In the Daviess County Circuit Court, Associate Division, a jury trial held April 20 for Elizabeth Mary Jonassen was declared a mistrial by Judge Daren Adkins at 3:36 p.m. The jury notified the judge of deadlocks at 3 p.m. and 3:30 p.m. Jonassen was charged with misdemeanor resisting arrest and escape from custody. The trial had begun at 8:30 a.m. and was submitted to the jury at 1:30 p.m. The case has been set for plea/trial setting on May 24.

Circuit Court

On April 14, the Supreme Court of Missouri appointed Judge Larry D. Harman and the official court reporter of the 7th Judicial Circuit of Clay County to preside over two cases involving the now defunct Gallatin Grain Company. The two cases are State vs. Daniel Froman and State vs. Pauline Froman.

Civil case filed: In Re Delana C. Taylor, change of name; Daniel S. Adamson vs. Francis E. Adamson, dissolution of marriage; State vs. Eugene J. Robinson, waiver of extradition.

Before Judge Jason Kanoy on April 16, on a plea agreement, Kevin W. Caldwell plead guilty to distribution of a controlled substance near a school, class A felony, and to involuntary manslaughter, which was amended from a class C to a class D felony. A sentence assessment report was ordered.

In Sarah M. Dowell vs. Joseph Jack Dowell et al, a motion for change of judge was sustained.

In State vs. Mitchell Lee Edward Wood a change of venue to Livingston County was granted. Wood is charged with possession of controlled substance with intent to distribute.

Associate Division cases bound over to the Circuit Court: State vs. Shanan I. Francios, Moberly, theft/stealing, class C felony; State vs. Margo W. Smith, Coffey, passing bad checks, class C felony; State vs. Richie A. King, Hamilton, tampering with judicial proceeding, class C felony, and tampering with judicial officer, class C felony.

Breach of contract: Harrison County Hospital vs. Ruth M. Lewis was dismissed by the parties. Default judgments were entered for FIA Card Services N.A. and against Julie Martin; for Harrison County Hospital and against Teresa Heiber; for Ozark Financial Group and against Julie Martin.

Suits on account: Consent judgments were entered for Bureaus Investment and against Hallie Guess; for Capital One Auto Finance and against Charles E. King. A default judgment was entered for Midwestern Health and against Boyde and Juanita Dennis. Liberty Hospital vs. John and Carla Wood was dismissed by the parties.

County Commission

James Lewis, bridge supervisor, reported that they will make repairs to a culvert in Benton Township this week and other sites as needed.

Bills were audited and paid.

Harry Roberts, health insurance broker for the county, met with the commission to present the 2010 insurance rates. Community Health, provider for the past four years, is no longer offering coverage. Proposals were from Blue Cross, United Healthcare, Aetna and Principal. Blue Cross offered a cap for the second year’s premium and covered most of the regional physicians and hospitals. Danny Heldenbrand moved to accept the Blue Cross PPO. David Cox seconded. Cox – yes; Heldenbrand – yes; Critten – yes. Carried.

Dave Allen, road department, met with the commission regarding the location of brush to be removed.

The Senior Services Board reported that Carolee Dixon and Linda Evans were appointed to four year terms on that board.

A proclamation was declared that May will be "Motorcycle Awareness and You" month in Daviess County with the challenge to "Look Twice, Save a Life."

The commission inspected roads, tubes and brush in Jefferson, Marion, Benton and Salem Townships in the afternoon.

Sheriff’s Office

Larry Johnson, Gallatin, reported April 15 that tires and wheels valued around $1,200 had been stolen from his farm near Midway Avenue and 230th Street.

Shirley Baker, Altamont, reported April 12 that the controls for her tommy gate were stolen from her truck which had been parked in her driveway. The controls were valued at $500.
