Before Judge Jason Kanoy on March 26, the following cases were heard:
The jury trial that had been scheduled for Kevin W. Caldwell was set aside. The case was continued to April 16 for a plea agreement. He is charged with distribution of controlled substance near school, class A felony, and involuntary manslaughter, class C felony.
Orville N. Zeikle admitted violating probation, which was continued on the conditions of 30 days inpatient treatment, 40 days shock incarceration to be served on weekends, and 60 hours community service. Original charges are DWI and resisting arrest.
Jeffrey C. Matthews admitted probation violation and was continued on probation with 16 days shock incarceration at defendant’s expense, on original charges of endangering welfare of a child and possession with intent to deliver.
Before Judge James Valbracht on March 25, the following cases were heard:
Richard Brown was sentenced to four years in the Department of Corrections for felony stealing, execution of sentence suspended. He received five years probation.
In Farmers Bank vs. Sarah M. Dowell, a jury trial was set for Aug. 11-13.
Shawn P. Bunch and Cynthia M. Bunch each received a suspended imposition of sentence and probation for felony endangering the welfare of a child first degree.
Kenneth E. Archer was granted a change of venue to DeKalb County on two counts of child molestation first degree.
Keenan Daniel Critten plead guilty to an amended charge of DWI persistent offender, class D felony, and assault on law enforcement officer, class A misdemeanor. One misdemeanor was dismissed. On the felony, he was sentenced to four years in the Department of Corrections, execution of sentence suspended, and five years probation. On the misdemeanor, he received 10 days shock time in the regional jail.
Before Judge Daren Adkins on March 22, the following non-support cases were heard:
Probation was revoked for Cindy D. Beech on two counts, due to violations, and the previously entered sentence of four years on each count, consecutive, was ordered executed.
Probation was revoked for Joe Willie Huff on two charges, due to violations, and the previously entered sentence of four years on each count, consecutive, was ordered executed.
Probation was extended one year for Michael S. Brooks on two felony counts.
Probation was suspended and a warrant was issued March 24 for the arrest of Brock A. Larkin for probation violations on felony charges of DWI persistent offender, resisting arrest, no valid license for motorcycle and misdemeanor resisting arrest. Bond is denied pending revocation hearing.
Bond was revoked and a warrant issued for Ron Silkwood on March 30 for felony possession of controlled substance and misdemeanor endangering welfare of child and domestic assault, with bond set at $100,000 cash only.

State vs. Jason A. Short, Maysville, child molestation first degree, class B felony; statutory sodomy first degree, felony; sexual misconduct first degree, class A misdemeanor;
State vs. Ronda Marie VanDyke, change of venue from Clinton County, forgery, class C felony; two counts passing bad checks, class C felony;
Civil cases filed: Kenton D. Askins vs. Stacy L. Askins, dissolution of marriage.
In a change of venue from Daviess County to Livingston County, Brooke Marriott plead guilty on March 23 to stealing of an animal, class C felony, and stealing, class C felony. Nolle Prosequi was filed on four other charges. A sentence assessment report was ordered.
Associate Division
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed, with Judge Daren Adkins presiding. Additionally court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases.

Quoc B. Nguyen, Kansas City, possession of marijuana, 19 days jail; possession of paraphernalia, 19 days jail.
Clinton J. Hardin, Albany, probation violation on original charge of minor visibly intoxicated, probation revoked, two days jail (board bill paid by defendant).
Daniel W. Phelps, Moberly, probation violation on original charge of passing bad checks, probation revoked, probation extended one year from 4-7-10 with same conditions.
Eric S. Allnut, Hamilton, careless and imprudent driving involving an accident, $48.50.
Rebecca E. Anderson, Princeton, failure to drive on right half of roadway, $38.50.
Alyssa M. Goode, Des Moines, Iowa, possession of marijuana, suspended imposition of sentence, two years probation, two days shock jail (board bill paid by defendant).
Kevin L. Laytham, Bethany, careless and imprudent driving, $38.50.
Brian A. Benton, Kansas City, no valid license, $150; speeding, $88.50.
Linda S. Barr, Pattonsburg, peace disturbance, suspended imposition of sentence, two years probation, 20 hours community service.
Passing bad checks: Carrie Pyzer, Kansas City, $25; Eric W. Spears, Trenton, $25.
Before Judge Bart Spear, Matthew E. Labee, Jamesport, was sentenced to 10 days jail and $100 fine for resisting arrest and 126 days jail and $100 fine for assault of law enforcement officer.
Civil Court
Suit on account: Midland Funding LLC vs. Jason Lewis was dismissed by the parties. In Midwestern Health Management Inc. Vs. Charles A. Curtis and Christina L. Curtis, a default judgment was entered against Charles Curtis on Feb. 18; a consent judgment was entered against Christina Curtis on March 16.
Small Claims: Wendy S. Cannell vs. Steven Holcomb was dismissed by the parties.
County Commission
James Lewis, bridge supervisor, reported that they continue to haul rip rap to problem sites but are having difficulties with the condition of the roads.
A culvert will be replaced in Benton Township this week.
James Lewis, Don Ohlberg, Mark Gadberry and Shannon McCrary submitted their certificates of training for DOT regulations.
Bills were audited and paid.
An executed contract and performance bond in the amount of $320,000 was received from APAC Quarries for their part of the 2010 CART rock deliveries.
Ben Becerra, sheriff, met with the commission regarding employee scheduling.
Kevin Hudson, CPA, met with the commission to present the final audit for the years 2007 and 2008. He will forward a copy to the Federal Clearinghouse, Missouri Department of Transportation, and two copies to the State Auditor’s office.

Sheriff’s Office
A burglary at a Winston residence was reported March 29 by Jette Simecek. When she returned to her home after being gone overnight, a bedroom window was found open. Muddy foot prints were found in the residence. Simecek also stated that she was missing two $50 bills from a diaper bag.
Jonas Kurtz, 24, Jamesport, was arrested March 29 on 5 counts of misdemeanor passing bad checks.
George Rainey, 29, Newtown, was arrested March 25 for felony no valid license. He posted $10,000 bond.
Brock Larkin, 36, Jamesport, was arrested March 29 on a bond violation for an original charge of felony resisting arrest and DWI. Bond was denied.
Mitchell Renouf, 18, Winston, was arrested March 25 for misdemeanor domestic assault third degree. He posted $1,000 bond.
