As of April 23, Judge Daniel Chadwick has assumed primary responsibility for cases filed in Division I of the 43rd Judicial Circuit. Division I currently comprises Caldwell, Daviess and Livingston Counties. The order was issued by the presiding judge of the 43rd Judicial Circuit, Brent Elliott. Judge Chadwick was sworn in on April 18.

Judge Elliott now assumes primary responsibility for cases filed in Division II of the 43rd Judicial Circuit, which comprises Clinton and DeKalb Counties. Both Judge Elliott and Judge Chadwick have jurisdiction over all five counties in the 43rd Judicial Circuit.

Judge Chadwick was recently appointed by Gov. Jay Nixon as the new circuit judge for the 43rd Judicial Circuit, a position which became vacant upon the retirement Circuit Judge Warren L. McElwain, who retired after 31 years on the bench.

Civil cases filed: Jack Arnold, Carlotta Arnold, and David Gwinn, all of Jamesport, vs. Smithfield Foods Inc., David Townsend, Premium Standard Farms LLC, and KC2 Real Estate LLC, suit for damages.

The State of Missouri has filed Certificates of Lien, DOR taxes, against each of the following individuals: Jayson A. Huskey, Ronnie G. Smith, Robert F. Willits, and Roger L. Harris.

A transcript judgment was entered for the Division of Employment Security and against Barney R. Esbeck.

On April 21 before Judge Brent Elliott, two civil cases were dismissed, Robert Svobada vs. Gene and Becky Morris and Laura B. Zimmerman vs. Tammy and Kenneth Baldwin.

Dissolutions of marriage were granted April 21 to Randi Hogan from Robert Hogan; to Kristal Burnett from Paul Burnett; and to Jennifer Dickson from Ron Dickson.

Alan Sage vs John First was dismissed by the court.

Associate Division

Traci K. Adams, Highland, Kan., was charged April 21 with felony passing bad checks.

Defendants found guilty in the Associate division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases.

Jason R. Bennett, Cameron, probation violation on passing bad checks, probation revoked, 30 days jail.

Dana A. Wortman, Gallatin, animal abuse, suspended imposition of sentence, two years probation, 30 hours community service.

Bridget A. Kirkpatrick, Des Moines, Iowa, littering, 30 days jail, $25 fine; possession of drug paraphernalia, 30 days jail, consecutive, $25 fine.

Wayne A. Wollam, Winston, domestic assault amended to peace disturbance, suspended imposition of sentence, two years probation, 20 hours community service.

James E. Roney, Cameron, sexual misconduct amended to drunkenness or drinking in certain prohibited places, 90 days jail, $25 fine.

Patricia A. Weese, Cameron, passing bad checks, $25.

Monica Coin, Pattonsburg, peace disturbance, suspended imposition of sentence, two years probation, 20 hours community service.

Janis F. Creamer, Winston, domestic assault amended to peace disturbance, 48 hours jail, board bill paid by defendant.

Angela Ruch, Jamesport, probation violation on possession of marijuana and three counts of endangering welfare of child, probation revoked, 30 days on each count, consecutive, suspended execution of sentence, two years probation.

Justin T. Thomas, Trenton, driving while intoxicated, one day jail, board bill paid by defendant, $350 fine; careless and imprudent driving, $48.50 fine.

Traffic Fines

The following are traffic cases which were heard in the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $2,168.00 for 28 cases. The total fines assessed for defendants who reside in Missouri was $1,950.50 for 28 cases. Civil Court

Breach of Contract: A consent judgment was entered for HSBC Bank Nevada and against Gearl L. Rinehart. A default judgment was entered for RAB Performance and against Stephanie Burns.

Suits on Account: Consent judgments were entered for Midwestern Health and against Stephanie Swanstone; and for Discover Bank and against Gearl Lee Rinehart. Midwestern Health vs. Tracy Kirkendoll was dismissed by the court with prejudice.

Marriage

Johnnie Wayne Horton and Amanda Leona King, both of Chillicothe, were married April 26 by Judge Daren Adkins.

County Commission

James Lewis, bridge supervisor, met with the commission reporting that they will replace a culvert in Sheridan Township and make repairs this week to other sites as needed.

Bills were audited and paid.

The commission signed a proclamation declaring April 27 to be Natural Resources Conservation Service Day in Daviess County.

Harry Roberts and Michelle Reynolds, health insurance broker for the county, met with the commission and county employees to present the coverage that will become effective May 1.

The commission reviewed the bi-annual state bridge inspection reports noting the sites in need of repairs.

These are the approved minutes of April 19, 2010. All commissioners were present.

The courthouse will be closed on Friday, May 7 in observance of Truman’s birthday.

Sheriff’s Office

A burglary at Landes Oil in Jamesport was reported April 23 by owner Greg Landes. Entry was gained through the west door, which was shattered. Security cameras show that the break-in occurred at 12:30 a.m. The subject took an unknown quantity of cigarettes and then headed east on Highway 6 in an older white mini van.

Richard Patrick, 39, Bethany, was arrested April 21 for misdemeanor DWI. He was processed and held for 12-hours detoxification. A summons was issued.

To avoid further penalty, submit assessment sheets to the office by May 1.
