Jan Stout, Child Support Prosecutor for the 43rd Judicial Circuit made up of Caldwell, Clinton, Daviess, DeKalb and Livingston counties, announced today that she will be resigning her position effective March 19 to campaign for Daviess County Associate Circuit Judge.

"There was some question as to whether I could hold the child support prosecutor position and be a judicial candidate," Stout said in a statement. "After the Office of Special Counsel was unable to give me a definitive answer, I requested an advisory opinion. I received their answer Tuesday afternoon indicating that I would need to resign my position or withdraw from the election."
The Office of Special Counsel is the final word in evaluating the application of the Hatch Act, which governs federal employees and positions receiving any federal funding. A knowing violation of the act could result in the loss of these funds.
Stout went on to say that she is committed to her campaign for judge and, after talking to her supporters, decided to resign her present position.
"This race is very important to me and something in which I strongly believe," Stout said. She has notified the prosecuting attorneys in the affected counties and they will soon be meeting to consider her replacement.
