John J. Moreno, 23, Gallatin, was charged Jan. 17 with felony statutory sodomy, two counts of felony tampering with a victim in a felony prosecution, misdemeanor endangering the welfare of a child, and three misdemeanor counts of supplying liquor to a minor. Moreno allegedly supplied alcohol to three minors at 405 S. Daviess Street in Gallatin on Jan. 17. According to the probable cause report made by Craig Wilson, Gallatin Police Department, Moreno allowed the juveniles to consume alcohol until one lost consciousness. While at the police station after his arrest, he attempted to intimidate the juveniles so that they would not make statements against him. He is being held on $35,000 bond.

Patrick Beck, 55, Kansas City, was arrested Jan. 15 for felony non-support. He is being held on $25,000 bond.

Nancy Poff, 23, Hamilton, was arrested Jan. 12 for a probation violation on an original charge of forgery. She is being held at the regional jail. Bond was denied.

Deanna Mason, 24, Pattonsburg, was arrested Jan. 12 for a probation violation on original charges of possession of controlled substance, possession of anhydrous ammonia in non-approved container, and possession of chemicals with intent to manufacture controlled substance. She is being held at the regional jail. Bond was denied.

County Commission

James Lewis, bridge supervisor, reported that they will make repairs on equipment and other repairs as needed this week.

The commission reviewed the personnel policy.

Trudi Burton inquired about the use of the lower floor of the building on Johnson Street for the Chamber of Commerce and Fine Arts Council. She was informed that it had been offered to other governmental organizations. Some response time from them is needed.

Reta Rains, collector-treasurer, met with the commission regarding investment needs in the next 90 days.

The commission discussed mileage reimbursements, leaving the amount at $.505 for the 2010 budget.

Joe Reed, Harrison Township, met with the commission regarding snow removal and other road maintenance.

Randy Railsback and Jackie Soptic, Green Hills Regional Planning Commission, met with the commission with budget requests for 2010 and updates on other projects in the county.

Sue Bird, circuit clerk, met with the commission regarding her 2010 budget.

Becky Simpson, Extension Council, met with the commission reporting that a joint annual meeting will be held with Caldwell County on Feb. 18, 2010, in Hamilton.

Donna Hibbs, Marion Township, met with the commission regarding the dumping of trash on her property.

Circuit Court

April Sharp was charged Jan. 14 with felony passing bad checks.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases.

Chase C. Smith, Cameron, possession of marijuana, 48 hours jail, board bill paid by defendant; driving while intoxicated, $350; minor in possession of alcohol, $150, 30 hours community service.

Matthew S. Goerne, Jamesport, fraudulent use of credit device amended to theft/stealing, class A misdemeanor, 10 days jail, board bill paid by defendant.

Logan C. Parmenter, St. Joseph, driving while intoxicated, suspended imposition of sentence, two years probation, 30 hours community service; minor in possession of alcohol, suspended imposition of sentence, two years probation, 30 hours community service.

Arlington E. Davis, Pattonsburg, no valid license, two days jail; driving while revoked, five days jail, board bill paid by defendant; possession of drug paraphernalia, $150; speeding, $28.50.

Faron Perry, Brimson, passing bad checks, $25.

Katrina M. Smith, Kenosha, Wis., possession of marijuana, two days jail, board bill paid by defendant.

Christopher Anderson, Weatherby, failure to tag deer, $98.

Michael D. Towell, Pottstown, Penn.., felony non-support amended to misdemeanor non-support, suspended imposition of sentence, two years probation.

Breach of contract: Consent judgments were entered for Capital One Bank (USA) NA and against Henry F. Kindelberger, for Gemini Capital Group and against Beverly Kindelberger. GE Money Bank vs. Ronald Price was dismissed by the parties. Arrow Financial Services vs. Marilyn L. Street was dismissed by the court without prejudice.

Suits on account: Default judgements were entered for Midwestern Health and against Robert and Sherry Gulley; for Midland Funding LLC and against Larry Sprague. Midwestern Health vs. Michael and Patricia Fisher was dismissed by the parties.
