Before Judge Daniel Chadwick on July 8, the following cases were heard:

Donald Lee Corbin plead guilty to misdemeanor sexual misconduct first degree. The sentence assessment report was waived, and he was sentenced to one year in the regional jail, execution of sentence suspended. He was placed on probation for two years and is required to register as a sexual offender. He is also to serve 30 days shock incarceration, 10 days consecutive and 20 days on weekends.

A bench trial for Stuart Ware Ross was set for July 9 on four felony charges of possession of controlled substance and one of possession of drug paraphernalia.

A change of venue to Caldwell County was granted to Jason S. Hines on three counts of statutory rape, one count furnishing pornographic material to a minor, and one count child molestation second degree.

A jury trial for Margo W. Smith was set for Oct. 19 for felony passing bad checks.

Based on a plea agreement, Jordan M. Briley plead guilty to felony passing bad checks. The sentence assessment report was waived by the defendant. Imposition of sentence was suspended and he was placed on five years probation.

A jury trial for Jason A. Short was set for Sept. 28-29 on charges of child molestation first degree, statutory sodomy and sexual misconduct. Motion for bond reduction was denied.

A jury trial for Jana R. Bell was set for July 22-23 on charges of arson and burglary second degree. Motion for bond reduction was denied.

Joshua N. Brown plead guilty to resisting arrest and driving while revoked, based on a plea agreement. The sentence assessment report was waived. He was sentenced to three years on the first count, to run consecutive to sentencing in a Livingston County case, and 10 days on the second count with credit for time served.

A change of venue to Caldwell County was granted to Jeremy A. Knight on two counts of burglary, two counts of stealing, and two counts of property damage.

Motions for bond reduction was granted to Anthony P. Blurton and to Charlie H. Plunkett III.

Before Judge James Valbracht on June 14, Brett T. Marshall was sentenced to five years in the Department of Corrections for felony DWI, execution of sentence suspended. He was placed on five years probation and is to be connected to SCRAM for one year. Sixty days of shock jail time will begin July 6, and he will be granted work release Monday through Friday. For misdemeanor driving while revoked, he was sentenced to two days shock jail time with credit for time served. Sentences are to run consecutively.

Daviess County charges against Teresa S. Schlemminger were dismissed. She has been sentenced to seven years concurrent on two DeKalb County charges of attempted distribution of controlled substance, and to seven years for possession of controlled substance in Caldwell County. The DeKalb County and Caldwell County sentences will run consecutively.

Civil Court

Small Claims: A default judgment was entered for Denton Clark and against William Dale Snyder.

Marriage

Daniel Joe Greene and Ronda Delaine Craig, both of Altamont, were married June 10 by Judge Daren Adkins.

County Commission

James Lewis, road and bridge supervisor, reported that they are making repairs when possible this week. They also discussed the various sites that have been reported in the past week and how to make repairs.

Lawrence Curtis, Liberty Township landowner, met with the commission concerning a drainage problem reported last week. The township will make repairs when the weather permits.

Wesley Harms, Jefferson Township landowner, reported a dangerous situation along a roadway caused by Grindstone Creek eroding the creek bank. He suggested a warning sign for traffic. The commissioners will have James Lewis post the site.

The commission inspected the building on Johnson Street leased by Access II, finding that various repairs are needed. They will meet with the Access II board to discuss necessary actions.

Alan Bradford, Conservation Agent, met with the commission regarding illegal dumping sites. He will investigate the reported sites.

In the afternoon, the commission inspected road drainage problems and brush in Lincoln, Washington, Liberty and Harrison Townships.

David Cox moved to accept the proposal from Andy Schwartz for mortar work on the dome area. Danny Heldenbrand seconded. Cox – yes; Heldenbrand – yes; Critten – yes. An agreement was executed for that purpose.

Sheriff’s Office

Damian M. Kirk, Turney, was arrested June 8 in Clinton County on a Daviess County warrant for domestic assault second degree, class C felony.

Nickolas A. Peters, 21, Paola, Kan., was arrested June 11 for misdemeanor possession of marijuana and paraphernalia. He is being held on $750 bond.

A burglary was reported June 4 at the residence of Tammy L. Smith and Cindy K. Gettel, on 190th Street. A side door had been forced open. Many items were taken, including a big screen TV, a camera, guitar, camcorder, and computer. The total value of stolen items is estimated to be over $9,000. The burglary occurred sometime between 6:30 p.m. on June 1 and 8:30 p.m. on June 4.
