A bench trial has been set for July 14, 2010, in a case brought by the State of Missouri, the Missouri Department of Natural Resources (DNR), and the Missouri Clean Water Commission against Daniel F. Froman and the Gallatin Livestock Auction.

The case, which will be heard by Judge Roger Prokes in the Daviess County Circuit Court, was filed in July 2008.

The involvement of the state in the case was prompted by complaints to the DNR from Sharon Berten against the Gallatin Livestock Auction for the pollution of her pond from sale barn runoff. She began complaining to Froman in 2007 and then filed her complaint with the DNR. If the DNR penalties against Froman were assessed today, they would total over $800,000.

Raymond Haight of the Missouri Attorney General’s office is representing the state in this case. Gallatin attorney Michael Arnold is representing Daniel Froman and the sale barn.

Daviess County Prosecuting Attorney Annie Gibson is prosecuting the the criminal case against Daniel Froman and the now defunct Gallatin Grain Company for grain theft, with assistance from the Attorney General’s office. Froman and his wife Pauline each face 22 felony counts of stealing grain and three felony counts of filing false financial statements. Over 100 claims were filed against the grain company through the Missouri Department of Agriculture, totaling over $4.5 million. Ineligible and withdrawn claims totaled over $1.3 million, making the grain theft over $3 million.
