James Lewis, bridge supervisor, reported that they will make repairs as needed this week.

Keith Johnson, Colonial Life Insurance, met with the commission regarding voluntary insurance for employees. No decision was made.

Bills were audited and paid.

The commission reviewed the comprehensive insurance coverage for all county property. The agent will be contacted with questions.

Georgia Maxwell, recorder, met with the commission with questions regarding the personnel policy.

At 1:30 p.m., as advertised, bids were opened for metal pipe. Winwater Co. and Metal Culverts, Inc. were the only bidders. David Cox moved to accept the bid from Metal Culverts, Inc. as the lowest and best bid. Lance Critten seconded the motion. Cox – Yes; Heldenbrand – yes; Critten – yes. Carried.

At 2:30 p.m., as advertised, bids were opened for crushed rock. All bid bonds were submitted. Bids were submitted from Trager Limestone, APAC, and Norris Aggregates. The matter was taken under advisement until a comparison study can be made.

Susie Tull, Daviess County Nursing and Rehab Center Administrator, contacted the commission reporting that the natural gas bill for the month of December 2009 was $1000 less than the same month in 2008, due to the new energy efficient furnace.

These are the approved minutes of Feb. 22, 2010. All commissioners were in attendance.

County Clerk

Absentee ballots for the April 6, 2010 election are now available in the county clerk’s office.

Sheriff’s Office

Burglaries at Premium Standard Farms, at the Scott Colby #5 and #6 farms located near Missouri Route B and 190 north of Jamesport, were reported by David E. Taylor, a loss control officer, on Feb. 20. Miscellaneous animal medications valued at over $8,000 were taken.

Kevin Caldwell, 31, Gallatin, has been charged with possession of controlled substance. Caldwell, who is an inmate at the regional jail, is accused of bringing medications identified as schedule two controlled substances into the jail. Bond is $35,000.

Janis Creamer, 56, Winston, was charged Feb. 23 with misdemeanor domestic assault. She posted $750 bond.

John Reeter, 22, Dawn, was arrested Feb. 27 for misdemeanor DWI, processed and released after 12-hour detoxification. A summons was issued.

Bradley Leatherman, 27, Chillicothe, was arrested Feb. 26 on two misdemeanor counts of violation of a full order of protection. He posted $2,000 bond.

Orville Zeikle, 36, Pattonsburg, was arrested March 1 on probation violations on original felony charges of DWI and resisting arrest. He is being held on $10,000 bond.

Charles Miller, 43, Coffey, was arrested March 1 for probation violations on an original felony charge of possession of controlled substance.

Circuit Court

Before Judge Brent Elliott on Feb. 24, the following cases were heard:

Mandy R. Broyles was sentenced to seven years in the Department of Corrections for DWI, aggravated offender, execution of sentence suspended. She received five years probation, with 60 day shock time in the regional jail. On a second count of operating vehicle without valid license, she was fined $150. A traffic ticket was dismissed.

In State of Missouri vs. Andrew H. Megaris, a judgment of forfeiture was entered on $8,000 cash which Megaris had planned to use to purchase illegal narcotics. The money now goes to the local school district.

Judge Elliott denied motions made by Wade A. St. Onge and Danielle M. Sanford to set aside their sentences.

Kenneth E. Archer’s motion for a change of judge was sustained. The case will be reassigned.

Before Judge James Valbracht on Feb 25, the following cases were heard:

Billy Christison entered an Alford plea of guilty to an amended charge of misdemeanor tampering with a witness. Imposition of sentence was suspended, and he received two years probation.

Victora Griffith received a suspended imposition of sentence for felony non-support. She was placed on five years probation.

The jury trial date for Robin Bryson was reset for June 11, 2010, on charges of possession of controlled substance and endangering welfare of a child.

A jury trial for Bobby R. Wheelbarger was set for May 12, 2010, on charges of DWI, persistent offender, and no valid license.

Cases bound over from Associate Division to Circuit Court: State vs. Mary J. Hampton, Maysville, four felony counts of passing bad checks; State vs. Abisai Benitiz, possession of controlled substance with intent to distribute.

Civil cases filed: Midwestern Health vs. John F. And Shawn Pettit, suit on account; State ex rel vs. Jason R. Hostetler, certificate of lien, Department of Revenue, taxes.

Associate Division

Jason S. Hines, 33, Altamont, was charged Feb. 11 with two counts of statutory rape second degree, class C felony. Another count of statutory rape was filed on March 1, as well as misdemeanor furnishing pornographic material to a minor, felony sexual exploitation of a minor, and misdemeanor child molestation. He is still being held on $45,000 bond.

Civil Court

Breach of contract: A consent judgment was entered for Ozark Financial and against Vernon C. Parman.

Suit on account: A default judgment was entered for Applied Bank and against Randy L. Ott.

Recorder’s Office
