On Oct. 23, Dale Ray Curtis, 19, Gallatin, was charged with felony burglary and assault, as well as misdemeanor counts of harassment (2), trespassing first degree, property damage second degree and assault third degree.. His brother, Kyle Curtis, 17, Gallatin, was charged with misdemeanor harassment, trespassing and minor in possession.
The charges stem from an incident which occurred on Yale Avenue, Hamilton, on Oct. 22, during which Dale Curtis allegedly entered a residence without permission and confronted two females who were babysitting for four young children there.
When the parents and owners of the residence, Brandy Hart and Daniel Romley, arrived home, Dale Curtis and his brother Kyle arrived within 10 minutes, and an argument ensued outside the residence.
The Curtises eventually left the scene. They later abandoned their vehicle in Daviess County and were arrested by Gallatin Police Chief Mark Richards. In the probable cause statement prepared by Deputy Todd Watson, the parents stated that Dale Ray Curtis had been warned to stay away several times in the past year, both in person and by phone. Dale Ray Curtis posted $35,000 bond, and Kyle Curtis posted $500 bond.
Zachary Barkovitz, 19, Overland Park, Kan., was charged Oct. 25 with misdemeanor possession of marijuana. He posted $500 bond.
John J. Wilson, 77, was arrested Oct. 24 for violation of bond. He was processed, held for 24 hours and released.
Sheri J. Baumgartner, 31, Belton, was arrested Oct. 23 for failure to appear on a misdemeanor charge of no valid license. She is being held on $1,200 bond.
Billy J. Wilson, 51, Pattonsburg, was arrested on felony probation and parole violations. Bond was denied.
County Commission
James Lewis, bridge supervisor, reported that they will be working in Benton Township again installing a tube.
David McWilliams met with the commission to let them know that the county will be needing to help pay for at least half of the cremation of an individual that doesn’t have any family or hardly any funds.
Angie Kirchner, Access II, met with the commission regarding the Head Start children using the Access II building for emergency shelter.
The commission met with Bob Burnett, the contractor and the land owners for a semi-final inspection on BRO 30.
Bills were audited and paid.

Circuit Court
Civil cases filed: State ex rel vs. Paul Kenneth Stanhope, certificate of lien, DOR, taxes;

In a case heard Oct. 20 by Judge Jason Kanoy, a change of venue to Livingston County was granted to Brooke N. Marriott, charged with two felony counts of theft of livestock, two felony counts of theft, and two misdemeanor counts of theft.
A jury trial was scheduled for Jan. 13, 2010, for Robin Bryson, who is charged with felony possession of a controlled substance and misdemeanor endangering welfare of a child, in a case heard by Judge James Valbracht on Oct. 23.
Associate Circuit Court
Earl L. Groom was charged Oct. 26 with one count of felony non-support.
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases.
