewis, road and bridge supervisor, reported that due to the recent rains, they are not able to begin the low water crossing in Harrison Township, but will continue with routine maintenance around the county.
Bills were audited and paid.
Don Price, Caldwell County, met with the commission regarding the culvert installed near his property. He agreed to pay $1,313 toward the project. Caldwell County paid $4,219.98 of the $10,066.00 project.
In the afternoon, the commissioners inspected roads, brush and culverts in Grand River, Washington, Lincoln, Salem and Marion Townships. Brush removal letters will be sent in Salem and Washington Townships.
The Commission was contacted by the Sullivan County Commission regarding Premium Standard Farms.
