Circuit Court

A bench trial was held July 14 before Judge Roger Prokes, in State of Missouri Attorney General, the Department of Natural Resources, and the Missouri Clean Water Commission vs. the Gallatin Livestock Auction and Danny Froman. The case was filed in July 2008. The case was taken under advisement.

Cases bound over from the Associate Division to Circuit Court: State vs. Eric Eiken, Gallatin, tampering with motor vehicle first degree, class C felony.

Civil cases filed: Charles L. Miller vs. State of Missouri, motion to set aside sentence.

Associate Division

The following are traffic cases which were heard in the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $2,228.50 for 39 cases. Total fines assessed for defendants who reside in Missouri was $419.50 for 10 cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Civil Court

Suit on account: Livingston Financial LLC vs. Eldon L. England, change of venue to Holt County.

County Commission

James Lewis, road and bridge supervisor, reported that they will complete the culverts in Benton Township this week.

Precision Roofing met with the commission for finalization of paperwork on the roof replacements in 2009. Brian Paulsen and Holly Boxley, Premium Standard Farms, met with the commission reporting on improvements made to area farms and township roads. They also included the amount of jobs and employees in the county, and the amount of corn and soybean meal purchased from the Coffey mill.

Matt Clark, Lincoln Township, requested release of the 2010 CART rock. Granted. A proceed order will be sent.

Annie Gibson met with the commission regarding rights-of way on State Route 6. She will send a letter to MODOT stating her opinion.

Cheryl Alexander, Daviess County Health Department, met with the commission regarding the closing of a street during a drive-in flu vaccination clinic. She was referred to the City of Gallatin for that approval.

At 2 p.m., the commission adjourned to meet again as Board of Equalization.

At 3:30 the commission resumed the regular meeting, meeting with Senator McCaskill’s representatives discussing that BRO funding has not been released by MODOT and other matters.

Sheriff’s Office

Andrew Belger, 24, Des Moines, Iowa, was arrested July 16 for speeding and failure to drive on right half of roadway. He posted $350 bond.

Sophia Contreras, 31, Kansas City, was charged July 16 with speeding. She posted $350 bond.

Mario Cardenaz-Veliz, 24, San Antonio, Texas, was arrested July 18 for speeding and no valid license, third offense, class D felony. Bond was denied.
