On Nov. 1, 2009, the Associate Division and Circuit Division of the Daviess County Circuit Court consolidated into one court, to be known as Circuit Court, Daviess County.
All filings should be addressed to Circuit Court, Daviess County. All filings will be accepted in the second floor court office. The Daviess County Circuit Clerk is Sue Bird. Deputy clerks are Theresa Hamilton, Pam Howard, and Sandra Dustman. Karen Johnson is traffic clerk. Daren Adkins is the Daviess County Associate Circuit Judge.
Circuit Court
On Oct. 28, the following cases were heard by Judge Brent Elliott:
Daniel J. Myers admitted probation violations and was sentenced to four years in the Department of Corrections for felony non-support, to run consecutively to any other imposed sentences.
Matt J. Gaunt admitted probation violations and was sentenced to three years in the Department of Corrections on each of two felony counts of non-support, sentences to run concurrently.
Michael L. King admitted probation violations. He was sentenced to three years in the Department of Corrections for driving without a valid license, to run concurrently with Grundy County sentence.
In John William Rezek vs. State of Missouri, the motion to set aside judgment was withdrawn, and he was sentenced to six years in the Department of Corrections for DWI, chronic offender, with credit for time served.
A warrant was issued Oct. 28 for the arrest of Joe Willie Huff for probation violations on two felony charges of non-support. Bond was set at $35,000.
In State vs. Martin Mendez Pliego, due to suppression of evidence, the case was dismissed.
On Oct. 22, the court agreed that in exchange for posting another $20,000 bond, Pauline Froman would be released from house arrest, supervision by court services, and drug testing. The $20,000 surety bond was posted on Oct. 26. Mrs. Froman is charged with nine counts of grain theft and one count of filing false financial statements by grain dealers.
Civil cases filed: Tifny Otto next friend vs. Marquis Wheeler, personal injury, vehicular; Kevin R. Heldenbrand vs. Annette Lucassen, property damage; Jaci L. Chadwick vs. Jeremiah R. Chadwick, dissolution of marriage; State of Missouri vs. Andrew H. Megaris, petition for forfeiture of property.
Criminal cases: Jeffrey Merrill Wilcox, Raytown, was charged Oct. 28 with felony non-support on a change of venue from Livingston County. Timothy R. Thomas, Gallatin, was charged Nov. 2 with three counts of felony non-support. Andrew Hearne Megaris, Overland Park, Kan., was charged Oct. 29 with felony possession of controlled substance and misdemeanor possession of marijuana.
A dissolution of marriage was granted Nov. 3 to Suzanne Marie O’Connor from Darrell Ray O’Connor.
Traffic Fines
The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,788.50 for 28 cases. The total fines assessed for defendants who reside in Missouri was $4,472.50 for 34 cases. Marriage
Dean Allen Gugin and Autumn Danell Cockriel, both of Trenton, were married Oct. 27, 2009, by Judge Daren Adkins.
Sheriff’s Office
Brent Trimble, 36, Gallatin, was arrested Oct. 27 for child abuse, class C felony. Trimble allegedly kicked an underage child who was in his care on Sept. 5. He is being held on $35,000 bond.
Shalena Dickson, 25, Gallatin, was charged Oct. 31 with burglary second degree, class C felony; property damage second degree, class B misdemeanor, and trespass first degree, class B misdemeanor. She is accused of entering a residence on Elm Street in Gallatin without permission, causing property damage. She was arrested by Gallatin Officer David Francken while she was still in the residence. She is being held on $35,000 bond.
Jerome J. Weber, 68, Jamesport, was arrested Oct. 30 for misdemeanor animal abuse and neglect. He posted $1,000 bond.
Timothy Skinner, 21, Lathrop, was arrested Oct. 30 on probation violations for a misdemeanor charge of failure to register as sex offender. He is being held on $5,000 bond.
Alyssa Goode, 21, Des Moines, Iowa, was arrested Nov. 1 for misdemeanor possession of marijuana. She posted $500 bond.
Kayla Roberts, 21, Wichita, Kan., was arrested Nov. 2 for felony possession of cocaine and paraphernalia. She is being held on $35,000 bond.
Darrell Harris, 50, Gilman City, was arrested Oct. 27 for misdemeanor DWI. He was held for 12-hour detoxification and issued a summons.
Terrie and Leroy Hogan reported the theft of a 2001 Ford F-150 pickup on Oct. 31, from their residence on Quartz Avenue, Gallatin.
County Commission
James Lewis, bridge supervisor, reported that they will be working in Benton Township again, weather permitting, and adding rock to a low water crossing in Harrison Township.
Sue Bird, circuit clerk, met with the commission regarding the mandated consolidation of the courts, effective Nov. 1.
Wendell Burns, Marion Township, met with the commission concerning road conditions in that township.
The commission reviewed the third quarter budget to actual reports. Bills were audited and paid.
The commission inspected the building at 609 South Main finding leaks in the roof. The contractor will make repairs.
A resident of Washington Township met with the commission regarding the road conditions. The township does not have a maintainer operator. No notification was received from the township of an appointment for the vacancy on the board. Their financial statement has not been filed and the CART rock has not been released.
